3. Approval of the minutes from the June 9, 2014 meeting.
VAC 14-4753: Vacation (1560 S. HAPPY HOLLOW RD./RECYCLING AND TRASH
COLLECTION FACILITY, 604): Submitted by CITY STAFF for property located at 1560 S.
HAPPY HOLLOW RD. The property is zoned 1-2, GENERAL INDUSTRIAL. The request is
to vacate 2.0 acres of existing street right-of-way.
ADM 14-4766: Administrative Item (DEANE SOLOMON RD./CREEK MEADOWS S/D,
247): Submitted by CLAY CARLTON for property located in CREEK MEADOWS S/D. The
property is zoned CPZD, COMMERCIAL PLANNED ZONING DISTRICT and contains
approximately 6.48 acres. The request is to amend the architectural design standards for
subdivision entry fencing.
ADM 14-4767: Administrative Item (EAST OF ADDINGTON AND CARTER/MARKS,
404): Submitted by BLEW AND ASSOCIATES for property located in EAST OF
ADDINGTON AVE. AND CARTER ST. The property is zoned RSF-4, RESIDENTIAL
SINGLE FAMILY, 4 UNITS PER ACRE and contains approximately 0.20 acres. The request
is for an extension of LSP 13-4296.
Motion:
Commissioner Cook made a motion to approve the consent agenda. Commissioner
Bunch seconded the motion. Upon roll call the motion passed with a vote of 7-0-0

CUP 14-4709: Conditional Use (WEDINGTON & MARINONI DR/THE COTTAGES, 441):
Submitted by CEI ENGINEERING for property located at WEDINGTON & MARINONI DR.
The property is zoned RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS PER ACRE, R -O,
RESIDENTIAL OFFICE, AND RMF -24, RESIDENTIAL MULTI -FAMILY 24 UNITS PER ACRE
and contains approximately 22.61 acres. The request is for additional parking.
R-PZD 14-4700: Residential Planned Zoning District (WEDINGTON & MARINONI
DR/THE COTTAGES, 441): Submitted by CEI ENGINEERING for property located at
WEDINGTON & MARINONI DR. The property is zoned RSF-4, RESIDENTIAL SINGLE
FAMILY, 4 UNITS PER ACRE, R -O, RESIDENTIAL OFFICE, AND RMF -24, RESIDENTIAL
MULTI -FAMILY 24 UNITS PER ACRE and contains approximately 22.61 acres. The request
is to rezone the property to R-PZD, Residential Planned Zoning District.
LSD 14-4702: Large Scale Development (WEDINGTON & MARINONI DR/THE
COTTAGES, 441): Submitted by CEI ENGINEERING for property located at WEDINGTON &
MARINONI DR. The property is zoned RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS
PER ACRE, R -O, RESIDENTIAL OFFICE, AND RMF -24, RESIDENTIAL MULTI -FAMILY 24
UNITS PER ACRE and contains approximately 22.61 acres. The request is for 150 residential
units.
Motion:
Commissioner Cook made a motion to table CUP 14-4709, R-PZD 14-4700, and LSD 14-
4702 indefinitely. Commissioner Selby seconded the motion. Upon roll call the motion
passed with a vote of 7-0-0.
CUP 14-4722: Conditional Use (1503 N. GARLAND AVE/ROTH, 404): Submitted by
HUNTER HAYNES for property located at 1503 N. GARLAND AVE. The property is zoned
RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS PER ACRE and contains approximately
3.39 acres. The request is for a duplex in an RSF-4 district.
Quin Thompson, Current Planner, read the staff report.
Hunter Haynes, Applicant, introduced the project briefly, describing recent revisions
intended to address staff concerns.
Terry Fallon, Neighbor, said that she was a member of the Hendrix -Maxwell neighborhood
association, and said that she objected to the conditional use because it would increase
density in the [single-family] neighborhood. She said that she had not been notified,
because her property isn't directly adjacent to the subject property, but that she would be
affected, and therefore disagrees with the public notification process in this case.
She stated that the nearby multi -family zoning had been a clerical error, and that it is not
appropriate to base future land -use questions on inappropriate and accidental zoning. She
said that each land use decision increases justification for future land use decisions that
may further erode the fabric of the neighborhood.
Tracy Hoskins, Chair, asked staff if notification signs had been placed on the property.
Kyle Cook, Commissioner, said that he opposed the conditional use because he felt that
the City should retain RSF-4 zoning as policy.
Craig Honchell, Commissioner, said that thought it likely that the notification signs were
difficult to see due to ongoing street improvements on Garland Avenue.
Kit Williams, City Attorney, commented that a conditional use requires 5 votes to pass,
rather than a majority.
Porter Winston, Commissioner, said that perhaps the item should be tabled to a future date
in order to provide opportunity for re -notification.

Kyle Cook, Commissioner, asked staff the difference between rezoning and conditional use
for this property.
Fulcher said that the conditional use provides for limited flexibility in uses without opening
up the property for the full uses of another zone.
Hoskins, said that higher densities are appropriate along traffic corridors and near the
University [of Arkansas]. He said that he would prefer to see a development of a style more
in harmony with the neighborhood.
Haynes agreed to table and allow the neighbors to attend and express concerns to the
Commission.
Motion:
Commissioner Winston made a motion to table CUP 14-4722 to the Planning Commission
meeting of July 14, 2014. Commissioner Bunch seconded the motion. Upon roll call the
motion passed with a vote of 7-0-0.
New Business:
LSD 14-4751: Large Scale Development (1666 S. INDUSTRIAL PLACE/PACKAGING
SPECIALTIES, 604): Submitted by BATES & ASSOCIATES for property located at 1666 S.
INDUSTRIAL PLACE. The property is zoned 1-2, GENERAL INDUSTRIAL, and contains
approximately 4.76 acres. The request is for construction of a 48,368 square foot
warehouse.
Jesse Fulcher, Senior Planner, read the staff report.
Evan Niehues stated that they've turned in a conditional use application to reduce the
parking requirements, and have worked with the Fire Department on access around the
building.
Commission Winston asked for an explanation.
Niehues stated they don't need the parking lot. There is parking on the adjacent property.
Commission Hoskins went of the Subdivision Committee meeting.
Niehues stated that was was important that they start construction soon.
Commission Hoskins asked to vote on the parking separately.
Motion #1:
Commissioner Winston made a motion regarding LSD 14-4751 to deny the variance of
Chapter 172.02 as recommended by staff. Commissioner Cook seconded the motion.
Upon roll call the motion passed with a vote of 5-2-0. Commissioners Noble and
Honchell voted `no'.
Motion #2:
Commissioner Winston made a motion to approve LSD 14-4751. Commissioner Selby
seconded the motion. Upon roll call the motion passed with a vote of 7-0-0.
CUP 14-4728: Conditional Use (3875 N. SHILOH/DISCOUNT TIRE, 174): Submitted by
VASQUEZ ENGINEERING for property located at 3875 N. SHILOH DR. The property is
zoned C-2, THOROUGHFARE COMMERCIAL and contains approximately 1.47 acres.
The request is for a conditional use permit for additional parking.
LSD 14-4727: Large Scale Development (3875 N. SHILOH DRIDISCOUNT TIRE, 174):
Submitted by VASQUEZ ENGINEERING for property located at 3875 N. SHILOH DR. The
property is zoned C-2, THOROUGHFARE COMMERCIAL, and contains approximately
1.47 acres. The request is for construction of a 7,322 square foot retail store.
Jesse Fulcher, Senior Planner, read the staff report.
Commissioner Winston discussed his reasoning for supporting the variance in front of
the store.
Juan Vasquez, applicant, stated that all work is done inside. The parking is needed based
on experience of other stores.
Commissioner Honchell asked if there were any concerns from Red Lobster.
Vasquez stated that all work was inside the service area.
Motion:
Commissioner Cook made a motion to approve CUP 14-4728 and LSD 14-4727.
Commissioner Winston seconded the motion. Upon roll call the motion passed with a
vote of 7-0-0.
