3. Approval of the minutes from the June 23, 2014 meeting.
Motion:
Commissioner Chesser made a motion to approve the consent agenda. Commissioner
Cook seconded the motion. Upon roll call the motion passed with a vote of 5-0-0
4. Old Business:
CUP 14-4722: Conditional Use (1503 N. GARLAND AVE/ROTH, 404): Submitted by
HUNTER HAYNES for property located at 1503 N. GARLAND AVE. The property is zoned
RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS PER ACRE and contains approximately
0.18 acres. The request is for a duplex in an RSF-4 district.
Quin Thompson, Current Planner, read the staff report.
Hunter Haynes, Applicant, said that the project had been redesigned according to urban
residential design standards. He said that the project represents a good example of the
`missing middle' housing type: medium density developments in walkable urban areas. He
added that the project would provide an appropriate buffer between a principal arterial street
[Garland Avenue] and single-family residences.

He said that the development would not increase traffic flow through Maxwell Street, which
was a concern of Mr. Mackay, a neighbor who sent staff an e-mail expressing his opposition
to the project.
He said that the project did not exceed the height limit allowed in the RSF-4 zoning district.
Public comment:
Joyce Richards, a neighbor, said that as zoning map errors were responsible for nearby
zoning map errors, there should be no further precedent should be set. She said that she is
opposed to more encroachment into the neighborhood by multi -family development. She
added that recently homes had been renovated in the neighborhood, and that there was new
investment in the area.
Terry Fallon, a neighbor, said that she was still opposed to the development of a 3 story
duplex on the lot. She noted some errors that had previously been included in the staff report,
saying that the actual lot size was not 3 acres but 0.18 acres.
She pointed out that planning staff still had concerns about ingress/egress and parking with
the proposed development. She also noted that she would be supportive of some types of
development on Garland Avenue, and quoted Lewis Mumford.
No more public comment.
William Chesser, Commissioner, asked staff to clarify the past zoning errors mentioned.
Andrew Garner, Planning Director, explained the history of the zoning error.
Chesser said that he had lived nearby and felt that the project was appropriate on Garland,
that the request met the goals of City Plan 2030, and that he would support the request.
Kyle Cook, Commissioner, said that he felt that single-family neighborhoods in general were
being eroded, and that this neighborhood was struggling to maintain its fabric.
Craig Honchell, Commissioner, said that he agreed with Mr. Cook, and that he preferred to
see single-family homes on one side of Garland. He said that he was concerned that the PC
would set a precedent, and that many lots would follow a similar course.
Janet Selby, Commissioner, said that she was in agreement with Mssrs Cook and Honchell.
Tracy Hoskins, Commissioner, said that he did not see that this project would have any
impact on Maxwell Street. He asked staff whether the development was expected to have an
adverse impact on traffic on Garland Avenue.
Thompson said that the low level of traffic generated by this project would not likely impact
Garland Avenue negatively.
Hoskins said that the precedent that Mr. Honchell was concerned with had been set by the
City Plan 2030, not by this Conditional Use Permit request. He then asked staff about the
condition of the property.
Thompson responded that the condition was poor, and noted as such by the Washington
County Assessor.
Hoskins said that it makes sense to have higher density developments near the University
and along major traffic corridors, and that he would definitely support the request. He
suggested to Mr. Haynes that tabling might be wise due to the lack of a full Planning
Commission.
Haynes requested that the item be tabled to the July 28, 2014 Planning Commission meeting.
Garner recommended tabling.
Motion:
Commissioner Cook made a motion to table CUP 14-4722 to the 7-28-14 meeting.
Commissioner Selby seconded the motion. Upon roll call the motion passed with a
vote of 5-0-0.

New Business:
CUP 14-4760: Conditional Use (3617 E. HUNTSVILLE RD/HENSCHELL, 529):
Submitted by TAYLOR HENSCHELL for property located at 3617 E. HUNTSVILLE RD. The
property is zoned RMF -24, RESIDENTIAL MULTI -FAMILY, 24 UNITS PER ACRE and
contains approximately 0.94 acres. The request is for an accessory structure that exceeds
50% the size of the principal structure.
Jesse Fulcher, Senior Planner, read the staff report.
Taylor Henschell, applicant, had no further comment.
No public comment was presented.
Motion:
Commissioner Chesser made a motion to approve CUP 14-4760. Commissioner Cook
seconded the motion. Upon roll call the motion passed with a vote of 5-0-0.
RZN 14-4763: Rezone (SE CORNER GREGG AVE. & ASH ST./CANDLELIGHT PLACE
APTS, 367): Submitted by J. TAYLOR HURST for property located at SE CORNER GREGG
AVE. & ASH ST. The property is zoned RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS
PER ACRE and contains approximately 0.94 acres. The request is to rezone the property
to RMF -24, RESIDENTIAL MULTI FAMILY, 24 UNITS PER ACRE.

Taylor Hurst, Applicant, was present to answer questions.
No public comment was presented.
William Chesser, Commissioner, said that he had lived nearby and that he supported the
rezone request.
Motion:
Commissioner Chesser made a motion to forward RZN 14-4763 to City Council with a
recommendation for approval. Commissioner Selby seconded the motion. Upon roll call
the motion passed with a vote of 5-0-0.
ADM 14-4720 Administrative Item (UPDATES TO THE DRAINAGE CRITERIA MANUAL
AND UDC AMENDMENT CHAPTER 156 VARIANCES; CHAPTER 169 PHYSICAL
ALTERATION OF LAND; CHAPTER 170 STORMWATER MANAGEMENT, DRAINAGE
AND EROSION CONTROL; CHAPTER 179 LOW IMPACT DEVELOPMENT): Submitted
by CITY ENGINEERING STAFF for updates to the Drainage Criteria Manual and revisions
to the Unified Development Code, Chapters 156, 169, 170, and 179.
Sarah Wrede, Floodplain Administrator, gave the staff report.
No public comment was presented.
Commissioner Honchell discussed that it made good sense to me. Hi did not have any
questions.
Commissioner Chesser discussed that it looks good.
Commissioner Cook discussed that it looks like we are just cleaning up what we have.
Commissioner Hoskins asked how many local consultants were spoken with for
feedback.
Wrede discussed a list of various parties that have continued to be updated on these
changes. She guessed about 10-15 on this list from firms, as well as some professors that
gave input.
Chris Brown, City Engineer, discussed that we have been allowing the LID portion of the
manual to be used for the additional parking lot areas. This has been used as a reference
manual for the past couple of months. He discussed that one engineer gave us some very
specific feedback after utilizing the manual on a project and specific sizing of the detention
pond that were modified because of their feedback.
Commissioner Hoskins discussed changes in stormwater detention about eliminating
freeboard. Are not changing the methods for calculating stormwater?
Brown discussed the various stormwater methods used for calculation. We are generally
sticking with the SCS method for sizing a detention pond. There are many more modeling
software methods available and we are changing our practices to accommodate these
new methods.
Commissioner Hoskins asked about how it will affect new projects.
Brown discussed that there will be a learning curve and our staff is willing and able to help
out. We will have to see as developments come through how we may need to tweak the
manual.
Commissioner Hoskins asked how it will impact the amount of property that is set aside
to perform these changes?
Brown discussed that our goal is not to increase the cost of development. Get rid of the
freeboard, use the detention pond more often as the orifice is much smaller. What we
were shooting for was not to increase the size of detention areas but to make it work better
for us.
Commissioner Hoskins discussed that the City Engineer now has more authority to grant
variances. He asked about more water being stored in the ponds.
Brown discussed dry ponds and wet ponds. He discussed that the model requires 40
hours to drain detention ponds. There are some other LID features available for use in the
bottom of the pond, but it is not a requirement.
Commissioner Chesser confirmed that you use the pond longer. This will make the use
of rain gardens and LID easier.
Brown discussed that now there is a method for LID to accommodate stormwater and to
reduce the detention pond size. The problems that we had in the old manual is that the
everyday rainfall up to the 2 -year storm was being let through the detention pond. This will
contain those smaller rains much better to prevent erosion and reducing channelization
offsite.
Motion:
Commissioner Chesser made a motion to forward ADM 14-4720 to City Council with a
recommendation for approval. Commissioner Cook seconded the motion. Upon roll call
the motion passed with a vote of 5-0-0.
