Call to Order: 5:30 PM, Tracy Hoskins 2. In Attendance: Tracy Hoskins, Ron Autry, Sarah Bunch, Craig Honchell, William Chesser, Kyle Cook, Ryan Noble, Porter Winston, and Janet Selby Absent: Staff: Andrew Garner, Jesse Fulcher, Quin Thompson, and Kit Williams 3. Approval of the minutes from the May 12, 2014 meeting. Motion: Commissioner Chesser made a motion to approve the 5-12-14 minutes. Commissioner Cook seconded the motion. Upon roll call the motion passed with a vote of 9-0-0. 4. New Business: CUP 14-4723: Conditional Use (1979 S. FINGER RD/PAYNE, 596): Submitted by REID & ASSOCIATES for property located at 1979 S. FINGER RD. The property is zoned R -A, RESIDENTIAL -AGRICULTURAL and contains approximately 14.80 acres. The request is for a tandem lot. Quin Thompson, Current Planner, read the staff report. Alan Reid, applicant/owner's representative, stated that he was in full agreement with staff's recommendations. Public comment: Joe Whitlatch, neighbor, said that he was concerned about the amount of development that was intended for the site, and that he was not opposed to two or three houses being built. Kendra Payne, daughter of the owner, said that the reason for splitting the lot was to provide home sites for family members. William Chesser, Commissioner, asked staff about the reasoning for limiting creek crossings, saying that it appeared that lot 'C' would be able to have a creek crossing. Thompson responded that staff considered that, because there are two existing lots on the property, the land owner had the right, pending City Engineer review, to cross the stream with a drive for one residence on each lot. The limitation was recommended only for the one new, or tandem. lot. Ron Autry, Commissioner, asked where houses were likely to be located. Kendra Payne said the intention is to build one house on each of the three lots to be located east of the stream. Motion: Commissioner Winston made a motion to approve CUP14-4723 as recommended by staff. Commissioner Cook seconded the motion. Upon roll call the motion passed with a vote of 9-0-0. CUP 14-4722: Conditional Use (1503 N. GARLAND AVE/ROTH, 404): Submitted by HUNTER HAYNES for property located at 1503 N. GARLAND AVE. The property is zoned RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS PER ACRE and contains approximately 7,600 square feet. The request is for a duplex in the RSF-4 district. This item was requested to be tabled by the applicant. Motion: Commissioner Winston made a motion to table CUP 14-4722 to the 06-09-2014 meeting. Commissioner Chesser seconded the motion. Upon roll call the motion passed with a vote of 9-0-0. CUP 14-4730: Conditional Use (372 W. DICKSON ST./FOOD TRUCK COURT, 404): Submitted by ZAC WOODEN for property located at 372 W. DICKSON ST. The property is zoned MSC — MAIN STREET/CENTER and contains approximately 0.17 acres. The request is for a mobile food vending court and parking waiver. Andrew Garner, City Planning Director, gave the staff report. Zac Wooden, applicant was present for question. Public comment: Matthew Petty, in support of the parking waiver and mobile vendor court. He is the one who encouraged Zac Wooden to move forward with this request. No more public comment was presented. Winston asked about trash collection. Wooden discussed no dumpster onsite. Hoskins asked about surrounding businesses commenting. Garner said that no comments have been provided. Hoskins asked about the parking demand. Garner said that staff didn't feel payment into the escrow would be warranted for this change in use. Hoskins discussed that this is an appropriate way of doing mobile vendors. The only issue is that this ordinance is very new. I would think it would be prudent to limit this to a year or two to test it out. If it is an open ended conditional use permit it doesn't give us a limitation. Chesser asked about reviewing CUPs. Williams discussed that only if a condition is violated it could be brought back. Maybe you could empower the planning division to approve it if there have been no complaint. Chesser asked if it was common. Williams discussed the process to bring an item back. I would recommend you empower the planning department if there have been changes in the ordinances or complaints to the planning division. Motion: Commissioner Chesser made a motion to approve CUP 14-4730 as recommended by staff, adding condition of approval #7 that the Planning Division shall be able to bring this conditional use permit back to the Planning Commission for the next two years if there are substantial changes in the ordinance or if the City has received valid complaints about this use. Commissioner Autry seconded the motion. Upon roll call the motion passed with a vote of 9-0-0. 3 CUP 14-4710: Conditional Use (NW CORNER OF WEST AND LAFAYETTE/SUSTAINABLE URBAN MOBILITY, 484): Submitted by DeMX ARCHITECTURE for property located at NE CORNER OF WEST AND LAFAYETTE. The property is zoned DG, DOWNTOWN GENERAL and contains approximately 0.08 acres. The request is for a conditional use to allow Use Unit 17, Transportation, Trades, and Services for a sharing/rental organization. Jesse Fulcher, Senior Planner, read the staff report. No public comment was presented. Tim Maddox, applicant, stated he agreed with conditions. Commission Cook asked about the thought process for using a storage container. Andrew Garner, City Planning Director, stated that this will allow a temporary use of the property while preserving the existing gas station. Commissioner Honchell asked if the Police Department has reviewed the request. Bob Unger, applicant, stated that the Police Department reviewed the concept. The drivers must have a license and be insured. The vehicles can't go on roads posted over 35 MPH, but they are setting a rule of only 30 MPH. Commissioner Chesser asked if we control vehicle speed. Garner stated staff didn't review the speed requirements on a public street. That is enforced by other agencies. Commissioner Hoskins asked if the building would have bathrooms and meet all building codes. Unger stated it would. Commissioner Hoskins stated he couldn't support the building architecture. Commissioner Chesser described the use of storage containers in other situations and that they can be well designed. Fulcher stated the building meets building code and downtown design standards with the exception of the two variances. Commissioner Cook asked how many vehicles they will have. Unger stated 5 or 6. The shipping container is being used because it puts the property to use and they are only planning on being there for a few years. The vehicles will also be for sale. Commissioner Winston stated that the building matches the use, which is green and mobile. Not concerned with the architecture. 9 Motion: Commissioner Winston made a motion to approve CUP 14-4710 as recommended by staff. Commissioner Chesser seconded the motion. Upon roll call the motion passed with a vote of 7-2-0. Commissioners Honchell and Hoskins voted `no'. CUP 14-4709: Conditional Use (WEDINGTON & MARINONI DRITHE COTTAGES, 441): Submitted by CEI ENGINEERING for property located at WEDINGTON & MARINONI DR. The property is zoned RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS PER ACRE, R -O, RESIDENTIAL OFFICE, AND RMF -24, RESIDENTIAL MULTI -FAMILY 24 UNITS PER ACRE and contains approximately 22.61 acres. The request is for additional parking. R-PZD 14-4700: Residential Planned Zoning District (WEDINGTON & MARINONI DRITHE COTTAGES, 441): Submitted by CEI ENGINEERING for property located at WEDINGTON & MARINONI DR. The property is zoned RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS PER ACRE, R -O, RESIDENTIAL OFFICE, AND RMF -24, RESIDENTIAL MULTI -FAMILY 24 UNITS PER ACRE and contains approximately 22.61 acres. The request is to rezone the property to R-PZD, Residential Planned Zoning District. LSD 14-4702: Large Scale Development (WEDINGTON & MARINONI DRITHE COTTAGES, 441): Submitted by CEI ENGINEERING for property located at WEDINGTON & MARINONI DR. The property is zoned RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS PER ACRE, R -O, RESIDENTIAL OFFICE, AND RMF -24, RESIDENTIAL MULTI -FAMILY 24 UNITS PER ACRE and contains approximately 22.61 acres. The request is for 150 residential units. Andrew Garner, City Planning Director, gave the staff report. Nathan Street, CEI Engineering, Inc. was present for questions. Commissioner Selby discussed concerns with traffic. Bunch shared the same concerns with Wedington. Stoplights that are very close together. We have all gotten calls and emails from the neighbors. My other concern is if you do not connect. Public Comment: April Mitchell, Loren Circle, improvements to Maple right behind our house. Are they taking our right-of-way? Sarah Lewis, lives on Berry Street. Traffic is very important to consider and storm water. All across Berry and Ora have drainage issues that will need to be considered. About six years ago the University Heights Neighborhood looked at traffic issues through these areas and we will want to use this study as a tool. Bobby Kelton, 672 N. Gray. Love the neighborhood. We looked at this and what this property is already zoned as. This won't help the school district. The current zoning seems fit for development. Donna Daniels lives on Loren Circle. I have a number of concerns about this development. You will hear them now and in a month. ON the Feb 24th Planning meeting you said you would be surprised if there would ever be a PZD. You said this is a decent plan but it is not in the right location. There are some major concerns. There is not enough parking for guests and parents. There has been no consideration about this or scooter parking. They will either come to the school with a car and a scooter. These are real problems. Last fall vacancy was at 14% in student apartments and 7% in other apartments. This is a major concern. The traffic study has no date? March 26th was during spring break. What the residents would like is a comprehensive study that looks at all roads south of Wedington, west of Garland, all the way to 1-49. She discussed student traffic patterns. Razorback Road has new 900 parking spots. Widening Razorback Road starts in June, phase 11 starts in September. Work on Halsell and Sang is underway. All of these projects affect a traffic study. We have seen what the highway department is proposing. Capstone Student Housing have sold many of their properties to a partner and once they are sold they are not single family. After they sell it all of their wonderful amenities go out of the window. They ended up polluting an aquifer in San Marcos. There are numerous problems with this development and you can hear more. Tim Coucil, 524 N. Sang. I have a problem with the rezoning request. The neighborhood became a rental property. If the zoning is changed where they are inviting 5 bedrooms, it becomes exacerbated and becomes unmanageable. It will change the character and nature of the neighborhood. The people who are in favor of the proposal say that this is what the students want. Rhenna Lines, corner of Cleveland and Sang, work at the university. Hate the traffic it is very heavy and dangerous. I know this is university traffic. Putting student housing in that big field and fight traffic on Wedington. They will go down Cleveland. They will take the outlet on Sang then go down Cleveland. I am very opposed to the outlet on Sang. I am not entirely opposed to the project but I do not want them driving through my neighborhood. Deborah Boddington, Ward 4 for 30 years. I second the comments of my neighbors. I have real concerns with public safety and infrastructure. Really the nature of the project is a luxurious student dorm that looks real nice on the outside. The safety and the infrastructure are concerns. No more public comment was presented. Honchell asked about the state highway department planning. We always try to play catch- up after the fact. He discussed traffic on Wedington. He discussed Shiloh and Futrall should be evaluated. Chesser asked if public streets will receive additional traffic Winston discussed that his overall view is that there should be higher density of this area closer to the interchange. Generally when we have this kind of development you have a transition from the commercial areas to the neighborhoods to the east. Autry discussed our tour of the site and asked for street improvements to Lonnie Avenue. 702 spaces will be a nuisance. He researched Capstone project. There were numerous negative comments about the development in Auburn, AL. You are putting traffic over onto Lonnie and Lincolnwood Drive and traffic created by this development. It will compound this. Norman, OK had a lot of great responses. Once the new management took over in Auburn it kind of fell apart. We have several of these in place. There is the potential for more and more of these types of these developments. We could have under -populated student housing developments that could be dangerous in more ways than one. Honchell discussed that these roads are not designed for this type of traffic load Hoskins responded that no improvements to Maple are proposed. He addressed comments about storm water drainage and grading should be addressed by City ordinance. I see the traffic study questions will continue to come up. When I was on the subdivision committee that saw this the first time. We need connectivity, but we don't like where it connects. I have gone back and forth on this project. During the boom one of the things that got us into trouble was suburban sprawl. That created our traffic problems. While we want to develop tighter to the core, what we have is another urban center which is called the University of Arkansas. While we want to have student housing close to the university, we see these projects creeping out into the neighborhoods. We are potentially making the same mistake by drifting student housing further out into our neighborhoods. He discussed the connections that have been made and the problems they would create. see real problems and am interested in see Motion for CUP 14-4709, R-PZD14-4700, and LSD 14-4702: Commissioner Chesser made a motion to table CUP 14-4709, R-PZD14-4700, and LSD 14-4702 to the 06-23-2014 meeting.
