Approval of Consent Agenda: Yes Approval of the minutes from the March 10, 2014 meeting. ADM 14-4652 Administrative Item (UDC AMENDMENT CHAPTER 156 VARIANCES): Submitted by CITY PLANNING STAFF for revisions to the Unified Development Code, Chapter 156. The proposal is to clarify that variances of Chapter 172: Parking and Loading may be requested. Motion: Commissioner Winston made a motion to approve the consent agenda. Old Business: RZN 14-4618: Rezone (SOUTHWEST CORNER OF PADDOCK LANE AND HAPPY HOLLOW RD/PADDOCK SD, 526): Submitted by BLEW AND ASSOCIATES for property located AT THE SOUTHWEST CORNER OF PADDOCK LANE AND HAPPY HOLLOW ROAD. The property is zoned R-PZD, RESIDENTIAL PLANNED ZONING DISTRICT and contains approximately 9.77 acres. The request is to rezone the property to RSF-8, RESIDENTIAL SINGLE-FAMILY, 8 UNITS PER ACRE and NC, NEIGHBORHOOD CONSERVATION. Jesse Fulcher, Senior Planner, read the staff report. No public comment was presented. Commissioner Winston stated that this was a good zoning change from the PZD. Motion : Commissioner Winston made a motion to forward RZN 14-4618 to City Council. New Business: RZN 14-4645: Rezone (NORTH OF ALBERTA ST. AND WEST OF THE COVES/THE COVES, 555): Submitted by KIM HESSE for property located at NORTH OF ALBERTA ST. AND WEST OF THE COVES. The property is zoned RPZD, RESIDENTIAL PLANNED ZONING DISTRICT and contains approximately 10.22 acres. The request is to rezone the property to RSF-8, RESIDENTIAL SINGLE-FAMILY, 8 UNITS PER ACRE and NC, NEIGHBORHOOD CONSERVATION. Jesse Fulcher, Senior Planner, read the staff report. No public comment was presented. Daniel Ellis, applicant, stated he had no additional comments. Motion: Commissioner Winston made a motion to forward RZN 14-4645 to City Council. Commissioner Chesser seconded the motion. Upon roll call the motion passed with a vote of 6-0-0. Planning Commission April 14, 2014 3 Agenda Item 1 Minutes 3-24-14 Page 3 of 12 LSD 14-4640: Large Scale Development (SOUTHWEST CORNER OF SHILOH AND FOXGLOVE/CRAIN AUTOMOTIVE, 287): Submitted by JORGENSEN AND ASSOCIATES for property located at THE SOUTHWEST CORNER OF SHILOH AND FOXGLOVE. The property is zoned CPZD, COMMERCIAL PLANNED ZONING DISTRICT/SPRINGWOODS and contains 6.61 acres. The request is for a 30,000 square foot retail and service building and display lot. Jesse Fulcher, Senior Planner, read the staff report. There is also a landscape variance that needs to be addressed to allow the applicant to group the shrubs along the edge of the parking lot. Public comment: Aubry Shepard, citizen, asked the applicant to utilize native plants. No more comment was presented. Commission Winston asked about the west elevation. Fulcher stated it wasn't visible from the street and did not need to meet the minimum design requirements. Ken Eastin, Urban Forester, stated that native shrubs were a part of the planting plan. Motion: Commissioner Winston made a motion to approve LSD 14-4640 conditions, including adding a condition to approve a variance groupings. Commissioner Chesser seconded the motion. Upon roll passed with a vote of 6-0-0. in favor of all to allow shrub call the motion Planning Commission April 14, 2014 4 Agenda Item 1 Minutes 3-24-14 Page 4 of 12 ADM 14-4648: Administrative Item (FOREST HILLS PZD, 440): Submitted by JOHN ALFORD for property located in PLANNING AREA 1 OF THE FOREST HILLS PZD. The property is zoned RPZD, RESIDENTIAL PLANNED ZONING DISTRICT and contains approximately 22.41 acres. The request is to amend the architectural design standards for Planning Area 1. Jesse Fulcher, Senior Planner, read the staff report. No public comment was presented. Brian Nebel, applicant, stated they were in agreement with the language proposed by staff. They ran a calculation on the building materials and they meet the revised design standards. Motion: Commissioner Chesser made a motion to forward ADM 14-4648 to City Council with a recommendation to approve the request. Commissioner Autry seconded the motion. Upon roll call the motion passed with a vote of 6-0-0. Planning Commission April 14, 2014 5 Agenda Item 1 Minutes 3-24-14 Page 5 of 12 CUP 14-4649: Conditional Use (FOREST HILLS PZD/FREDDY'S FROZEN CUSTARD, 440): Submitted by CDS DEVELOPMENT SERVICES for property located at LOT 15 OF THE FOREST HILLS PZD. The property is zoned RPZD, RESIDENTIAL PLANNED ZONING DISTRICT and contains approximately 1.35 acres. The request is for a conditional use permit to allow more parking than allowed by code. Jesse Fulcher, Senior Planner, read the staff report. Jamie Rheem, applicant, discussed the parking demands for other stores in Arkansas and Missouri. They have re -worked the design to accomdate the no -build to zone required by Neighborhood Market and they want the ADA parking spaces close to the building for safety purposes. The site work won't allow preservation of the western tree. Public comment: Aubry Shepard, citizen, stated they should incorporate trees into site design. No more public comment was presented. Commissioner Bunch asked about the condition of the trees and what "good" condition meant. Ken Eastin, Urban Forester, stated that good/excellent is top of the line condition. Commission Hoskins stated he had doubts about the survival of the western tree after construction was complete. It looks like they've tried to work the plan around the trees. Eastin stated that the eastern tree is definitely worth preserving, but current plan doesn't allow it. Commissioner Hoskins asked how close construction could take place to the tree. Eastin stated no closer than the drip line, but that could still cause problems for the tree. Commissioner Hoskins asked if the current plan would preserve the tree. Eastin stated no, the grading needed to move out from the tree line. Rhemm stated he felt confident that they could make the plan work and save the eastern tree. Kit Williams, City Attorney, stated that the applicant will need to work with the Urban Forester to ensure the tree will survive. Commissioner Winston stated he was supportive of Commissioner Hoskins comments. Commissioner Chesser asked for the definition of "fair" condition as it applied to the western tree. Eastin stated that there may be some dead wood or insect damage, but that is was still a healthy tree. Planning Commission April 14, 2014 6 Agenda Item 1 Minutes 3-24-14 Page 6 of 12 Commissioner Chesser stated he was confused why we wouldn't try and save this tree, that it was possible to preserve it as well. Commissioner Honchell stated we agreed with Commission Hoskins comments. Motion: Commissioner Hoskins made a motion to approve CUP 14-4649 with the condition that the western tree may be removed, but the eastern tree shall be preserved. Commissioner Winston seconded the motion. Upon roll call the motion passed with a vote of 5-1-0. Commissioner Chesser voted "no". Planning Commission April 14, 2014 7 Agenda Item 1 Minutes 3-24-14 Page 7 of 12 LSD 13-4568: Large Scale Development (NORTHWEST CORNER OF MOUNT COMFORT ROAD AND SHILOH DRIVE/KUM & GO, 329): Submitted by CEI ENGINEERING for property located at the NORTHWEST CORNER OF MOUNT COMFORT ROAD AND SHILOH DRIVE. The property is zoned C-1, NEIGHBORHOOD COMMERCIAL and contains approximately 1.69 acres. The request is to build a 4,991 square foot gas station with associated parking. Jesse Fulcher, Senior Planner, read the staff report. No public comment was presented. Rob Wadle, applicant, stated they have been working on a new design for the last two months and are still proposing full access with an extended center turn lane. The left out turns are very low volume and customers can use the signal if they'd like. The requirement to add a new signal head should not be a requirement for this development. Commissioner Winston asked about the timing of the traffic study. Nathan Streett, applicant, stated the study was updated to address the fact that the numbers were gathered when the University was out of session. This reduced the level of service for left -turns out of the site. Commissioner Winston stated that the studies look at traffic delay not traffic safety. Commissioner Hoskins asked about the peak hour traffic counts. Streett stated that is was 11 cars in the a.m. and 12 in the p.m. Commissioner Hoskins asked for the distance between curb cuts. Streett stated that is was 262' between Shiloh and the drive on Mount Comfort. Commissioner Hoskins asked if the plans included widening the road. Streett stated that they will have the widen the road 450' back to fit in all of the transitions. Kit Williams, City Attorney, asked if they agreed with making this a shared access for future development. Streett stated yes. Commissioner Hoskins stated he could support a % access (no left out). Williams handed out a memo and discussed access rights for properties abutting a street. The commission does not have to grant full access. Left out turns are the most dangerous and that is my concern. Commissioner Honchell mentioned that the sun blinds east bound drivers in the morning. Can't support the left out. Planning Commission April 14, 2014 8 Agenda Item 1 Minutes 3-24-14 Page 8 of 12 Commissioner Autry stated that the new dealership up Shiloh and the connection of Rupple Road to MLK will increase traffic in this area beyond what was shown in the traffic report. Commissioner Chesser asked if access could be restricted in any manner. Williams stated yes. Commissioner Chesser stated he was leaning towards a right-in/right-out. Commissioner Hoskins stated he support a % access. Wadle stated that the development won't generate enough left turns onto Shiloh to warrant them installing a signal head. Fulcher stated he didn't know the cost of the signal head. Commissioner Hoskins stated he agreed with the applicant. Motion : Commissioner Hoskins made a motion to approve LSD 14-4568 with the condition that the access on Mount Comfort be limited to % (no left -out), the condition for the signal head be removed and in support of all other conditions. Commissioner Autry seconded the motion. Upon roll call the motion passed with a vote of 5-1-0. Commissioner Chesser voted "no". Planning Commission April 14, 2014 9 Agenda Item 1 Minutes 3-24-14 Page 9 of 12 ADM 14-4635 Administrative Item (UDC AMENDMENT CHAPTER 166.21 DOWNTOWN DESIGN OVERLAY DISTRICT STANDARDS; CHAPTER 166.22 PARKING DECK DESIGN STANDARDS; and CHAPTER 166.23 URBAN RESIDENTIAL DESIGN STANDARDS): Submitted by CITY PLANNING STAFF for revisions to the Unified Development Code, Chapters 166.21, 166.22, and 166.23. The proposal is to modify various design standards UDC Chapter 166. Andrew Garner, City Planning Director, gave the staff report. Commissioner Honchell stated agreement with staffs recommendation and felt okay with it; it reads the way it should. Commissioners Autry and Hoskins agreed with Honchell Motion : Commissioner Hoskins made a motion to forward ADM 14-4635 to City Council with a recommendation for approval. Commissioner Chesser seconded the motion. Upon roll call the motion passed with a vote of 6-0-0.
