MINUTES OF A MEETING OF THE
SUBDIVISION COMMITTEE
A regular meeting of the Fayetteville Subdivision Committee was held on August 29, 2013 at 9:00
a.m. in Room 326 of the City Administration Building, 113 W. Mountain, Fayetteville, Arkansas.

PPL 13-4404: Preliminary Plat (W. OF N. 54TH ST. AND E. OF W. PERSIMMON STJLEGACY PH V,
475): Submitted by BATES AND ASSOCIATES for property located WEST OF NORTH 54TH STREET
AND EAST OF WEST PERSIMMON STREET. The property is zoned RSF-4, RESIDENTIAL SINGLE
FAMILY, 4 UNITS PER ACRE and contains approximately 32.83 acres. The request is for a residential
subdivision with 108 single family lots.
Andrew Garner, Senior Planner, gave the staff report.
Ryan Dickerson, City 911 Coordinator, discussed comments with the addresses.
Ken Eastin, Urban Forester, discussed the tree preservation plan and his recommendation to table the
project.
Commissioner Bunch asked about the existing tree canopy.
Eastin answered that the site has approximately 2.5% tree canopy.
Glenn Newman, Staff Engineer, discussed the right-of-way dedication request of the applicant, street
improvements, off-site sewer improvements, and existing infrastructure on-site.
Commissioner Autry asked about existing infrastructure.
Newman discussed the existing infrastructure.
Commissioner Winston asked about the southern entrance and re-routing the drive around trees.
Newman discussed it would be possible.
Geoff Bates, applicant, gave background on the project, including working with the bank that has
taken over the property. The main reason we are requesting the right-of-way variance is because we
will lose lots.
Evan Neihues, applicant, discussed the tree preservation plan. He feels this project should move
forward.
No public comment was presented.
Commissioner Winston asked if the 77 feet of right-of-way would affect the existing infrastructure.
Geoff Bates, applicant, indicated `no' it would not affect the infrastructure.
Commissioner Winston discussed they would rather see sidewalks on both sides of the street the
applicant and staff can figure out the mitigation trees.

Commissioner Autry discussed agreement with staff on the 77 feet of right-of-way.
Motion:
Commissioner Winston made a motion to forward PPL13-4404 to Planning Commission for
approval with the following findings:
Condition #'s 1 and 2: agree with staff as stated in the conditions.
Condition #3: agree with staff except for 54`h St. improvements to be delayed until the final
plat for phase II.
Agreeing with all other conditions.
Commissioner Autry seconded the motion. Upon roll call the motion passed by a vote of 3-
0-0.
There being no further business, the meeting adjourned at 10:00 AM.
