Mountain, Fayetteville, Arkansas. Subdivision Committee September 13, 2012 Page 2 of 6 LSD 12-4190: Large Scale Development (1325 JOYCE BLVD/LEGACY BANK, 175): Submitted by USI CONSULTING ENGINEERS, INC. for property located at 1325 JOYCE BLVD. The property is zoned C-2, THOROUGHFARE COMMERCIAL, and contains a total of 1.53 acres. The request is for a bank of 4,850 SF with associated drive-thru facility and parking. Jesse Fulcher, Current Planner, gave the staff report. Glenn Newman, Staff Engineer, stated that staff has been working with the applicant to address channel protection and water quality. Sarah Wrede, Floodplain Administrator, stated that staff is trying to get the grading outside of the Streamside Protection Zones. The existing streamside zone isn't in great condition, it appears to have been graded in the past, so the applicant could establish a vegetative buffer and improve the condition. At this point, staff hasn't found that a hardship to support the variance. Megan Dale, Urban Forester, stated that the existing trees are in the right-of-way and being preserved. Terry Carpenter, applicant, stated that the site has been shifted slightly to the west to limit hardscape in the streamside zones. The existing buffer is mowed and in poor condition. Planting can be added to the area to improve the condition. The site size has hindered their options. Ken Shireman, applicant, would like staff to look at the top of bank location again. Wrede discussed the definition for top of bank. Fulcher informed the commissioners that they could require conditions and safeguards if the variance is granted. Newman stated that the top of bank was fairly obvious on site and would likely not be changed by staff. Andrew Garner, Senior Planner, stated that the applicant could appeal the City Engineer's interpretation to the City Council. Fulcher stated that the commission should ask the applicant for a planting plan if the applicant is proposing this to mitigate for the grading in the streamside zones. Motion: Commissioner Winston made a motion to forward the request to the full Planning Commission in favor of variance and other conditions. Commissioner Noble seconded the motion. Upon roll call the motion passed by a vote of 2-0-0. LSD 12-4215: Large Scale Development (585 WILLOUGHBY/THE CULLS 11, 361): Submitted by Subdivision Committee September 13, 2012 Page 3 of 6 CLAY GROTE for property located at 585 WILLOUGHBY RD. The property is zoned I-1, Heavy Commercial and Light Industrial and contains a total of 2.33 acres. The request is for a 24,250 square foot office and warehouse building. Quin Thompson, Current Planner, gave the staff report. Clay Grote, PE, said that the applicant was unaware of prior tree removal until the Technical Plat Review meeting. He indicated that it would not be possible to meet mitigation requirements on the site, and requested a pro -rated prior tree removal fine. Joe Terminella, applicant, said that he is seeking a compromise with the City in order to build a business. Clay Grote, said that the trees had been removed at some time between 2007 and 2008 and asked for the City to consider assuming the earliest date so that the penalty period would be shorter, allowing the project to continue in 2013 rather than 2014 as indicated by the Urban Forester. Megan Dale, Urban Forester, said that the city prefers on-site mitigation, however it is possible to create a combination of on-site and off-site mitigation. She recommended maximizing the area available for tree planting on-site and mitigating the remainder with off-site preservation. Clay Grote, asked for clarification of the off-site mitigation requirement calculation. Megan Dale said that the preservation area counts the canopy of the trees within the preservation area, and remains after individual trees have died. Motion: Commissioner Winston made a motion to forward the request to the full Planning Commission in favor of all conditions. Commissioner Noble seconded the motion. Upon roll call the motion passed by a vote of 2-0-0. Subdivision Committee September 13, 2012 Page 4 of 6 LSD 12-4217: Large Scale Development (191 E. SUNBRiDGE/TAE NEW SCHOOL, 290): Submitted by JORGENSEN AND ASSOCIATES for property located at 191 E. SUNBRIDGE. The property is zoned R - O, Residential Office and C-2, Thoroughfare Commercial and contains a total of 19.23 acres. The request is for a 46,905 square foot preschool/auditorium addition. Andrew Garner, Senior Planner, gave the staff report. Glenn Newman, Staff Engineer, discussed the drainage and grading plan. Megan Dale, Urban Forester, discussed the tree preservation plan and potential conflicts with existing trees and the new sidewalk on Sunbridge Drive. Blake Jorgensen, applicant, discussed that revisions will be made to the landscape plan and the tree preservation plan. He discussed the sidewalk and existing utilities on Sunbridge Drive and that the sidewalk could potentially be routed around trees and utilities. No public comment was presented. Motion: Commissioner Winston made a motion to forward the request to the full Planning Commission in favor of all conditions. Commissioner Noble seconded the motion. Upon roll call the motion passed by a vote of 2-0-0. Subdivision Committee September 13, 2012 Page 5 of 6 PPL 12-4216: Preliminary Plat (NW OF MISSION AND SHELTON/CHAPEL VIEW, 259): Submitted by BATES AND ASSOCIATES for property located NW OF MISSION AND SHELTON. The property is in the Planning Area and contains approximately 22.88 acres. The request is for a residential subdivision with twenty-one single family lots. Quin Thompson, Current Planner, gave the staff report. Ben Booth, applicant, disagreed with the staff finding that a road stub -out to the north would not be limited by natural barriers. He presented photographs of the intermittent stream that the road would have to cross. He said that he is interested in minimal disturbance to the stream and would prefer to build small bridges across the stream. Discussion followed as to the best location for future street connections. Porter Winston moved that the Subdivision Committee forward the request to the full Planning Commission with a future street connection to the west that would be further north than that shown on the plan as presented. Motion: Commissioner Winston made a motion to forward the request to the full Planning Commission with no connectivity to the north. Commissioner Noble seconded the motion.
