Chairman Winston requested all cell phones to be turned off and informed the audience that listening devices were available. Upon roll call all members except Noble, Chesser, Pennington and Bunch were present. Planning Commission November 13, 2012 Page 3 of 6 New Business: ADM 12-4260: Administrative Item (4703 N. CROSSOVER RD./FAYETTEVILLE FARMER'S MARKET, 099): Submitted by LORI BOATRIGHT for property located at 4703 NORTH CROSSOVER ROAD. The property contains approximately 37 acres and is zoned R -A, RESIDENTIAL - AGRICULTURAL. The request is an amendment to the approved CUP 10-3551 to allow a tent and additional days and hours of operation for the Fayetteville Farmer's Market Botanical Garden site. Jesse Fulcher, Current Planner, read the staff report. Lori Boatright, applicant, stated that there is no location for a winter market, this site will be operated year round. Commission Cabe made a motion to approve the request. Commission Honchell seconded the motion. Commission Hoskins asked if the vendors were charged. Boatright state there is a daily commission rate, same as the square. Commission Hoskins asked if there was a lease rate on the market. Boatright said there are in-kind services provided for the Botanical Gardens. Commission Hoskins asked if the grass would die below the tent and about ruts. Boatright stated that the Botanical Gardens maintain the property. Commission Hoskins asked if the City Council knew there would be a tent on the property when they approved the updated agreement with the Farmers Market. Kit Williams, City Attorney, stated that Condition #4 gives the City authority to end the arrangement if there are problems created by the tent being on the property. Commission Hoskins stated that the property will be tom up by vehicles and he has an issue with a semi- permanent use of the City's property for private enterprise, and can't support the request. Williams reminded the applicant and the commission that five votes are required to approve the request and with only five members present, it might be best to table the request to the next meeting. Commission Honchell asked about the streamside area north of the site. Fulcher stated that the activities are located outside of the 50' buffer. Williams stated the commission should include a condition about the streamside buffer. Commissioner Winson asked about bathrooms. Planning Commission November 13, 2012 Page 4 of 6 Boatright stated that there is a fixture plan for port -a -potties on the property. Commission Winston asked that this area be shown on the site plan as well. Motion: Commissioner Cabe made a motion to table ADM12-4260. Commissioner Cook seconded the motion. Upon roll call the motion passed with a vote of 4-1-0, with Commissioner Hoskins voting no. Planning Commission November 13, 2012 Page 5 of 6 ADM 12-4256: Administrative Item (617 N. COLLEGE AVE./MGB PHOTO, 445): Submitted by MALLORY BERRY for property located at 617 NORTH COLLEGE AVENUE. The property contains approximately 0.25 acre and is zoned C-2, THOROUGHFARE COMMERCIAL. The request is to allow for a temporary retail structure (airstream trailer) to remain on the property for longer than 90 days (Use Unit 2). Quin Thompson gave the staff report. Commisioner Hoskins asked the applicant about bathroom facilities. Mallory Berry, applicant, responded that temporary facilities (a port -a -potty) was in place for the property. Motion: Commissioner Cabe made a motion to approve ADM12-4256 as recommended by staff. Commissioner Cook seconded the motion. Upon roll call the motion passed with a vote of 5-0-0. Planning Commission November 13, 2012 Page 6 of 6 ADM 12-4259 Administrative Item (UDC AMENDMENT: SUBDIVISION REGULATIONS IN THE PLANNING AREA) Submitted by CITY PLANNING STAFF to modify the subdivision regulations in the Fayetteville Planning Area (UDC Section 166.08.B) to be consistent with Washington County requirements. Jesse Fulcher, Current Planner, read the staff report. Motion• Commissioner Cabe made a motion to approve ADM12-4259 as recommended by staff. Commissioner Cook seconded the motion. Upon roll call the motion passed with a vote of 5-0-0. There being no further business, the meeting was adjourned at 6:15 PM.
