Subdivision Committee August 16, 2012 Page 2 of 4 PPL 12-4177: Preliminary Plat (3845 E. SKILLERN/HARTSFIELD, 295): Submitted by ALAN REID for property located at 3845 E. SKILLERN RD. The property is zoned RSF-2, RESIDENTIAL SINGLE FAMILY, 2 UNITS PER ACRE and contains approximately 3.00 acres. The request is for a residential subdivision with two single family lots. Staff report was read by Quin Thompson. Commissioner Hoskins asked why staff is requiring tree mitigation on a private residential lot. Alison Jumper, Park Planning Superintendent, responded that due to the number of previous lot splits on this property, the request must be handled like a typical sub -division of land, which requires review by the Urban Forester. Because the tree is shown on the plat as being removed, the tree must therefore be mitigated for. Alan Reid: Mitigation trees are not shown on the plat because the residential design has not been completed and it does not make sense to locate the trees on the plan until the design is complete. Thompson: On the plat, if the tree were shown as remaining, then mitigation would not be required. The tree could be removed after the plat is recorded without mitigation. Hoskins: Just wanted to clarify that the City is not requiring tree mitigation on private residential lots. Motion: Commissioner Pennington made a motion to forward the request to the full Planning Commission with all conditions of approval as recommended by staff. Commissioner Hoskins seconded the motion. Upon roll call the motion passed by a vote of 2-0-0. Subdivision Committee August 16, 2012 Page 3 of 4 PPL 12-4140: Preliminary Plat (1730 N. OLD WIRE RD./COTTAGES AT OLD WIRE, 369): Submitted by BATES AND ASSOCIATES for property located at 1730N. OLD WIRE RD. The property is zoned NC, NEIGHBORHOOD CONSERVATION and contains approximately 13.64 acres. The request is for a residential subdivision with 53 single family lots. Andrew Garner, Senior Planner, gave the staff report. Alison Jumper, Park Planning Superintendent, discussed landscaping and tree preservation. Geoff Bates, applicant, discussed that they were okay with the recommended conditions. Public Comment: Sally Kelly, lives on Ash Street adjacent to the site. Discussed drainage issues and a solution on her property that was completed several years ago. She discussed offsite trees that may be impacted. Kevin Sanchez, adjacent property owner #3 on the plat. Discussed that he is not sure they are meeting City ordinance. Some of the trees are shown to go away on some sheets and indicated preserved in other areas. He asked about run-off mitigation and drainage going to adjacent property owners. He discussed other discrepancy on the plans and concerns with fire trucks going through his neighborhood to access this site. Geoff Bates, applicant, responded that they meet fire code requirements, that inlets will be added to the north to catch runoff mentioned by Mr. Sanchez, and that the discrepancies will be caught prior to construction plans being approved. No more public comment was presented. Commissioner Hoskins asked about the tree mitigation plan and the master grading plan. Glenn Newman, staff engineer, explained the master lot grading plan and the drainage plan related to the tree preservation plan. Commissioner Hoskins asked about sidewalk and street tree planting. Could the sidewalk be located close to the curb to avoid the tree? Jumper indicated that yes it could potentially be located close to the curb to avoid the tree. Catherine Kilgor, property owner to the south, asked about the fence being taken down. Geoff Bates, applicant, indicated that the fence will remain. Motion: Subdivision Committee August 16, 2012 Page 4 of 4 Commissioner Pennington made a motion to forward the request to the full Planning Commission finding in favor of the condition as recommended by staff and adding that on condition of approval #1 be modified for the sidewalk to the west of Lot 35 to be placed close to the curb to avoid the tree, and for no recommendation on the street tree planting location. Commissioner Hoskins seconded the motion. Upon roll call the motion passed by a vote of 2-0-0. There being no further business, the meeting adjourned at 9:45 AM.
