Commissioner Lack requested all cell phones to be turned off, and informed the audience that listening devices were available. Upon roll call all members were present with the exception of Commissioner Cabe. Planning Commission July 12, 2010 Page 3 of 8 Consent. Approval of the minutes from the June 28, 2010 Planning Commission meeting. Motion• Commissioner Winston made a motion to approve the Consent Agenda. Commissioner Cabe seconded the motion. Upon roll call the motion passed with a vote of 8-0-0. Planning Commission July 12, 2010 Page 4 of 8 Old Business: ADM 10-3611 (2035 NORTH COLLEGE AVENUE, 368): Submitted by KIM FUGITT for property at 2035 N. COLLEGE AVENUE. The property contains approximately 3.2 acres and is zoned C-2, Thoroughfare Commercial. The request is for a variance of Fayetteville Unified Development Code Section 166.14(C) (7) to permit a chain link fence in front of the building. Andrew Garner, Senior Planner, gave the staff report. Kim Fugitt, applicant, stated that he was present to answer any questions. No Public Comment was received. Commissioner Lack stated that he had opposed the previous time. He agreed that the bamboo will create a dense screen and asked for comments from the other Commissioners. Commissioner Earnest said that he has some reservations, but will defer to the Urban Forester. Commissioner Chesser and staff discussed the type of species recommended. Commissioner Chesser stated that he supports the request. Motion: Commissioner Winston made a motion to approve as drawn by the applicant. Commissoiner Earnest seconded the motion. Upon roll call the motion passed with a vote of 8-0-0. Planning Commission July 12, 2010 Page 5 of 8 New Business: RZN 10-3608: Rezoning (PARKER /101 EAST ALICE STREET, 213): Submitted by BLEW & ASSOCIATES, INC. for property located at 101 EAST ALICE STREET. The property is zoned RSF-4, SINGLE FAMILY - 4 UNITS/ACRE, and contains approximately 0.74 acre. The request is to rezone the subject property to C-2, Thoroughfare Commercial. THIS ITEM IS REQUIRED TO BE TABLED DUE TO LACK OF NOTIFICATION No public comment was received. Motion: Commissioner Chesser made a motion to approve as drawn by the applicant. Commissoiner Winston seconded the motion. Upon roll call the motion passed with a vote of 8-0-0. Planning Commission July 12, 2010 Page 6 of 8 ADM 10-3618: Administrative Item: (UDC AMENDMENT USE UNIT 2 CONSTRUCTION FACILITY) Dara Sanders, Current Planner, gave the staff report. No public comment was received. Commissioner Winston offered his appreciation of Staff s clarification of the code. Commissioner Chesser asked about the length of time for temporary facilities. Commissioner Hoskins and staff discussed issues with temporary vs. permanent businesses and structures and the requirements for a temporary real estate office. Commissioner Lack offered that they would be temporary bank buildings and other businesses that might require temporary transitional space. Motion: Commissioner Kennedy made a motion to approve the request. Commissioner Hoskins seconded the motion to approve. Upon roll call the motion passed with a vote of 8-0-0. Planning Commission July 12, 2010 Page 7 of 8 ADM 10-3619: Administrative Item: (UDC AMENDMENTS CHAPTERS 151, 161, 162, AND 164): Submitted by CITY PLANNING STAFF. The proposal is to amend references of "Drive -In Facilities" to "Drive-Thru Facilities" for consistency in the Unified Development Code. Dara Sanders, Current Planner, gave the staff report. No public comment was received. Commissioner Chesser had questions about the drive-in / drive-thru's. Sanders explained the difference between drive-ins and drive-thrus. Motion: Commissioner Chesser made a motion to forward the request. Commissioner Kennedy seconded the motion. Upon roll call the motion was passed with a vote of 8-0-0. Planning Commission July 12, 2010 Page 8 of 8 ADM 10-3609: Administrative Item: (UDC AMENDMENT CH. 166.08 STREET DESIGN AND ACCESS MANAGEMENT): Submitted by CITY PLANNING STAFF for revisions to Fayetteville Unified Development Code, Section 166.08 Street Design and Access Management Standards. The proposed code changes will clarify the access management requirements for different types of development and include a minimum curb cut distance from intersections for single family residences. CITY PLANNING STAFF HAS REQUESTED THIS ITEM BE TABLED INDEFINITELY Motion: Commissioner Chesser made a motion to forward the request. Commissioner Winston seconded the motion. Upon roll call the motion was passed with a vote of 8-0-0. There being no further business, the meeting was adjourned at 6:10 P.M
