Commissioner Cabe requested all cell phones to be turned off and informed the audience that listening devices were available. Upon roll call all members were present with the exception of Commissioners Earnest, Winston, and Bunch. Commissioner Bunch arrived after roll call. Planning Commission February 27, 2012 Page 3 of 8 Consent. Approval of the minutes from the February 13, 2012 meeting. ADM 12-4029: Administrative Item (Abshier Heights R-PZD Modification No. 3): Submitted by BART BAUER for the property located at the NORTHWEST CORNER OF ABSHIER DRIVE AND HILLCREST AVENUE. The request is to amend the approved R-PZD 06-1883 Abshier Heights to architecturally design one of the multi -family buildings with brick instead of stone on the rear of the building. Public Comment: Jan Wicks, lives on Hillcrest Avenue, inquired about the Abshier Heights items and discussed the character of the neighborhood. Commissioner Cabe pulled ADM 12-4029 Abshier Heights PZD Modification from the consent agenda and moved it to the end of the agenda with the Abshier Heights rezoning request. The only item left on the consent agenda is approval of the minutes. Motion: Commissioner Cook made a motion to approve the modified Consent Agenda. Commissioner Cook seconded the motion. Upon roll call the motion passed with a vote of 7-0-0. Planning Commission February 27, 2012 Page 4 of 8 Old Business: CUP 12-4023: Conditional Use Permit (1637 W. DEANE STJLEGACY VENTURES, 365): Submitted by APPIAN DESIGN GROUP for property located at 1637 WEST DEANE STREET. The property is zoned RSF- 4, RESIDENTIAL SINGLE-FAMILY, 4 UNITS PER ACRE and contains approximately 0.88 acre. The request is for a Cottage Housing Development, Use Unit 44, for five new single-family cottages. Andrew Garner, Senior Planner, presented the staff report. Tim Brisiel, applicant, gave abrief presentation. No public comment was presented. Motion: Commissioner Griffin made a motion to approve CUP 12-4023 determining in favor of compatibility in 41 and all other conditions. Commissioner Chesser seconded the motion. Upon roll call the motion passed with a vote of 7-0-0. Planning Commission February 27, 2012 Page 5 of 8 New Business: CUP 12-4040: Conditional Use Permit (1001 W. STONE ST./ATHLETIC FACILITY, 522): Submitted by CRAFTON TULL & ASSOCIATES, INC. for property located at 1001 WEST STONE STREET. The property is zoned P-1, INSTITUTIONAL and RMF -24, RESIDENTIAL MULTI -FAMILY, 24 UNITS PER ACRE and contains approximately 22.57 acres. The request is for expansion of the Fayetteville High School Athletic Facility (Use Unit 4) in the RMF -24 zoning district. LSD 12-4032: Large Scale Development (1001 W. STONE ST./ATHLETIC FACILITY, 522): Submitted by CRAFTON TULL & ASSOCIATES, INC. for property located at 1001 WEST STONE STREET. The property is zoned P-1, INSTITUTIONAL and RMF -24, RESIDENTIAL MULTI -FAMILY, 24 UNITS PER ACRE and contains approximately 22.57 acres. The request is for renovation to the Fayetteville High School athletic facilities. Andrew Garner, Senior Planner, presented the staff report for both CUP 12-4040 and LSD 12-4032. Jonathan Ely, applicant, was present for questions. No public comment was presented. Commissioner Chesser asked about conditional use permit versus rezoning the property. Garner discussed reasons for this application being processed as a conditional use permit. Commissioner Hoskins as about street right-of-way and landscaping. Garner discussed that street right-of-way stubs out at the far northern and southern ends of this parcel but does not go through the parcel. He also discussed that if there are a few small areas of existing parking spaces and there may be some requirements for tree islands in some of those parking areas. He referred to the conditions of approval in the landscape report. Motion for CUP 12-4023: Commissioner Chesser made a motion to approve CUP 12-4040 finding in favor of all conditions in the staff report. Commissioner Cabe seconded the motion. Upon roll call the motion passed with a vote of 7-0-0. Motion for LSD 12-4040: Commissioner Chesser made a motion to approve LSD 12-4040 finding in favor of all conditions. Commissioner Cook seconded the motion. Upon roll call the motion passed with a vote of 7-0-0. Planning Commission February 27, 2012 Page 6 of 8 CUP 12-4048: Conditional Use Permit (WASHINGTON COUNTY FAIRGROUNDS/THE AMP, 287): Submitted by DAVID SWAIN for property located at the WASHINGTON COUNTY FAIRGROUNDS. The property is zoned R -A, RESIDENTIAL AGRICULTURAL and contains approximately 29.61 acres. The request is to allow outdoor music, Use Unit 35, in an R -A zoning district. Andrew Garner, Senior Planner, presented the staff report. Terry Trotter, applicant, requested that the commission modify condition of approval #3 to allow music until midnight. No public comment was presented. Commissioner Chesser asked if it could be conditioned so only some of the events would go past midnight Kit Williams, City Attorney, discussed the difficulty of enforcing such a condition. He reminded the commission that this conditional use permit does not exempt this applicant from the noise ordinance. Commissioner Chesser asked staff for their opinion about going until midnight. Garner stated that this was brought up by the applicant immediately prior to the meeting and staff does not have an opinion at this point. Motion #1: Commissioner Chesser made a motion to approve CUP 12-4048 finding in favor of all conditions modifying condition of approval #3 to 11:30 PM. Commissioner Griffin seconded the motion. Commissioner Honchell asked if there had been in noise complaints at the Washington County Fairgrounds. Garner and Williams both stated that they were not aware of any complaints. Commissioner Honchell said he has no trouble letting them play music until midnight Motion #2: Commissioner Honchell made a motion to amend motion 41 to allow using until midnight. Commissioner Bunch seconded the motion. Upon roll call Motion #2 passed with a vote of 6-1-0 (Commissioner Chesser voting `no'). Upon roll call Motion #1 to approval CUP 12-4048 passed with a vote of 7-0-0, including the modification to condition of approval #3 to allow music until 12 PM. Motion: Commissioner Chesser made a motion to forward ADM 12-4029 to the City Council with a recommendation for approval. Upon roll call the motion passed with a vote of 7-0-0. Planning Commission February 27, 2012 Page 8 of 8 RZN 12-4028: Rezone (1400 AND 1500 BLOCKS OF N. DESOTO PL./ABSHIER HEIGHTS, 407): Submitted by BART BAUER for properties located at the 1400 AND 1500 BLOCKS OF NORTH DESOTO PLACE. The properties are zoned R-PZD, RESIDENTIAL PLANNED ZONING DISTRICT and contains approximately 2.18 acres. The request is to rezone Tract A of the Abshier Heights R-PZD to RSF-8, RESIDENTIAL SINGLE-FAMILY, 8 UNITS PER ACRE. Andrew Garner, Senior Planner, presented the staff report Bob Bauer, applicant, discussed the reasons for his request for RSF-8 over RSF-4, mainly because the existing utilities and other constraints on the property will require some smaller lots. Public Comment: Ron Wicks, neighbor on Hillcrest Avenue, stated no objection to the rezoning. He asked if there was any assurance there would be no more than eight houses. Kit Williams, City Attorney, discussed that an applicant cannot be forced or asked to offer a Bill of Assurance. Ron Wicks stated, again, that he did not have any objections. No more public comment was presented. Commissioner Hoskins asked about requiring brick on the RSF-8 property. Garner discussed that brick would only be required on the portion of the property that remains zoned R-PZD, where one additional multi -family building is planned to be built. Motion: Commissioner Chesser made a motion to forward RZN 12-4028 to the City Council with a recommendation for approval. Commissioner Cook seconded the motion. Upon roll call the motion passed with a vote of 7- 0-0. There being no further business, the meeting was adjourned at 6:30 PM.
