Commissioner Winston requested all cell phones to be turned off and informed the audience that listening devices were available. Upon roll call all members were present with the exception of Commissioners Cabe and Chesser. Planning Commission October 10, 2011 Page 3 of 8 Consent. Approval of the minutes from the September 26, 2011 meeting. ADM 11-3967: Variance (6111 W. JANA PLACE/RENFROE, 279/280): Submitted by JORGENSEN & ASSOCIATES for property located at 6111 WEST JANA PLACE. The property is in the PLANNING AREA and contains approximately 5.06 acres. The request is for a variance on the reduction of the frontage required on the public right-of-way. VAC 11-3944: Vacation (3670 N. LALIQUE LN.NPR INVESTMENTS, 169): Submitted by BATES AND ASSOCIATES for properties located at 3670 NORTH LALIQUE LANE. The property is zoned RSF-4, RESIDENTIAL SINGLE-FAMILY, 4 UNITS PER ACRE and contains approximately 0.26 acre. The request is to vacate a portion of a utility easement. Motion: Commissioner Earnest made a motion to approve the Consent Agenda. Commissioner Cook seconded the motion. Upon roll call the motion passed with a vote of 7-0-0. Commissioner Chesser arrived. Planning Commission October 10, 2011 Page 4 of 8 Old Business: CUP 11-3918: Conditional Use Permit (510 W. 11TH ST. & 989 S. SCHOOL AVE./BARTHOLOMEW (SALE BARN), 562): Submitted by MORRISON SHIPLEY ENGINEERS, INC. for property located at 510 WEST I1TH STREET AND 989 SOUTH SCHOOL AVENUE. The property is zoned CS, COMMUNITY SERVICES and contains approximately 10.95 acres. The request is to utilize a trailer as a temporary leasing office, Use Unit 2, for an apartment complex. Jesse Fulcher, Current Planner, gave the staff report. Heather Robason, applicant, discussed the reasons why they are requesting this item be tabled again for two weeks. Motion: Commissioner Cook made a motion to table CUP 11 -3 918 for two weeks. Commissioner Chesser seconded the motion. Upon roll call the motion passed with a vote of 8-0-0. Planning Commission October 10, 2011 Page 5 of 8 New Business: LSD 11-3903: Large Scale Development (2530 W. WEDINGTON DR./KUM & GO, 402): Submitted by CET ENGINEERING for property located at 2530 WEST WEDINGTON DRIVE. The property is zoned C-2, THOROUGHFARE COMMERCIAL and contains approximately 1.54 acres. The request is for a gas station and convenience store containing approximately 4,958 square feet. Jesse Fulcher, Current Planner, gave the staff report, recommending approval of the large scale and denial of the access to Wedington. Erin Rushing, applicant, stated that the main issue was access to Wedington. They tried to acquire the property to the west and obtain an access easement, but weren't able. The access has been to the east side of the property. The fueling station needs access to Wedington, but AHTD won't allow a different standard on the restricted right-in/right-out driveway. Commissioner Chesser asked staff if they would support a right -in only drive. Fulcher stated that a design would need to be presented. Staff hasn't seen a design for the right-in/right-out that we can support. Commissioner Chesser stated that he might support a right -in only with a more restrictive design and asked if there was another design. Rushing stated he hadn't seen one. Commissioner Hoskins asked the applicant if the project was dead without the access to Wedington. Rob Wadley, applicant, stated that the store needs access to Wedington, especially with the short signal length for south bound traffic on Futrall. Kit Williams, City Attorney, asked the applicant if they had thought about adding a second south bound lane on Futural. Wadley stated that Kum and Go must have access on Wedington. The state only has one design. Commissioner Winston stated that he could support a right -in but not a right -out, since you exit into a dedicated turn lane for the on ramp. This requires drivers to cross over to go west. Glenn Newman, Staff Engineer, stated that that state wouldn't likely increase the signal length for Futrall, since Wedington was the primary street. The state has indicated to us that they would accept a more restrictive design. Commission Porter asked the applicant if they wanted more time to work with the state on the design. Wadley, stated that they would talk with the owner and state. Commissioner Chesser stated that he was concerned with the right -out, but might support the right -in. Planning Commission October 10, 2011 Page 6 of 8 Motion• Commissioner Chesser made a motion to table LSD 11-3903 until the October 24, 2011 Planning Commission meeting. Commissioner Earnest seconded the motion. Upon roll call the motion passed with a vote of 8-0-0. Planning Commission October 10, 2011 Page 7 of 8 CUP 11-3945: Conditional Use Permit (4618 N. COLLEGE AVE./FREEDOM FAIR, 096): Submitted by JEFF OLAND for property located at 4618 NORTH COLLEGE AVENUE. The property is zoned C-2, THOROUGHFARE COMMERCIAL and R -A, RESIDENTIAL -AGRICULTURAL and contains approximately 17.55 acres. The request is for a one -day fair, Use Unit 2, City-wide uses by conditional use, in the C-2 and R -A zoning districts. Andrew Garner, Senior Planner, gave the staff report. Warren Philips, applicant, was present for any questions No public comment was presented. Motion: Commissioner Chesser made a motion to approve CUP 11-3945 with all conditions as recommended by staff. Commissioner Bunch seconded the motion. Upon roll call the motion passed with a vote of 8-0-0. Planning Commission October 10, 2011 Page 8 of 8 CUP 11-3947: Conditional Use Permit (1444 E. STEARNS ST.BELLAFONT LOT 2,175): Submitted by JORGENSEN AND ASSOCIATES for property located at 1444 EAST STEARNS STREET. The property is zoned C-3, CENTRAL COMMERCIAL and contains approximately 1.55 acres. The request is for parking in excess of that permitted in Chapter 172, Parking and Loading. Andrew Garner, Senior Planner, gave the staff report. Justin Jorgensen, applicant, withdrew the conditional use request for additional parking but requested the variance for the driveway onto Vantage Drive as shown. No public comment was presented. Commissioner Earnest asked for clarification about the request Garner discussed that the driveway onto Vantage Drive requires Planning Commission approval, but since the applicant has withdrawn the request for an increased number of parking spaces over the ordinance, the parking issue does not need to be considered by the commission. Motion: Commissioner Chesser made a motion to approve the variance to permit the curb cut as proposed by the applicant at 1444 East Stearns Street. Commissioner Bunch seconded the motion. Upon roll call the motion passed with a vote of 8-0-0. There being no further business, the meeting was adjourned at 6:12 PM.
