PLANNING COMMISSION
A special meeting of the Fayetteville Planning Commission was held on February 28, 2011 at 5:30 p.m. in
Room 219, City Administration Building in Fayetteville, Arkansas.

5:30 PM- Planning Commission Chair Andy Lack called the meeting to order.
Commissioner Lack requested all cell phones to be turned off and infonned the audience that listening
devices were available. Upon roll call all members were present with the exception of Commissioner
Hoskins.

Consent.
Approval of the minutes from the January 14, 2011 meeting
LSD 10-3743: Large Scale Development (LOT 10 FOREST HILLS, 440): Submitted by MORRISON-
SHIPLEY ENGINEERS, INC for property located at the SOUTHWEST CORNER OF NORTH WEDINGTON
DRIVE AND SALEM STREET. The property is zoned C-PZD 07-2793 and contains approximately 2.11 acres.
The request is for a multi -tenant retail building containing approximately 15,771 square feet and associated
parking.
Motion:
Commissioner Winston made a motion to approve the Consent Agenda. Commissioner Chesser seconded
the motion. Upon roll call the motion passed with a vote of 9-0-0.

New Business:
RZN 11-3757: Rezoning (3250 W MARTIN LUTHER KING BLVD/ALDI, INC, 557): Submitted by
BATES & ASSOCIATES for property located at 3250 W. MARTIN LUTHER KING BLVD. The property
is zoned R -O, RESIDENTIAL OFFICE and contains approximately 1.77 acre. The request is to rezone the
subject property to C-1, Neighborhood Commercial.
Dara Sanders, Current Planner, gave the staff report.
Geoff Bates, representative, discussed the property, split zoning of the project boundary, and the anticipated
variances associated should the property be rezoned to a form -based zoning district.
No public comment was presented.
Commissioner Cabe and Sanders discussed the various options available to the applicant for development the
property.
Commissioner Kennedy and Sanders discussed staff s concerns with the applicant's proposal.
Commissioner Lack and Planning staff discussed the concept of spot zoning in relation to the subject property.
Commissioners Hoskins and Honchell expressed support for the applicant's request.
Commissioner Earnest discussed the opportunity to apply a form -based zoning district to Martin Luther King
Boulevard in conformance with City Plan 2025 and the City Council's past determination on the subject
property.
Commissioner Hoskins discussed potential future scenarios should a conditional use permit be approved with
the current zoning of the property.
Motion:
Commissioner Cabe made a motion to deny the item. Commissioner Chesser seconded the motion. Upon
roll call the motion passed with a vote of 6-3-0 (Commissioners Kennedy, Hoskins, and Honchell voting
`No').
There being no further business, the meeting was adjourned at 6:30 PM.
