5:30 PM - Planning Commission Chair Andy Lack called the meeting to order.
Commissioner Lack requested all cell phones to be turned off and informed the audience that
listening devices were available. Upon roll call all members were present with the exception of
Commissioner Honchell.

Consent.
Approval of the minutes from the September 27, 2010 Planning Commission meeting.
VAC 10-3662: Vacation (OAKBROOKE III, 361): Submitted by BATES & ASSOCIATES for
property located at OAKBROOKE SUBDIVISON III. The property is zoned R-PZD,
RESIDENTIAL PLANNED ZONING DISTRICT and contains approximately 21.50 acres. The
request is to vacate all of the existing utility easements.
This item cannot be discussed as it is an incomplete application.
Motion:
Commissioner Cabe made a motion to pull VAC 10-3662 from the agenda. Commissioner
Chesser seconded the motion. Upon roll call the motion passed with a vote of 7-0-1 with
Commissioner Hoskins recusing.
Motion:
Commissioner Cabe made a motion to approve the consent agenda, which only consists of the
approval of the minutes from the September 27, 2010 Planning Commission meeting.
Commissioner Chesser seconded the motion. Upon roll call the motion passed with a vote of 8-
0-0.

Old Business:
ADM 10-3637: Administrative Item (UDC Amendment Chapter 174): Submitted by City
Planning Staff. The proposal is to amend Chapter 174, Signs, to include signage designations for
recently adopted zoning districts and to modify the current signage regulations.
Motion:
Commissioner Chesser made a motion to table the item until October 25, 2010. Commissioner
Earnest seconded the motion. Upon roll call the motion passed with a vote of 8-0-0.

New Business:
CUP 10-3657: Conditional Use Permit (ST. JOSEPH'S 1722 N. STARR DR., 373): Submitted
by H2 ENGINEERING, INC. for property located at 1722 N. STARR DRIVE. The property is
zoned R -A, RESIDENTIAL -AGRICULTURAL and contains approximately 17.73 acres. The
request is for approval of expansion of the existing facilities with a 20,000 s.f addition housing an
activity center, classrooms, and art and music rooms.
LSD 10-3656: Large Scale Development (ST. JOSEPH'S STARR DRIVE, 373): Submitted by
H2 ENGINEERING, INC. for property located at 1722 N. STARR DRIVE. The property is zoned
R -A, RESIDENTIAL -AGRICULTURAL and contains approximately 17.73 acres. The request is
for an expansion of the existing church and school facility.
Andrew Garner, Senior Planner, gave the staff report for both CUP 10-3657 and LSD 10-3656.
Jeremy Thompson, applicant, discussed the project and stated agreement with the conditions of
approval.
No public comment was presented.
Commissioner Lack discussed that this school was similar in size with other schools in
neighborhoods in the City and he is in favor. He asked about non -conforming outdoor lighting.
Commissioner Hoskins also asked about the letter from a member of the public asking about lights
shining out onto Starr Drive.
Garner explained staff's recommended condition of approval regarding the existing light fixtures
that were angled slightly up and staff is recommending them to be angled to direct light downward.
Commissioner Chesser asked about the zoning being R -A, and the possibility to rezone the site to
institutional for the school and church use.
Garner discussed the differences between a school that is permitted under a conditional use permit
and one permitted under the P-1, Institutional zoning, and the different requirements and design
standards for each scenario.
Jeremy Thompson discussed that the applicant will likely be coming back within the next year to
ask for the site to be re -zoned to P-1.
Commissioner Winston asked about the condition of Starr Drive and complaints from the neighbor
complaining about on -street parking.
Garner discussed that Starr Drive is a paved two lane road that is designated as a Collector Street on
the Master Street Plan. The Master Street Plan shows a Collector Street with two 14 -foot wide travel
lanes without any on -street parking.

Kit Williams, City Attorney, discussed that the Police Department enforces the on -street parking
requirements in accordance with traffic and safety laws, and that they have the right to enforce no
parking.
Commissioner Winston asked about the number of new parking spaces that were being built with
this addition.
Jeremy Thompson responded that there would be 9 new spaces. The overflow onto Starr Drive is
during church events, not during regular school hours.
Commissioner Winston asked about the timing of the traffic signal at Starr Drive/Mission as
mentioned by the neighbor in their letter.
Williams discussed that the timing of traffic signals is completed by the City Transportation
Department, however, as Mission is also a state highway the timing of this signal also is required to
be coordinated with the State Highway Department.
Commissioner Winston asked about the early hours of the solid waste division truck service
mentioned by the neighbor.
Williams responded that trash trucks often go very early to avoid rush hour traffic.
Motion for CUP 10-3657:
Commissioner Chesser made a motion to approve CUP 10-3657 modifying Condition of Approval
#4 to read "All nonconforming parking lot lighting, including building -mounted lighting shall be
redirected downward... ", and with the approval of all other conditions as recommended by staff.
Commissioner Cabe seconded the motion. Commissioner Chesser clarified that the intent of
condition of approval #4 was only to apply to parking lot, or area lighting, Commissioner Cabe
agreed with this clarification. Upon roll call the motion passed with a vote of 8-0-0.
Motion for LSD 10-3656:
Commissioner Chesser made a motion to approve LSD 10-3656 with the conditions as
recommended by staff, finding in favor of condition of approval #1 regarding street improvements.
Commissioner Cabe seconded the motion. Upon roll call the motion passed with a vote of 8-0-0.

CUP 10-3665: Conditional Use Permit (MAE FARM, 096): Submitted by MAE FARM for
property located at 4618 N. COLLEGE AVENUE, WEST OF LAKE FAYETTEVILLE. The
property contains approximately 17 acres and is zoned R -A, Residential -Agricultural and C-2,
Thoroughfare Commercial. The request is for a conditional use permit for temporary agri-tourism
events (Use Unit 2) such as hay rides, farmer's markets, camping, and other seasonal festivals.
Andrew Garner, Senior Planner, gave the staff report.
Cynthia Hasselhoff, applicant, stated that she was here for any questions.
No public comment was presented.
Commissioner Cabe discussed that he felt this was a good use for the property.
Motion:
Commissioner Cabe made a motion to approve the item. Commissioner Chesser seconded the
motion. Upon roll call the motion passed with a vote of 8-0-0.

CUP 10-3658: Conditional Use Permit (WORD OF TRUTH FELLOWSHIP, 640): Submitted
by JOY MCNEILL, GRANDVIEW APARTMENTS for property located at 401 W. 24TH STREET.
The property is zoned RMF -24, MULTI FAMILY - 24 UNITS/ACRE and contains approximately
13.27 acres. The request is to approve the use of a church, Use Unit 4, in the RMF -24 Zoning
District.
Andrew Garner, Senior Planner, gave the staff report.
Inaudible name, Word of Truth Fellowship, discussed the mission of the church and the intent for
the church at this location.
Joy McNeil, Manager Grandview Apartments, discussed the parking situation and that there are
wide drive aisles that could be used for overflow parking.
No public comment was presented.
Commissioner Lack discussed that this church use by conditional use permit is appropriate, as
opposed to a re -zoning.
Commissioner Chesser asked about condition Lb. regarding the parking.
Garner explained that the intent of this condition is that if there is a valid complaint of a parking
problem this conditional use permit could be brought back to the Planning Commission.
Motion:
Commissioner Chesser made a motion to approve the item, finding in favor of all staff
recommended conditions, also finding in favor on condition # 1. Commissioner Cabe seconded the
motion. Upon roll call the motion passed with a vote of 8-0-0.
There being no further business, the meeting was adjourned at 6:15 PM.
