MINUTES OF A MEETING OF THE
SUBDIVISION COMMITTEE
A regular meeting of the Fayetteville Subdivision Committee was held on July 29, 2010 at 9:00 a.m.
in Room 326 of the City Administration Building, 113 W. Mountain, Fayetteville, Arkansas.

PPL 10-3616: Preliminary Plat (RIVERWALK I/DEADHORSE MTN RD, 645,684): Submitted
by H2 ENGINEERING, INC. for property located 1.3 MILES SOUTH OF HWY 16E, ALONG
THE WEST SIDE OF DEADHORSE MOUNTAIN ROAD. The property is zoned RSF-4, SINGLE
FAMILY - 4 UNITS/ACRE and contains approximately 95.91 acres. The request is for phase I of a
residential subdivision with 67 single-family dwellings.
Dara Sanders, Current Planner, gave the staff report discussing that previous issues with tree
preservation and concerns with an existing pond have been satisfied and recommended forwarding
the request to the full Planning Commission with a recommendation of approval.
Glenn Newman, Staff Engineer, discussed the pond and traffic signal recommendation from staff.
Greg Howe, Urban Forester, discussed the overall site plan and requested that revisions be made to
the plat to indicate access and building footprints on the lots to determine the likelihood of tree
preservation.
Commissioner Winston requested explanation on a drainage easement that was discussed at the
previous Subdivision Committee meeting.
Kipp Hearne, H2 Engineering, discussed natural springs on the property.
Commissioner Winston asked if these springs were wetlands and when they are addressed.
Jeremy Pate, Development Services Department Director, explained wetland delineation is under
the jurisdiction of the Federal Government and not within the scope of the Planning Commission's
authority. If it is determined that wetlands are delineated on the property, these issues would be
resolved with the Corps of Engineers, and the applicant will be required to bring and alternative
layout to the Planning Commission.
Public Comment:
Jerry Hall, adjacent property owner and previous property owner of the subject property, discussed
natural features and including springs and ponds on the property.
Jackie HallWyland, adjacent property owner to the southwest of the site. She asked why the
applicant is doing this project with the housing market is down and discussed the history of this area
as she used to live on the subject property.
Charles Mesner, an adjacent property owner. He discussed traffic issues and that getting out onto
Highway 16 is terrible.
Public comment was closed.
Commissioner Winston asked staff to address the historic value and the wetland issue.

Sanders explained that the City does not currently review or regulate potential historic significance
on residential properties, and that the issue with potential wetlands on the property is not within the
purview of the Planning Commission. The Planning Commission is responsible for reviewing and
varying the regulations of the Unified Development Code. Staff has determined that the project
meets the minimum requirement of the zoning and development regulations subject to conditions
and recommends approval.
Commissioner Lack agreed with staff on the jurisdictional issue and asked for clarification on the
requested revisions from the Urban Forester. He asked if the tree preservation ordinance requires
development to be shown on a preliminary plat.
Howe answered that the ordinance requires showing the high likelihood of tree preservation.
Commissioners and Howe discussed the requirements of the tree preservation ordinance.
Commissioner Lack requested additional information prior to the Planning Commission meeting
for verification that the requested tree preservation revisions are compliant with the regulations of
the tree preservation ordinance.
Hearne and the Commissioners discussed the issue with parkland dedication and the tree
preservation.
Staff and the Commissioners discussed the street improvements, which include on -street parking
and traffic calming measures.
Motion:
Commissioner Lack made a motion to forward the request with the conditions of approval
recommended by staff. Commissioner Hoskins seconded the motion. Upon roll call the motion
passed by a vote of 3-0-0.
There being no further business, the meeting adjourned at 10:30 AM.
