Commissioner Lack requested all cell phones to be turned off, and informed the audience that listening devices were available. Upon roll call all members were present. Planning Commission August 30, 2010 Page 3 of 9 Consent. Approval of the minutes from the August 9, 2010 Planning Commission meeting. Motion• Commissioner Chesser made a motion to approve the Consent Agenda. Commissioner Cabe seconded the motion. Upon roll call the motion passed with a vote of 9-0-0. Planning Commission August 30, 2010 Page 4 of 9 Old Business: RZN 10-3613: Rezoning (WATSON, 5989 E. HUNTSVILLE, 611): Submitted by TOM and MARIE WATSON for property located at 5989 E. HUNTSVILLE ROAD. The property is zoned RSF-4, SINGLE FAMILY - 4 UNITS/ACRE and contains approximately 2.9 acres. The request is to rezone the subject property to R -A, Residential Agricultural. Andrew Garner, Senior Planner, gave the staff report discussing rezoning request and the applicant's revised proposal to rezone the property to R -A, Residential Agricultural. Tom Watson, applicant, stated that he was here for questions. No public comment was presented. Commissioner Hoskins asked if for sign permitting purposes this property was viewed as two parcels. Kit Williams, City Attorney discussed that it would be viewed as one parcel for sign permitting process. Motion: Commissioner Chesser made a motion to forward the item with a recommendation for approval. Commissioner Cabe seconded. Upon roll call the motion passed with a vote of 9-0-0. Planning Commission August 30, 2010 Page 5 of 9 New Business: ADM 10-3651: Administrative Item (D.L. JOHNSON, 1659 TIMBERCREST): Submitted by DAVA JOHNSON for property located at 1659 N. TIMBERCREST. The request is for a modification to the conditions of approval for CUP 10-3597 to extend the hours of operation. The applicant withdrew this request. No staff report or public comment was presented. Planning Commission August 30, 2010 Page 6 of 9 ADM 10-3653: Administrative Item (FLEET FEET): Submitted by RUSSELL GUNNELL for property located at 1020 HAROLD STREET. The property is zoned R -O, RESIDENTIAL OFFICE and contains approximately 0.52 acre. The request is to remove a condition of approval associated with CUP 00-26.00 and CUP 08-3039. Dara Sanders, current planner, gave the staff report and recommended an additional condition of approval limiting freestanding signage to a monument sign. Russ Gunnell, applicant, introduced himself and explained the signage issues at this location. No public comment was received. Commissioner Winston asked the applicant if there is interest in a pole sign. Gunnell stated that there are no definite plans at this time. Kit Williams, City Attorney, and Gunnell discussed the reason for the signage limitation associated with the original conditional use permit. Commissioner Chesser and staff discussed the notification requirements for administrative items. Jeremy Pate, Development Services Director, explained staff's recommendation to limit the signage. Commissioner Lack expressed support for allowing signage in accordance with the regulations for the underlying zoning district. Motion: Commissioner Winston made a motion to approve the request with no conditions. Commissioner Kennedy seconded the motion. Upon roll call the motion passed with a vote of 9-0-0. Planning Commission August 30, 2010 Page 7 of 9 RZN 10-3633: Rezoning (MBC HOMES LLC, WILLY BERCHTOLD, 565): Submitted by WILLY BERCHTOLD for property located at 2409 HUNTSVILLE ROAD. The property is zoned C-2, THOROUGHFARE COMMERCIAL, RSF-4, RESIDENTIAL SINGLE FAMILY, 4 DWELLING UNITS/ACRE, and R -A, RESIDENTIAL AGRICULTURAL and contains approximately 2.45 acres. The request is to rezone the subject property from C-2, RSF-4, R -A zoning districts to CS, Community Services zoning district. Dara Sanders, Planner, gave the staff report. Willy Berchtold, applicant, introduced himself and explain his intent for the property. No public comment was received. Commissioner Lack expressed support for the request. Motion: Commissioner Chesser made a motion to approve forward the request with a recommendation for approval. Commissioner Earnest seconded the motion. Upon roll call the motion passed with a vote of 9-0-0. Planning Commission August 30, 2010 Page 8 of 9 I-PZD 10-3632: Industrial Planned Zoning District (FAYETTE JUNCTION, 599): Submitted by CRAIG HULL for property located at 1332, 1348, and 1350 CATO SPRINGS ROAD. The property is zoned I-1, HEAVY COMMERCIAL/LIGHT INDUSTRIAL and contains approximately 11.77 acres. The request is for land use approval of an I-PZD, Industrial Planned Zoning District for a concrete plant and an industrial wax business. The applicant withdrew this item. No staff report or public comment was presented. Planning Commission August 30, 2010 Page 9 of 9 ADM 10-3637: Administrative Item (UDC Amendment Chapter 174): Submitted by City Planning Staff. The proposal is to amend Chapter 174, Signs, to include signage designations for recently adopted zoning districts and to modify the current signage regulations. Dara Sanders, Planner, gave the staff report. No public comment was received. Commissioner Hoskins and staff discussed formatting issues, illumination of signage, bulletin boards, and the different variations of the height to square footage ratio for pole signs. Commissioner Hoskins requested that staff consider crafting a different description for this allowance and producing a chart to better explain the variations of the height to square footage ratio allowances for pole signs. Commissioner Chesser, Commissioner Hoskins, Commissioner Lack, and staff discussed the existing requirements for bulletin boards and wall signs. Commissioner Chesser and Kit Williams, City Attorney, discussed monument signs for churches in the RSF districts. Commissioner Lack requested that staff look at signage allowance for cultural uses in RSF districts based on the size of the use. Commissioner Earnest discussed signage in the RSF districts, suggested that the Commission look at a broader approach in mixed use areas, and thanked staff for the work and background provided. Commissioner Cabe discussed wall signs in the RSF district, stating that the existing 8 square feet allowance is too large for cultural uses in a residential district, as the community will already know what the use is. Motion: Commissioner Cabe made a motion to table the request until the September 27, 2010 Planning Commission meeting. Commissioner Chesser seconded the motion. Upon roll call the motion to passed with a vote of 9-0-0. There being no further business, the meeting was adjourned at 7.16 PM.
