Mayor Jordan called the meeting to order. Present: Marion Doss, Ronnie Wood, City Clerk Sondra Smith, Mayor Jordan, Assistant City Attorney Jason Kelley, Deputy City Clerk Lisa Branson, Staff, Audience, and Press. Pete Reagan and Gene Warford were absent. Approval of the Minutes: April 29, 2010 Meeting Minutes Marion Doss moved to approve the April 29, 2010 Firemen's Pension and Relief Fund Board of Trustees meeting minutes. Ronnie Wood seconded the motion. Upon roll call the motion passed 4-0. Pete Reagan and Gene Warford were absent. Pension List Changes: None Approval of the Pension List: June, 2010 Pension List Ronnie Wood moved to approve the June, 2010 Pension List. Marion Doss seconded the motion. Upon roll call the motion passed 4-0. Pete Reagan and Gene Warford were absent. Firemen's Pension and Relief Fund Board of Trustees Meeting Minutes May 27, 2010 Page 2 of 4 Old Business: Election — Ballots Opened Marion Doss and Mayor Jordan accompanied Sondra Smith, City Clerk to retrieve the ballots from the locked cabinet. Jason Kelly, Assistant City Attorney read the ballot procedure that was approved by the Board. Each one needs to be opened and then the ballots taken out and placed face down. The ballots were opened during the meeting according to the ballot procedure that was approved by the Board. Sondra Smith: We're going to call the names on the ballots that we received. I have a list of the pensioners we sent ballots to and I would like someone on the Board to check the names off as we call them out so you can keep a count. The City Clerk called the name of the pensioners on each ballot envelope before opening the envelope. Mayor Jordan: How many is that? Marion Doss: 37. Sondra Smith: Should be 37. Mayor Jordan: That's a pretty good turn out. Sondra Smith: Better than we've ever had. The City Clerk and the Deputy City Clerk opened each ballot and the ballots and envelopes were shuffled. The ballots were read and counted. One ballot had Ralph Tate written to the side and no box was checked for Position 1. Mayor Jordan: That would not be legal would it? Don't they have to check a box? Sondra Smith: They are just voting for Position 2. Jason Kelly: They did not indicate a selection for Position 1. Lisa Branson, Deputy City Clerk: They voted for Pete Reagan for Position 2 but did not vote for Position 1. Firemen's Pension and Relief Fund Board of Trustees Meeting Minutes May 27, 2010 Page 3 of 4 Jason Kelley: Let's set that one aside and finish counting the rest of the votes The City Clerk and the Deputy City Clerk continued counting the ballots. Jason Kelley: It's up to the Board. My opinion on the ballot that was set aside is that there is a valid vote for Position 2 but there is not a valid vote for Position 1. That's my opinion but that's a matter for the Board to decide. Sondra Smith: Ralph Tate may be turning in his vote and signing it. They have signed ballots in the past Marion Doss: It's possible. It may be Ralph Tate signing it or it may be a write-in vote for Ralph Tate. Sondra Smith: You can't tell for sure. Jason Kelley: There is no way to discern it. Mayor Jordan: I'd call that void, because he's running in Position 2. To me that would be invalid. Sondra Smith: Do we need to double check these? Did you keep count Marion? Marion Doss: Yes. I have 19 for me, 17 for Mullens, 3 for Jenkins, 1 for Napier, 27 for Reagan, and 6 for Tate. Is that what you have? Sondra Smith: I have 17 for Mullens, 19 for Doss, 3 for Jenkins, 1 for Napier, 27 for Reagan and 6 for Ralph Tate. Sondra Smith: Pete received the most votes for Position 2 and Marion Doss received the most votes for Position 1. Jason Kelley: According to the rules, the winner for each position will be announced, which you have announced them. Then the election will be ratified by the Board. So there needs to be a vote to ratify the two winners as the winners. Ronnie Wood moved to approve the Fire Pension election results. Marion Doss seconded the motion. Upon roll call the motion passed 4-0. Pete Reagan and Gene Warford were absent. New Business: Revenue/Expense Report April 30, 2010 Firemen's Pension and Relief Fund Board of Trustees Meeting Minutes May 27, 2010 Page 4 of 4 Sondra Smith: This is the report that Trish in the Accounting Department does each month so you can see your expenses and revenues. This is just an informational item. Longer Investments: Monthly Report — April 30, 2010 Sondra Smith: Longer Investments sent a copy of the April 301h report for the Board to review. Informational: 2010 MeetinE Schedule Sondra Smith: This is just an informational item. Meeting Adjourned at 3:35 p.m.
