Mountain, Fayetteville, Arkansas. Subdivision Committee February 11, 2010 Page 2 of 4 FPL 09-3496: Final Plat (PADDOCK S/D/ROBERT SCHMITT, 526): Submitted by H2 ENGINEERING, INC. for property located SOUTH AND WEST OF PADDOCK LANE AND HAPPY HOLLOW ROAD. The property is zoned R-PZD, RESIDENTIAL PLANNED ZONING DISTRICT and contains approximately 9.77 acres. The request is for final plat approval of a residential subdivision with 58 residential units. Andrew Garner, Senior Planner, gave the staff report, and described the background and request for final plat approval. Greg Howe, Urban Forester, discussed that there is tree preservation on individual lots that will be protected in the subdivision covenants. Kipp Hearne, applicant, also discussed the tree preservation areas and that in an effort to provide additional tree preservation will vacate an access easement in the southwest corner of the site and place the abandoned undeveloped easement into a tree preservation area. Public Comment: Richard Covey, adjacent property owner to the west, discussed that there was a stub -out to the west that was supposed to line up on his property. Public Comment Was Closed: Kipp Hearne, applicant, discussed that the plat shows the stub -out just to the south of Richard Covey's property, but that they did not survey the adjacent property lines, and the street may stub -out to Mr. Covey's property. Garner discussed that the subdivision has been constructed in accordance with the approved construction plans. Commissioner Lack discussed that he remembers the discussion about the street stub -out when this project initially came through. He discussed the issue of tree preservation by subdivision covenants. Garner discussed that this was an unusual situation where tree preservation areas were protected by the subdivision covenants, which are enforced by the property owner's association, not the City. He discussed that prior to building permit on the lots with tree preservation areas that grading and tree preservation plans would have to be submitted for review and approval. Motion: Commissioner Lack made a motion to approve the request. Commissioner Honchell seconded the motion. Upon roll call the motion passed by a vote of 3-0-0. LSP 10-3511: Lot Split (GREG HENRY, 448): Submitted by BLEW & ASSOCIATES, INC. for Subdivision Committee February 11, 2010 Page 3 of 4 property located at 711 VINSON and 822 REBECCA. The property is zoned RSF-4, SINGLE FAMILY - 4 UNITS/ACRE and contains approximately 0.44 acres. The request is to divide the subject property into two tracts of approximately 0.20 and 0.24 acres. Dara Sanders, Current Planner, gave the staff report and recommended approval of the request. Buckley Blew, representative, agreed with the conditions of approval. Harold Parrett, neighbor, stated that he has no objection to the lot split and discussed alleged code violations and expressed concern with access. Motion: Commissioner Honchell made a motion to approve the request with the staff recommended conditions of approval. Commissioner Cabe seconded the motion. Upon roll call the motion passed by a vote of 3-0-0. 3 Subdivision Committee February 11, 2010 Page 4 of 4 ADM 10-3526: Administrative Item (LADE/HERZOG/11 N WILLOW): Submitted by CADE JACOBS for property located at 11 N WILLOW. The property is zoned RMF -24, MULTI FAMILY — 24 UNITS PER ACRE and contains approximately 0. 11 acres. The request is to construct a single-family dwelling on an existing non -conforming lot of record platted prior to 1970. Jesse Fulcher, Current Planner, gave the staff report, describing the request to build a single-family home. Cade Jacobs, applicant, stated that he was helping a family member build a new house on the lot. Commissioner Lack asked if the lot size was similar to RSF-8 Fulcher stated that the existing lot was consistent with the minimum lot requirements in the RSF-8 zoning district. Motion: Commissioner Lack made a motion to approve the request with the staff recommended conditions of approval. Commissioner Honchell seconded the motion. Upon roll call the motion passed by a vote of 3-0-0. There being no further business, the meeting adjourned at 9:35 AM.
