5:30 PM- Planning Commission Chair Sean Trumbo called the meeting to order.
Commissioner Trumbo requested for all cell phones to be turned off, and informed the audience
that listening devices were available. Upon roll call, all members were present.

Consent:
Approval of the minutes from the August 10, 2009 Planning Commission meeting.
ADM 09-3411 (LIBERTY BANK): Submitted by CRAFTON, TULL & SPARKS for property
located at the NW CORNER OF JOYCE AND VANTAGE. The property is zoned R -O,
RESIDENTIAL OFFICE and contains approximately 2.68 acres. The request is for a one year
extension of the approved Large Scale Development, LSD 07-2574.
ADM 09-3412 (PATHWAY BAPTIST): Submitted by JUSTIN JORGENSEN for property located
at the SE CORNER OF MT. COMFORT AND SALEM. The property is zoned R -O,
RESIDENTIAL OFFICE and P-1, INSTITUTIONAL and contains 14.36 acres. The request is for a
one year extension of the approved Lot Split, LSP 08-3025.
VAC 09-3397: (UNIVERSITY OF ARKANSAS, 483): Submitted by the U OF A for property
located at ION. GARLAND AVENUE. The property is zoned P-1, INSTITUTIONAL. The request
is to vacate a portion of an existing utility easement.
VAC 09-3399: (HARRIS / 303 S. WEST AVENUE, 523): Submitted by BATES & ASSOCIATES
for property located at 303 S. WEST AVENUE. The property is zoned DG, DOWNTOWN
GENERAL and contains approximately 0. 10 acres. The request is to vacate a portion of the West
Avenue right-of-way and a 30' alley right-of-way.
No public comment was received.
Motion:
Commissioner Graves made a motion to approve the Consent Agenda. Commissioner Cabe
seconded the motion. Upon roll call the motion passed with a vote of 9-0-0.

RZN 09-3394: (S & M, LLC / BOX AVENUE SUBDIVISION LOTS 2 & 3,372): Submitted by
H2 ENGINEERING, INC. for property located at 2013, 2025, 2037, and 2049 BOX AVE. The
property is zoned RSF-4, SINGLE FAMILY - 4 UNITS/ACRE and contains approximately 1.05
acres. The request is to rezone the subject property to RMF -6, Residential Multi -family, 6 units per
acre.
Jesse Fulcher, Current Planner, gave the staff report, explaining the previous conditional use and lot
split, and the intent of the owner to market the existing two-family dwellings as townhomes. The
rezoning was necessary to allow the classification of the units as townhomes, and a Bill of
Assurance had been provided to affirm the owner's intentions.
Bleaux Barnes, applicant, stated that he wanted to provide the current residents an opportunity to
buy the units and get financing, which required them to be townhomes.
Commissioner Winston asked if a variance would be necessary to allow a property line in between
the attached units.
Fulcher explained the common wall/zero lot line ordinance that permitted attached units to be
subdivided.
Motion:
Commissioner Lack made a motion to forward the request to the City Council with a
recommendation of approval. Commissioner Cabe seconded the motion. Upon roll call the
motion passed with a vote of 9-0-0.

RZN 09-3398: (SCHAFFER / 528 N. COLLEGE, 446): Submitted by LANCE AND JULIE
SCHAFFER for property located at 528 N. COLLEGE AVENUE. The property is zoned C-2,
THOROUGHFARE COMMERCIAL and contains approximately 0.17 acres. The request is to
rezone the subject property to DG, Downtown General.
Jesse Fulcher, Current Planner, gave the staff report, explaining the owners' intent to utilize the
majority of the existing structure as a residence, which was not permitted in the C-2 zoning district.
In staff s opinion, the Downtown General zoning district is consistent with adopted land use polices
and compatible with surrounding properties.
Lance Schaffer, applicant, stated that they are using the structure as their primary residence, with a
small shop on the first floor.
Commissioner Winston asked if the existing parking lot between the building and street would
require a variance if the property was rezoned.
Fulcher stated that there are only two parking spaces, which do not constitute a parking lot, and
therefore a variance would not be necessary to allow parking in the build -to zone.
Motion:
Commissioner Cabe made a motion to forward the request with a recommendation of approval.
Commissioner Winston seconded the motion. Upon roll call the motion passed with a vote of
9-0-0.
There being no further business, the meeting was adjourned at 5:45 PM.
