Subdivision Committee February 26, 2009 Page 2 of 3 New Business: LSP 09-3216: (CLAY MORTON / SUNSET DRIVE, 404): Submitted by BATES AND ASSOCIATES for property located at 1147 N. SUNSET DRIVE. The property is zoned RSF-4, SINGLE FAMILY - 4 UNITS/ACRE and contains approximately 0.52 acres. The request is to divide the subject property into two tracts of 0.19 and 0.33 acres. Jesse Fulcher, Current Planner, gave the staff report, described the request and provided background on an ongoing over -occupancy violation. Two letters from adjacent property owners, objecting to the lot split, were handed out. The applicant is required to extend a water line prior to recordation of the lot split. Derrick Thomas, applicants, stated he had no additional comments. No public comment was received. Commissioner Winston asked if there were any issues with separation between curb -cuts. Fulcher stated that there are only minor separation requirements for residential curb -cuts and that there would not be any issues. Commissioner Anthes asked if the lot frontage was okay and if there were any covenant restrictions, house size, design requirements, etc. Fulcher stated that the property fronted on Sunset and Wedington, so there was sufficient frontage. The City can not enforce covenants that may dictate house size and design. There are minimum bulk and area requirements, which are being met. Motion: Commissioner Anthes made a motion to approve the request, stating the request met all requirements. Commissioner Winston seconded the motion. Upon roll call the motion passed with a vote of 3-0-0. 2 Subdivision Committee February 26, 2009 Page 3 of 3 R-PZD 09-3168: (HOLCOMB HEIGHTS PH.111, 245): Submitted by APPIAN CENTER FOR DESIGN for property located at 3434 W. WEIR ROAD. The property is zoned RSF-4, SINGLE FAMILY - 4 UNITS/ACRE and contains approximately 3.23 acres. The request is for Zoning, Land Use and Preliminary Plat approval of a Residential Planned Zoning District with 11 lots. The development proposes 8 single family lots, 8 townhomes, 2 live work units, a mixed use building, greenspace and a civic building. Andrew Garner, Senior Planner, stated that the request was being tabled to the March 12, 2009 Subdivision Committee meeting. No public comment was received. Motion: Commissioner Winston made a motion to table the request. Commissioner Anthes seconded the motion. Upon roll call the motion was passed with a vote of 3-0-0. There being no further business, the meeting adjourned at 9:15 AM. 3
