Subdivision Committee September 11, 2008 Page 2 of 7 New Business: ADM 08-3098: Administrative Item (OZARKS ELECTRIC): Submitted by CRAFTON TULL SPARKS AND ASSOCIATES for property located at 3641 W. WEDINGTON DRIVE. The request is for a major modification to the Large Scale Development, LSD 07-2710 Ozarks Electric, for revised cross access. Andrew Garner, Senior Planner, gave the staff report, discussing the applicant's request and the proposed modification to eliminate the previously approved private drive south to Persimmon and allow for cross access to the east. Finding the request meets all ordinance requirements staff recommends approval with conditions as listed in the staff report. Jonathan Ely, applicant, was present representing Ozark Electric, and stated agreement with the conditions of approval. No public comment was received. Commissioner Trumbo asked if public traffic was to be permitted on the original drive south to Persimmon, and the new cross access drive. Jonathan Ely responded that the originally approved drive south to Persimmon was to be a private, gated drive for Ozarks Electric, and that the new cross access drive was also going to be private and gated at the Ozark Electric property line. Motion: Commissioner Trumbo made a motion to approve the request with the conditions approval recommended in the staff report. Commissioner Bryant seconded the motion. Upon roll call the motion passed with a vote of 3-0-0. Subdivision Committee September 11, 2008 Page 3 of 7 FPL 08-3077: Final Plat (TWIN SPRINGS ESTATES PH. II, 318/357): Submitted by LEONARD & MARY GABBARD for property located at DOUBLE SPRINGS RD, 0.8 MI N OF JESS ANDERSON ROAD. The property is in the Planning Area and contains approximately 5.57 acres. The request is to review a final plat with 23 single family dwellings. Andrew Garner, Senior Planner, gave the staff report, describing the background and request for final plat approval of 23 single family lots and one unbuildable lot. Staff is recommending approval with conditions as listed. Leonard Gabbard, applicant/owner, stated he was representing the project. He asked staff about Condition No. 2.d and pointed out that the plat page number was located in the upper right-hand comer of the plat. Garner responded that no other revisions were needed and 2.d. could be removed. No public comment was received. Motion: Commissioner Trumbo made a motion to approve the request with conditions as listed. Commissioner Bryant seconded the motion. Upon roll call the motion passed with a vote of 3-0- 0. Subdivision Committee September 11, 2008 Page 4 of 7 PPL 08-3086: Preliminary Plat (CREEKSIDE, 360): Submitted by H2 ENGINEERING, INC. for property located at the SE CORNER OF MT. COMFORT ROAD AND BRIDGEPORT DRIVE. The property is zoned RSF-4, SINGLE FAMILY - 4 UNITS/ACRE and contains approximately 10.94 acres. The request is for a residential subdivision with 16 single family dwelling units. Jesse Fulcher, Current Planner, gave the staff report, describing thte preliminary plat request of 16 single family lots. He discussed access to Mt. Comfort Rd., a Minor Arterial street. The applicants have agreed to provide a common shared drive with two curb cuts onto Mt. Comfort Rd. Staff is recommending the drive entrances be shifted to obtain a greater separation distance from Berkleigh. Fulcher discussed street improvements, and other conditions, including a variance of greenspace and banking of parkland. Jeremy Thompson, applicant, stated he was in agreement with almost all conditions of approval, with the exception of the turn lane at Bridgeport. Currently we only have three lots that access Bridgeport, but I don't believe a turn lane is consistent with the traffic loads, with the reduction of lots to 16. Tom Hennelly, applicant, stated he would like to discuss the recommendation for directional boring through the tree canopy area for the sewer line, as he was under the impression they could root prune. Also on #2, he would like to discuss tree canopy priority. Greg Howe, Urban Forester, stated he didn't know the size of the sewer line, and the exact location of the trees, because they are not called out on the plan. Construction could damage the trees if they are adjacent to traffic. On the priority level, the trees shown as low priority are specimen trees, and should be considered high priority. Hennelly stated he would like the opportunity to discuss the construction techniques and will provide more data. He discussed priority of tree canopy and how those determinations are made. Jeremy Pate, Director of Current Planning, confirmed that ultimately is up the Urban Forester to make that determination and recommendation to the Planning Commission for a decision. No public comment was received. Commissioner Trumbo stated that the turn lane seems like it's not needed. Jeremy Pate, Director of Current Planning, stated that staff would be happy to review before Planning Commission. Hennelly stated he would discuss an idea to construct the turn -lane with a city cost -share... Just didn't think additional 30 vehicles per day warrants a turn lane. Glenn Newman, City Engineer, stated he would like to further discuss with the applicant the opportunity to provide a rear alley. Subdivision Committee September 11, 2008 Page 5 of 7 Commissioner Trumbo asked if shifting the driveway was possible. Hennelley stated they certainly would look at relocating it. Motion• Commissioner Trumbo made a motion to forward the request to Planning Commission with a recommendation for approval, making no recommendation on condition #1, to allow additional time for staff and the applicant to discuss street improvements, and in favor of conditions #2 and #3. Commissioner Bryant seconded the motion. Upon roll call the motion passed with a vote of 3-0-0. Subdivision Committee September 11, 2008 Page 6 of 7 LSD 08-3037: (VICTORY COMMONS, 560): Submitted by BATES & ASSOCIATES for property located at RAZORBACK ROAD, 500'S OF THE INTERSECTION WITH 6TH STREET. The property is zoned I-1, HEAVY COMMERCIAL/LIGHT INDUSTRIAL and contains approximately 1.29 acres. The request is for a commercial development with 18 attached dwelling units and 9,319 s.f. of commercial space with associated parking. Jesse Fulcher, Current Planner, gave the staff report, describing the site location and proposal for a three-story mixed-use building. Razorback Rd. has been recently improved by AHTD. He discussed the landscape variance request. Because of the recommendation of denial on the Tree Preservation plan, staff is recommending tabling to allow time for the applicant and staff to work together. Fulcher discussed conditions and recommendations. Jeremy Pate, Director of Current Planning, clarified the recommendation of curb cut issues, which provides two options for the developer to choose from, in order for him to not have to return to the Planning Commission if the AHTD denies the first option that is proposed. Tracy Hoskins, applicant, stated it was a use by right project. He has just discovered it was recommended to be tabled. Geoff Bates, applicant, stated he didn't know why this should be tabled, we can work out the changes in the next 7 days. Greg Howe, Urban Forester, explained the recommendation for the Tree Preservation Plan. He stated that the 15% canopy that is required was down to 5% right now. However the 5% of tree canopy shown as preserved are all impacted by the development with fill or other construction. Trees proposed to be saved within a tree island near the north end of the building, and 1115, 1160, & 1161 are also of concern. Hoskins discussed his concern with tabling the project, citing the use by right of this project, the AHTD limitations from Razorback Road being improved, and the tree canopy issues. No public comment was received. Hoskins discussed the landscape variance, and that it will be a problem to shift the site a lot. The primary issue would be reducing the width of the driveway aisle, which was required by the fire department, and a major redesign is not warranted. AHTD will allow us to plant out there, I have a letter or email to that effect. For curb cuts, AHTD placed the curb cuts there, and made a mistake by not allowing access to all 3 parcels. He discussed conversations with AHTD when Hwy 112 was improved. He met with staff, who recommended the location as currently shown. Hoskins discussed the AHTD reasons for not supporting the median cut. Commissioner Cabe discussed the AHTD determination; is it appropriate to even discuss, if it's not supported? Pate described that staff is providing the 2°a option to prevent the developer from having to come Subdivision Committee September 11, 2008 Page 7 of 7 back to Planning Commission and delay the project further if AHTD denies the request for the median cut. Hoskins discussed the Razorback Rd. radius at 15`h St. Newman discussed the wetland determination requirements from the code. Hoskins presented photographs over the last four years. We can get a determination of wetlands from a 3rd party by the deadline. At least give us the opportunity to try to make the Monday deadline. Commissioner Cabe discussed the landscape variance. Pate discussed the landscape variance, where the intent is to provide the 15' ft. with landscaping. In this instance, it is almost meeting that requirement along the frontage, due to the excess right-of- way. Staff has recommended shifting the north end of the parking lot a couple of feet to the west to maintain a 15 foot greenspace area. Commissioner Cabe asked if staff is okay with working this out by Monday. Howe stated that he was. Commissioner Trumbo stated he was okay with forwarding on, as long as staff is OK with taking the time to work on it. Commissioner Bryant asked what time on Monday the revisions are due. Fulcher stated they are due at 10:00 AM. Commissioner Bryant asked if the applicant would be able to meet that. Hoskins stated he believed he could. Commissioner Trumbo asked if the applicants were okay with the two options presented by staff on the curb cuts. Hoskins stated that he didn't see that's a big deal, as long as it states that it's if we don't get the AHTD approval. He discussed trees and wetland determination. Commissioner Trumbo made a motion to forward the request to Planning Commission with conditions as listed. Commissioner Cabe seconded the motion. Upon roll call the motion passed with a vote of 3-0-0. All business being concluded, the meeting was adjourned at 10:15 AM.
