MINUTES OF A MEETING OF THE
SUBDIVISION COMMITTEE
A regular meeting of the Fayetteville Subdivision Committee was held on June 12, 2008 at 9:00 a.m.
in Room 219 of the City Administration Building, 113 W. Mountain, Fayetteville, Arkansas.

New Business:
LSP 08-2947: (MARKS, 404): Submitted by RANDY RITCHEY STEADFAST, INC. for property
located at 1224 HENDRIX. The property is zoned RSF-4, SINGLE FAMILY - 4 UNITS/ACRE and
contains approximately 0.50 acres. The request is to divide the subject property into two parcels of
0.25 acres each.
The requested lot split was tabled since the applicant did not submit the required information
prior to the deadline necessary to continue processing the application. Public comment was
not presented.
Motion:
Commissioner Graves made a motion to table the request to the July 03 Subdivision Committee
meeting. Commissioner Trumbo seconded the motion. Upon roll call the motion was passed
by a vote of 3-0-0.

(MARKHAM HILL COTTAGE COURTS, 520): Submitted by ROBERT SHARP for
property located at NORTH OF MAINE ST., BETWEEN SANG AND CROSS. The property is
zoned RMF -24, MULTI FAMILY - 24 UNITS/ACRE and contains approximately 2.54 acres
located within the Hillside Hilltop Overlay District. The request is for Zoning, Land Use, and
Development approval of a Residential Planned Zoning District with 23 single family cottage
dwelling units and site improvements.
Andrew Garner, Senior Planner, gave the staff report and described the proposed project for 23
single family dwellings in the Hillside Hilltop Overlay District. He discussed that staff was
recommending tabling the request at this time to allow the applicant time to revise the tree
preservation plan and bring the preservation numbers up from approximately 24% to the minimum
30% required by ordinance for a PZD.
Carole Jones, Urban Forester, stated agreement with the previous comments and discussed that staff
has worked with the applicant but the plans still need revision.
Glenn Newman, Staff Engineer, stated that permission from the adjacent property owner is required
to construct the intersection improvements at the new Nettleship Street and Cross Avenue.
Daniel Dean, applicant, stated that he understood staff s concern with tree preservation and would
like time to work with staff to address the issues.
Felicia Ferris, public comment, discussed concern that Markham Hill was a major fire hazard. She
discussed the possibility of college students living in this development with not enough parking, and
that the students may park all over the narrow streets causing difficulty for fire access. She
requested a close look at how fire response is being provided.
Commissioner Graves discussed that he was in support of staff recommendations. He read through
the conditions of approval requiring Planning Commission determination stating agreement with all
staff recommendations.
Commissioner Trumbo stated agreement with Commissioner Graves.
Motion:
Commissioner Trumbo made a motion to table the request finding in favor of all conditions of
approval. Commissioner Graves seconded the motion. Upon roll call the motion passed with a
vote of 3-0-0.
(MOUNTAIN RANCH APARTMENTS, 479): Submitted by JORGENSEN & ASSOC for

property located SE OF PERSIMMON STREET AND MOUNTAIN RANCH PHASE I. The
property is zoned RMF -24, MULTI FAMILY - 24 UNITS/ACRE and contains approximately 15.37
acres. The request is for a multi -family development with 360 single family units proposed, a
project which was previously approved and is under construction.
Jesse Fulcher, Current Planner, gave the staff report, describing that the project approval had
expired and that Urban Residential Design Standards had been approved since the original approval;
however, the project was under construction and therefore staff was recommended approval of two
waivers of design standards and recommending that the project be forwarded to the full Planning
Commission.
Justin Jorgensen, applicant, stated that he had no further comments.
Commissioner Graves stated that this was the exact same project as previously approved and that
the waivers were appropriate given that the project was under construction.
No public comment was received.
Motion:
Commissioner Graves made a motion to forward the request finding in favor of all conditions of
approval. Commissioner Trumbo seconded the motion. Upon roll call the motion passed with a
vote of 3-0-0.
LSD 08-3010: (ROCKIN' CHICKEN, 557): Submitted by H2 ENGINEERING, INC. for property
located at 3120 W. 6TH STREET. The property is zoned C-1, NEIGHBORHOOD COMMERCIAL

and contains approximately 7.40 acres. The request is for a 3,379 s.f. restaurant with associated
parking.
Dara Sanders, Current Planner, gave the staff report, recommending approval of the request with
conditions as listed in the staff report.
Tom Hennelly, applicant, gave a summary of the project.
No public comment was received.
Motion:
Commissioner Trumbo made a motion to approve the request finding in favor of all conditions of
approval. Commissioner Graves seconded the motion. Upon roll call the motion passed with a
vote of 3-0-0.
All business being concluded, the meeting was adjourned at 9:45 AM.
