MINUTES OF A MEETING OF THE
SUBDIVISION COMMITTEE
A regular meeting of the Fayetteville Subdivision Committee was held on November 15, 2007 at
9:00 a.m. in Room 219 of the City Administration Building, 113 W. Mountain, Fayetteville,
Arkansas.

New Business:
LSP 07-2715: Lot Split (BRACY/LOT 17 CMN 1, 213): Submitted by MCCLELLAND
CONSULTING ENGINEERS for property located at 3420 N. PLAINVIEW, LOT 17 OF CMN
BUSINESS PARK I. The property is zoned C-2, THOROUGHFARE COMMERCIAL and contains
approximately 1.96 acres. The request is to divide the subject property into two tracts of 0.77 and
1.14 acres.
Andrew Garner, Senior Planner, gave the staff report, recommending approval with four
conditions.
Leslie Munzner, applicant, had no comment.
No public comment was received.
Commissioner Winston stated the request was straightforward.
Motion:
Commissioner Winston made a motion to approve the request with staff recommendation of
approval with conditions. Commissioner Anthes seconded the request. The motion passed with a
vote of 3-0-0.

FPL 07-2796: Final Plat (STADIUM CENTRE COTTAGES R-PZD, 557): Submitted by H2
ENGINEERING for property located at THE SE CORNER OF OLD FARMINGTON ROAD AND
SANDRA STREET. The property is zoned R-PZD, RESIDENTIAL PLANNED ZONING DIST.
and contains approximately 2.45 acres. The request is for a final plat of a Residential Planned
Zoning District subdivision with 14 residential lots, 1 common area lot and 1 detention lot for a total
of 16 lots.
Jesse Fulcher, Current Planner, gave the staff report, recommending staff approval with conditions.
Sarah Patterson, Urban Forester, stated the conditions of approval for landscaping and tree
mitigation, as outlined in the report.
Commissioner Anthes asked if the plan had changed since Planning Commission review, and if
City Council had determined there would be no connections to Sandra Street.
Fulcher confirmed that it had.
Commissioner Winston asked if lot 15 would be buildable.
Kipp Hearne, applicant, stated it would not.
Commissioner Winston made several comments regarding technical issues on the plat.
Matt Casey, Staff Engineer, stated that all sidewalks must be shown on the plat.
Commissioner Anthes asked if there was any idea on the location of the meandering sidewalk along
Old Farmington Road.
Patterson stated she will have to look at it with the Sidewalk Administrator at the time of
construction, but the intent is to make it as straight as possible. If there are good trees that are in the
way, though, it might meander to save that canopy.
Motion:
Commissioner Winston made a motion to approve the request with stated conditions.
Commissioner Anthes seconded the motion. The motion passed with a vote of 3-0-0.

FPL 07-2770: Final Plat (SUMMIT PLACE S/D, 329): Submitted by DAVE JORGENSEN for
property located at S & E OF TOWNSHIP STREET AND N. COLLEGE AVE. The property is
zoned RSF-4, SINGLE FAMILY, 4 UNITS PER ACRE and contains approximately 30.77 acres.
The request is for a final plat of a residential subdivision with 50 single family lots.
Andrew Garner, Senior Planner, gave the staff report, providing the date of preliminary plat
approval and noting the conditions of approval for the final plat as listed in the staff report. Staff
recommended approval.
Matt Casey, Assistant City Engineer, stated there has been some accidental off-site land
disturbance and tree removal with the development. Engineering has tried to facilitate
discussions between the developer and the property owner to resolve the issue, without much
luck. Engineering will not be signing the final plat until City Attorney lets them know it is okay
to be signed.
Sarah Patterson, Urban Forester, stated that the off-site tree removal requires nine trees to be
planted on-site. All lots will have to meet tree preservation requirements (30% preservation) as
they development.
Tina Daniel (attorney for the applicant) asked what the City Attorney will know about grading
violations that the Engineering Division does not know.
Jeremy Pate, Director of Current Planning, stated she will need to speak to the City Attorney
regarding any legal issues.
Casey stated that on-site measures to resolve the grading violation have been taken, but off-site
issues with the grading violation have not been resolved as the applicant has not received permission
from the neighbor to stabilize the disturbed slope. As it appears this issue may go into a lawsuit staff
will heed the City Attorney's advice. If the City Attorney is okay with this issue, staff will sign the
final plat.
Justin Jorgensen, (applicant), stated that he is in agreement with the conditions of approval and
that they have worked with City staff and the neighbors to resolve the grading violation.
Pate stated the applicant needs to revise the hatching pattern of the Hillside/Hilltop Overlay
District on the final plat as it is too dark.
Commissioner Anthes stated she was glad to hear 40% of the tree canopy was retained after the
community has been concerned with the hillside being cleared as part of this development.
Motion:
Commissioner Anthes made a motion to approve the request subject to conditions, with the
understanding that the plat will not be signed until the dispute is resolved. Commissioner Winston
seconded the motion. The motion passed with a vote of 3-0-0.

PPL 07-2766: Preliminary Plat (THE COVES, 555): Submitted by RAUSCH COLEMAN
HOMES for property located NW OF ALBERTA AND HOLLAND AND WALNUT CROSSING
S/D. The property is zoned R-PZD, RESIDENTIAL PLANNED ZONING DISTRICT and contains
approximately 50.40 acres. The request is for 180 single family lots.
Jesse Fulcher, Current Planner, gave the staff report and discussed the conditions of approval. He
discussed the street improvements to Alberta from the initial Walnut Crossing project and the
agreement between the developers and Farmington regarding the traffic signal on Hwy 62. Fulcher
went over waivers and conditions of approval, including a recommendation to revise the phase line.
Matt Casey, Staff Engineer, stated that he hasn't seen the details on the roll-over curb yet, which is
one of the waiver requests. He stated he has no objections at this time, but the engineer will have to
compensate for drainage during construction plan review.
Sarah Patterson, Urban Forester, stated that the area has been previously cleared, with less
desirable, invasive species on the site. During the review of this project, they have looked to the
riparian area along the north to save canopy. A lot of mitigation (949 trees) is to be planted on-site to
plant within riparian area and park and trails areas, which will add a dense canopy on this property.
No public comment was received.
Kim Hesse, applicant, stated that the phasing intent was based on sewer, that they had overlooked
the 2"a street connection, and will make that change.
Commissioner Anthes discussed the shared driveways that staff has recommended for certain lots,
and with which the applicant disagrees. Anthes stated the coving concept has created the issue with
the driveways taking up much of the area of the front of the lot, and the way the project layout has
occurred has created the need for the design.
Hesse stated that in other projects, they have not been able to sell the homes with shared drives. It
has become an issue. These are affordable homes, and they would like very much to reduce cost by
reducing pavement any way they can, but the shared driveway has become problematic. With some
of the long driveways, they will be able to narrow down the driveway to reduce cost. The benefits of
coving outweigh the issues that came up. She stated she finds it to be an appealing streetscape,
regardless of driveways. Their goal is to develop homes as efficiently as possible, but they have to
sell them.
Mike Anderson (applicant) stated the majority of homes have alleys, so there are not a tot of curb
cuts onto the street anyway.
Commissioner Anthes stated she just moved from a house that had a shared curb cut in the historic
district, and it worked just fine, so she didn't see the problem with that.
The Committee began a discussion about curb cuts, and resolutions to the issue.

Commissioner Anthes asked for staff and the applicant to look at options to reduce curb cuts to 10'
max width for those lots. The goal is to reduce the visual impact the many driveways will have.
Motion•
Commissioner Anthes made a motion to forward the request, specifying for staff and the applicant
to determine if condition 1(a) is necessary, in favor of 1(b), the Commission will wait for a full
recommendation for condition 1(c), and that staff and the applicant will work to provide a mutually
agreeable solution for condition 2. Commissioner Winston seconded the motion. The motion
passed with a vote of 3-0-0.
All business being concluded, the meeting adjourned at 9:50 AM.
