Mountain, Fayetteville, Arkansas. Subdivision Committee September 27, 2007 Page 2 of 7 New Business: ADM 07-2738: Administrative Item (WEDINGTON PLACE, 401): Submitted by Crafton, Tull & Sparks Associates for property located N OF WEDINGTON DRIVE, W OF STEAMBOAT DRIVE. The request is for a major modification to the approved Large Scale Development of Wedington Place to add a drive-thru to Bldg. A. Jesse Fulcher, Current Planner, gave the staff report, discussing the request for the addition of a drive-thru lane around Building "A". The building will be slightly shifted to the north, which will result in the removal of approximately 7 parking spaces. A parking table has been included with the staff report indicating sufficient parking for the overall development. Jonathan Ely, applicant, did not have any further comments to add. Commissioner Anthes asked about the visibility of the new location of the dumpster and any expected changes to the east elevation of the building associated with the drive-thru. Fulcher stated that the dumpster was approved on the north side of the building with the large scale development; however, the location of the drive-thru necessitated relocation of the dumpster. The only change to the east elevation would be the addition of a window for drive-thm service. The east elevation is not very visible from the public realm, and as approved, was the least articulated side of the building. Motion: Commissioner Anthes made a motion to approve the request. Commissioner Winston seconded the request. The motion passed with a vote of 3-0-0. Subdivision Committee September 27, 2007 Page 3 of 7 ADM 07-2754: Administrative Item (CLINTON RETAIL, 134): Submitted by Kim Fugitt for property located N of Joyce Blvd., on the W side of Steele Blvd. The request is for major modification to the approved Large Scale Development, LSD 07-2279 with changes to the building design. Jesse Fulcher, Current Planner, gave the staff report, discussing the requested material changes to the building elevations. Commissioner Porter asked why the roll-out doors had been removed from the rear elevation. Mike Morgan, applicant, stated that the doors were no longer needed for the development. There is sufficient screening still proposed on the north side of the property. Commissioner Anthes asked if there were building elevations to review. Fulcher displayed the boards for the commissioners and provided a brief explanation regarding the changes in materials. Motion: Commissioner Anthes made a motion to approve the request. Commissioner Winston seconded the motion. The motion passed with a vote of 3-0-0. Subdivision Committee September 27, 2007 Page 4 of 7 LSP 07-2732: Lot Split (CMN III, 172-211): Submitted by MCCLELLAND CONSULTING ENGINEERS for property located at THE NE CORNER OF GREGG AVENUE AND VAN ASCHE DRIVE. The property is zoned C-1, NEIGHBORHOOD COMMERCIAL and contains approximately 53.93 acres. The request is to divide the subject property into two tracts of 20.8 and 33.2 acres. Jesse Fulcher, Current Planner, gave the staff report, describing the requested lot split. Mike Morgan (applicant), stated that he was in favor of all conditions of approval. Commissioner Winston asked if the proposed split was along a natural border. Morgan stated the split is proposed along the floodplain/deed restricted area. Commissioner Anthes asked if access to the properties had been reviewed. Glen Newman, Staff Engineer, stated that he had reviewed some preliminary access points, but that access would be reviewed at the time of development. Commissioner Anthes stated that she just wanted it noted for the applicant's benefit. Motion: Commissioner Anthes made a motion to approve the request. Commissioner Winston seconded the motion. The motion passed with a vote of 3-0-0. Subdivision Committee September 27, 2007 Page 5 of 7 LSP 07-2730: Lot Split (MURPHY OIL/FINGER ROAD, 558): Submitted by CEI ENGINEERING ASSOCIATES, INC. for property located at 2985 W. 6TH STREET, HWY. 62W. The property is zoned C-2, THOROUGHFARE COMMERCIAL and contains approximately 28.70 acres. The request is to divide the subject property into two tracts of 27.72 and 0.78 acres respectively. Andrew Garner, Senior Planner, gave the staff report. He clarified that condition of approval number one should read, "Right-of-way in the minimum amount of 25' from centerline along Finger Road and 48.5' from centerline along 6t" Street shall be dedicated as part of this lot split if it does not currently exist. The Master Street Plan right-of-way shall be clearly indicated on the plat." Dustin Riley, applicant, stated he was in agreement with the conditions. Commissioner Anthes asked about the lot size and if right-of-way was dedicated as part of the Wal-Mart development. Garner responded that the lots meet all requirements in the C-2 zoning district, and that it is anticipated that adequate right-of-way was dedicated as part of the development, but that the lot split plat does not clearly show the right-of-way. Motion: Commissioner Anthes made a motion to approve the request in favor of condition #1 as stated by staff and the other conditions. Commissioner Winston seconded the motion. The motion passed with a vote of 3-0-0. It should be noted that this item was re -opened at the end of the meeting and an additional condition of approval, #5, was added requiring a cross access easement between the two parcels to be provided prior to recording the lot split (see following minutes). Subdivision Committee September 27, 2007 Page 6 of 7 LSP 07-2731: Lot Split (MURPHY OIL / MALL AVENUE, 173): Submitted by CEI ENGINEERING ASSOCIATES, INC. for property located at 3951 NORTH MALL AVENUE, S OF JOYCE BLVD. The property is zoned C-2, THOROUGHFARE COMMERCIAL and contains approximately 24.94 acres. The request is to divide the subject property into two tracts of 24.10 and 0.29 acres. Andrew Garner, Senior Planner, gave the staff report. He added that similar to the previous item on the agenda, that a condition of approval number 4 should be added that, "Right-of-way in the minimum amount of 35' from centerline along Mall Avenue and 48.5' from centerline along Joyce Boulevard shall be dedicated as part of this lot split if it does not currently exist. The Master Street Plan right-of-way shall be clearly indicated on the plat." Dustin Riley, applicant, stated he was in agreement with the conditions. Commissioner Myres asked about the right-of-way being a similar situation as the previous lot split item on the agenda. Garner responded that, yes, it is a similar situation where the right-of-way has likely been dedicated but as the plat does not clearly show it, a condition of approval should be added. Glenn Newman, Staff Engineer, asked whether this lot split would result in a small portion of the parent tract north in the northeast corner would be left as a small sliver of land cut off from the parent tract and the resulting tract. Jesse Fulcher, Current Planner, showed on the lot split plat that the small portion property in question would indeed remain connected to the parent tract, and would not be separated. Commissioner Anthes asked about parking and access into the gas station property. Dustin Riley, applicant, responded that a shared access agreement would be recorded. Commissioner Anthes discussed that the shared access agreement between these parcels should be provided, for this lot split and also the previous lot split item on the agenda. She discussed that a condition of approval should be added to be lot splits to ensure adequate access and cross -access. Motion: Commissioner Anthes made a motion to approve the request in favor of adding condition #4 as stated by staff, and adding condition #5 that a shared access easement shall be provided between the two subject properties to ensure adequate cross access and parking, and subject to the other conditions. Commissioner Winston seconded the motion. The motion passed with a vote of 3- 0-0. LSP 07-2730: Lot Split (MURPHY OIL/FINGER ROAD, 558): Subdivision Committee September 27, 2007 Page 7 of 7 Motion: Commissioner Anthes made a motion to re -open LSP 07-2730 (Murphy Oil/Finger Road). Commissioner Winston seconded the motion. The motion passed with a vote of 3-0-0. Motion: Commissioner Anthes made a motion to approve LSP 07-2730 in favor of condition #1 as stated by staff and the other conditions, and adding condition #5 that a shared access easement shall be provided between the two subject properties to ensure adequate cross access and parking, and subject to the other conditions. Commissioner Winston seconded the motion. The motion passed with a vote of 3-0-0. All business being concluded, the meeting adjourned at 9.45 AM.
