A special meeting of the Fayetteville City Council was held on December 27, 2007 at 4:30 PM in
Room 326 of the City Administration Building located at 113 West Mountain Street,
Fayetteville, Arkansas.
Mayor Coody called the meeting to order.
PRESENT: Alderman Gray, Thiel, Cook, Allen, Ferrell, Lucas, Jordan, Mayor Coody,
City Attorney Kit Williams, City Clerk Sondra Smith, Staff, Press, and Audience
ABSENT: Alderman Rhoads
New Business:
Amend § 94.05 Sale and Use of Fireworks: An ordinance to amend § 94.05 Sale and Use of
Fireworks of the Fayetteville Code to allow First Night Fayetteville to set off a public fireworks
display near midnight of December 31St
City Attorney Kit Williams read the ordinance.
City Attorney Kit Williams: I saw in the paper this morning that the location of the fireworks
was going to be changed. It was my understanding that in the past it has been set off on
University property. Our regulations do not always extend to University property so they did not
have to comply with our fireworks ordinance. This year they are going to be set off on City
property and we do need to comply with our ordinances. There was not a provision to allow it so
Subsection G would allow the fireworks to be displayed by First Night Fayetteville on December
31. That is why we had to have a special meeting.
Alderman Ferrell moved to suspend the rules and go to the second reading. Alderman
Jordan seconded the motion. Upon roll call the motion passed 7-0. Alderman Rhoads was
absent.

City Attorney Kit Williams read the ordinance.
Alderman Jordan moved to suspend the rules and go to the third and final reading.
Alderman Ferrell seconded the motion. Upon roll call the motion passed 7-0. Alderman
Rhoads was absent.
City Attorney Kit Williams read the ordinance.
Alderman Thiel: Even though I support this the Police Department will probably get some calls
from some people that will be unhappy about the noise that late at night. It will be pretty
disruptive to this area of town. I am not quite sure why they decided to have it downtown. We
will see how this goes this year. On top of this hill that sound really carries.
Alderman Allen: Will we be able to fund this again next year?
City Attorney Kit Williams: It will continue as long as First Night Fayetteville will want to set
off fireworks on December 31. It is particular for that celebration.
Alderman Thiel: So this is permanent?
City Attorney Kit Williams: The next City Council or this City Council can change this in the
future by repealing Subsection G but it is permanent until that time.
Mayor Coody: They have different classifications of fireworks and the big ones, the huge ones
and loud ones will they be using those?
Tony Johnson, Fire Chief: They plan to use two inch mortar which is the small aerial. The
debris will be less and it will not be as loud of a noise as if they were using five to six inch
mortar.
Mayor Coody: So it will not be like July 4th with those really big fireworks. This will be more
subdued.
Tony Johnson, Fire Chief: That is correct.
Mayor Coody: So we will get fewer complaints maybe.
Mayor Coody asked shall the ordinance pass. Upon roll call the ordinance passed 7-0.
Alderman Rhoads was absent.
