THE BOARD OF SIGN APPEAL
A regular meeting of the Board of Sign Appeals was held on Monday, June 2, 2003 at
3:45 p.m. in Room 326 of the City Administration Building, 113 W. Mountain,
Fayetteville, Arkansas.

SNA 03-07.00: Sign Variance (Shake's, pp 252) was submitted by Matt Smith of MDH
Builders, Inc. on behalf of Shake's Frozen Custard, Inc. for property located at 2835 N.
College Avenue. The property is zoned C-2, Commercial Thoroughfare. One monument
sign has been approved for the restaurant. The request is for an additional monument sign
for the home office, which is on the same site and a roof sign for the restaurant displaying
the company's trademark.
Green:
We will now convene a meeting of the Board of Sign Appeals. The first
item on the agenda for the Board of Sign Appeals is consideration of the
minutes of the April 7, 2003 meeting. Are there any corrections or
additions to those minutes?
Andrews: I have one typo on page 7 3/4 of the way down on my statement. It should
say I went out there and try to figure where it was going to be placed.
Spell check didn't catch it, it is ok. Of all the boards I have been on these
are the best minutes that we ever get, the Board of Adjustment and the
Board of Sign Appeals so you are doing a good job.
Olszewski: Put that in the record.
Green: Are there any other corrections or additions? Hearing none, I will
consider the minutes approved with that modification.
Green: The first item of new business is a sign variance submitted for Shake's
submitted by Matt Smith. The request is for an additional monument sign,
which is the company's trade mark I believe. Dawn, can you give us some
background?
Warrick: I will be glad to. I will first ask if the Board wishes to go through these
items with no applicants present.
Kohler: I don't.
Nickle: Can we table this to the next meeting?
Warrick: That would be what we would have to do regardless. If the Board chooses
not to hear the items with no representation there will likely be questions
that I am not able to answer on these things for you. If you wish to wait
for July that is fine.
Kohler: If it is not important enough for an applicant to show up.
Andrews: There could be extenuating circumstances.

Whitaker: Past experience tells me that when dealing with signs you are going to
need to ask a lot of questions because every time I have seen one come
through there are at least one or two things that need to be clarified.
Alt: So typically the items are tabled?
Warrick: That has been common practice not to take action on an item without
representation and the ability to ask questions of the applicant.
Green: Ok, what is the Board's pleasure?
MOTION:
Andrews: I will move that we table this sign variance until the next meeting.
Green: Ok, is there a second?
Nickle: Second.
Green: There is a motion and a second to table. That means that there is no
further discussion. Can you call the roll please Renee?
Roll Call: Upon the completion of roll call the motion to table SNA 03-?? Was
approved by a vote of 7-0-0.
Green: That item is tabled until at least next month.

SNA 03-08.00: Sign Variance (Dixie Development, pp176) was submitted by Pam
Jones for Dixie Development for property located north of Old Missouri Blvd. and east of
Joyce Blvd. The property is zoned R -O, Residential Office. The request is for a 4' x 6'
directional sign within the confines of the Commerce Business Park. The requirement is
2' x 2' for a directional sign.
Green: There is one other item on the agenda.
MOTION:
Andrews: I will move that we table that variance until our next meeting.
Nickle: Second.
Green: There is a motion and a second to table item number two on the Board of
Sign Appeals agenda. Can you call the roll please?
Roll Call: Upon the completion of roll call the motion to table SNA 03-?? Was
approved by a vote of 7-0-0.
Green: Ok, is there any additional new business?
Olszewski: One other item. How many people do we have to have for a meeting?
Green: Four.
Olszewski: There is a good possibility that I will be gone in July.
Kunzelmann: I will also be gone.
Nickle: What is the date of the meeting?
Warrick: The first Monday, I will have to look to be sure.
Nickle: I will be here.
Warrick: We will have a quorum then, yes? Election for your Board is legislated by
your bylaws to begin in July.
Olszewski: You've been it for a year?
Green: It seems like forever to me.
Warrick: I will double check your bylaws but I believe that we will need to have an
election at the beginning of our next meeting to seek a chair.
