That the City Council of the City of Fayetteville, Arkansas hereby vacates portions of street and alley rights -of -way as described in Exhibit B attached to the Planning Department's memo. Section 2. A copy of this Ordinance duly certified by the City Clerk along with the map attached as Exhibit A to the Planning Department's memo shall be filed in the office of the Washington County Circuit Clerk. Section 3. This vacation approval is subject to the following conditions: 1. Existing utilities are required to be relocated and new easement dedicated as required by the franchise utilities prior to this vacation taking effect. 2. The property has excess platted right-of-way ROW on two sides, including: • 19' (approximately) of excess street right-of-way (ROW) along the West Avenue frontage. • 30' (approximately) of unused (formerly railroad) ROW on the west property boundary.
