MINUTES OF A MEETING OF
TECHNICAL PLAT REVIEW
A meeting of the Technical Plat Review Committee was held on Tuesday, November 5,
1996 at 9:00 a.m. in room 111 of the City Administration Building, 113 W. Mountain,
Fayetteville, Arkansas.

Item: PROPERTY LINE ADJUSTMENT FOR MICHAEL MITCHELL
The first item on the agenda was submitted by Michael Mitchell for property located north of
Cato Springs Rd. And west of Cline Ave. The property is zoned R-1 and contains approximately
2.77 acres.

Ms. Warrick questioned if Tract B was as shown on the plat already a seperately deeded tract of
land.
Mr. Mitchell's understanding was, from his realtor,that everything was completed. The survey
had been made and all was left was the approval of the property line adjustment. He was
assuming the realtor had completed all the paper work.

Other requirements: August 28, 1995 a lot split for this property was requested. As a condition
of creating the tract of land which is affected by this property line adjustment request, the
applicant was required to dedicate an additional 10' of right-of-way for Cato Springs Road by
warrnaty deed. The lot split was never filed and the warranty deed never drafted. Since this
request is in essence creating the same tract of land, the same condition applies.

channel.
Mr. Mitchell questioned if it needed to be an easement.
Mr. Beavers replied it did not have to be defined. The City just needed a right to access the
property to get to the channel.
Mr. Mitchell stated that he would agree to it.

there would be any problems with the access and the overhead lines. He questioned the use of

The next item on the agenda was submitted by Milhalland Engineering on behalf of Fadil
Bayyari for property located north of Hwy 16 E and 1.5 miles east of Hwy 265. The property is
zoned RS, Residential Small Lot, and R -O, Residential Office, and contains approximately 15.14
acres with 63 units proposed.

Requested an easement between lots 75 and 76.
Mr. Petrie questioned if they could use the easement between lots 76 and 77.
Mr. Phipps stated the site droped off to steeply and they would not be able to use the easement.
He would need a 16' easement between lots 75 and 76. He would also need an easement
between lots 79 and 80. He also requested the 25' setback also be stated as a utility easement
along the front. Presently they only had a 10' easement.
Mr. Petrie commented that the City did not care for the utitiy easements to be the entire setback.
Mr. Beavers stated that Engineering fully supported that the setback also be a utility easement.
Mr. Phipps stated they would need to be able to get to the front of the lots. They could not drop
off the back of the hill, they would need to use the front as much as possible.
Ms. Warrick understood four trees were to be planted per lot, but it was not reflected in the
covenants.
Mr. Phipps commented the north edge of the property really droped off into the flood plain and
those lots would have to be filled to make them buildable. If he was to set his tranformer now
they might be covered up. It would be the developers expense to relocate them in that situation.
SW Bell- Andy Calloway -442-3170
Asked them to consider placing arrowheads, easements seemed to run together and it was hard to
determin which line they talking about. On the northeast corner, lot 77, he questioned where the
centerline of the easement was referenced. He was unclear where the easement was.
Mr. Petrie replied it was an existing easement before they divided it.
Mr. Calloway stated they needed to clearly define the easements. On the west side, lot 82, it
looked like an 8' utility easement off that lot but the off site was not dimensioned and it did not
scale out to meet across the street, it needed to be at least 12' to give them a full 20'. He added
the offsite easements had not been filed. He would not be able to sign the final plat until they
were shown on this plat.
Mr. Beavers added lots 77 and 78 required individual grading plans because of the flood plain
and a note needed to be added to the plat reflecting this requirement.

Item: LARGE SCALE DEVELOPMENT FOR WAL-MART SUPERCENTER
The next item on the agenda was submitted by CEI Engineering for property located at the
southwest corner of Mall Lane Road and Joyce Street. The property is zoned C-2, Throughfare
Commerical, and contains approximately 24.94 acres.
The item was represented by Mandy Bunch and Cindy Girelli

Sidewalks: a 5' sidwalk with an 8' greenspace between the curb and sidewalk already exist along
Joyce Blvd. The 5' sidewalk with an 8' greenspace should also be built along Mall Lane Road;
even though it is shown as a private street.

Ms. Bunch stated they would not show the sidewalk; it would have to be a Planning Commission
requirement, because the City ordinance did not require it since it was not a public street.

Comments: Some isle widths for van accessible spaces are not adequate.
Ms. Bunch questioned if they would be required to have street lights every 300' because they
would have a lot of light on site.
Mr. Franklin responded if she could provide photometerics to show spill over into the street.
Ms. Bunch replied she could provide the drawing.

173 to title block, only one building setback is shown- show all. And show area in floodplain on
plat.
Proposed & Existing Street rights of way and easements: Right of way on Joyce Blvd needs to
total 110' (55' from centerline) to comply with new street standards passed 9/17/96. Note on plat
"Clary Development to construct private street Mall Lane prior to development" will not be
enforced by City but may hold up issuance of building permit for this project.
Subdivision of Land: City offices have no record of this phase of Spring Park Subdivision being
filed of record. Currently researching this issue and need additional information. No as-builts on
file in Engineering Deptment for this lot including easements and utilities.
Site Specific Information: Parking requirements- seem to have problems with accessible spaces,
90 degree spaces adjacent to Mall Lane back directly into major through traffic lane, entrance is
off -center from main aisle, access here seems confined, and no pedestrian access from farther
parts of parking lot to the building- can this be provided?
Other requirements: Need diskette, note on plat that no free standing sign will be permitted (sign
will be allowed on combination sign for the subdivision). If overhead lines on west side of site
are relocated new lines must be placed underground as per new ordinance #3997 (10-1-96).

Ms. Girelli explained they were set up in private escrow accounts that they would be built before
opened, because it was required by Wal-Mart and it would be required that they build it befor e
they open the store.

General: All improvements shall meet the City's latest criteria.
Mr. Beavers is confused concerning the Spring Creek Center and the Spring Park Subdivision
status. Engineering does not have records of final plats or water and sewer mains which are
shown on proposed final plats. This needs to be clarified or could result in delaying your project.
Differences in lot sizes and water and sewer from sheet 2 (DCI survey) and the rest of the
drawings.
Water -Preliminary: final design subject to additional review. The water line shall be looped as
shown on Clary's surveys and plats. This additional feed will be beneficial to Wal -mart's fire
protection and is a requirement for the properties to the east. The 8" water main east of the
proposed Wal -mart site was shown on proposed plates by Clary including sheet 2 of 5. Fire
protection shall meet the Fire Chief's request. Minimum easement widths shall be 20'. Change
plan note (sheet 4), the existing water line at the south is 36" CPP not 48". No taps will be
allowed to this line.
Sewer -Preliminary: Final design subject to additional review. Minimum easement widths (or
combination of easements and ROW) shall be 20' and wider for sewer lines over 10' in depth.
The easement for the water and sewer in front of the store is subject to further review based upon
final design. No records (construction plans or as-builts) that the existing manhole you propose
to tie into exists. A Field check by our inspectors did not locate this manhole.
Preliminary Grading: The exact requirements for the drainage swale on the west na dthe
proposed easement form the neighboring property will probably not be resolved prior to the
Planning Commission Meeting This will not hold up the approval process but will be a
condition of your final design and construction submittal. Please note that improvments,
including the swale on the west, shown on the LSD are not approved. All improvements are
subject to additional review and final design. Has the 100 year flow WSE in the swale along the
west? Mr. Beavers agreed with the report that a detention pond was not required. He questioned
how the concentrated flows from the parking lot drainage system effect the downhill neighboring
property? How would this flow get to Mud Creek ( a few hundred feet away)? Are the electric
lines to be relocated for the improved swale? The parking lot drainage will be privately

mainatained and a letter agreement from the owner will be required.
Preliminary Drainage:
Street -Preliminary: Must comply with the City's current Street Standards as approved by the
Council 6 August 96. Are contributions from Wal-Mart required for off-site improvements
including Joyce Street?
Comments:
Ms. Bunch stated they would be having a meeting with Clary next week and they would be
discussing the proposed utilities.
Mr. Beaver commented that the proposed water loop was planned to help feed the fire protection
for National Home Center. The City was going to request if not require that the line be built and
looped into Wal -mart.
Ms. Bunch commented that the water line had been eliminated, it had been shown as a proposed
line. She questioned the direction National was fed from.
Mr. Beavers replied they were fed from the east. He questioned if the 8" existing.
Ms. Bunch did not know, but added they had an updated survey that should clarify the issues.
Mr. Beavers did not have a final plat that showed lot 4 or their lot.
Ms. Bunch stated that all the lots had been reconfigured.
Mr. Beavers stated the master plan for Clary was a loop for fire protection and they were going to
require that it be provided.
Mr. Jackson stated that as the project was being developed as it filled up the lines would be
extended and the loop would be completed. They had a tremendous fire flow demand in the
project.
Mr. Beavers questioned why they were showning the detention pond.
Ms. Bunch Reponded they would clean up the area, they would grade less of the area It would
not detain as it was shown because the outlet pipe is as large as the inlet flow.
Mr. Beavers questioned the berm.
Ms. Bunch commented it was left from another development, but it worked well with what they
had shown because it worked as a screen from the street traffic.
Mr. Lane questioned if more than 85% of the site was covered with nonpermiable surfaces.
Mr. Beavers cautioned if they were to regrade the swale and if they had to relocate the existing
lines they would have to be placed underground.
Ms. Girelli Stated they did not plan on have to move the lines.
UTILITIES
SWEPCO- Dennis Burrack-973-2308
Stated there was an existing overhead line, which they would like to see it remain an overhead
line. The technology would not allow them to place it underground and make it a single circuit.
They would have to make it a parrellel circuit which would be very expensive they would be
looking at $250 and $300 per foot to place the lines underground. If they made the decision to
place the lines underground they would have to have a lead time of six to nine months. The
existing circuit was intended to complete a loop feed in be able to feed from both Springdale and

Fayetteville substations into this area. There was existing facilities, they would come off
existing poles. They would need 4" conduit or concrete pad. They had sent all the studies in
already. He questioned if they had recieved the studies.
Ms. Bunch replied they did not receive the entire package, but they did not see any problem with
what they dealt with as far as load information.
Mr. Burrack questioned if they had discussed temporary power or were they going to use the unit
substation put inside as temperary fill.
Ms. Girelli stated she did not know, but could find out.
Mr. Burrack commented they were working questions and might effect grading. There would be
a minimum of 24" but they would prefer 36" of coverage for the under ground equipment. They
would require one conduit but would prefer two, in case one faulted in the middle. All other
existing easements were fine.
SW Bell- Andy Calloway -442-3170
No comments. As a point of information not concerning this application he expressed
difficulting in working with the other Wal -mart stores. He asked them to specificaly locate
where they would like the phones located inside the building.
• Refering to the Clary development he could not locate a final plat that had been filed. The plats
needed to be clarified.
Ms. Warrick added it was a real problem they could not find how they had been filed, she did not
believe they had ever recieved a mylar. If they had it would have distributed to the utility
companies. She showed the final plat that they used when Wal -mart purchased the lot.
Mr. Calloway added it had been done before Service Merchandise had gone in and he believed it
had been replated since then. He believed they had combined a couple of lots and abandoned a
bunch of easements. He thought there was another plat that was not finalised and filed.
Ms. Bunch stated they would try and resolve the issues with Clary next week.
Ms. Warrick asked them to convey the information to the City.

Easements shown were fine. If any of the existing lines had to be readjusted to grade would be at
the owners expense.
Ms. Girelli questioned how much it would run, because they would have a portion that would
need to lowered.
Mr. Evan stated it would run between $5-7 per foot. They would like the meters located on the
west side of the building for visual purposes. They would like to come in on the backside of the
project with gas service.

The item was submitted by University Baptist Church for property located west of Shady Lane

The item was submitted by Bill Meadows for property located east of Dead Horse Mountain

These items were presented for discussion by the utility companies. There was no discussion on
