MINUTES OF A MEETING OF
TECHNICAL PLAT REVIEW
A meeting of the Technical Plat Review Committee was held on Tuesday, May 21, 1996 at 9:00 a.m. in room
111 of the City Administration Building, 113 W. Mountain, Fayetteville, Arkansas.

PROPERTY LINE ADJUSTMENT - CHASE MILLER
LOT 4 & 5 BERL DODD - N OF 15TH, E OF COLLEGE
The first item on the agenda was the property line adjustment submitted by Chase Miller for property located at lots
4 & 5 of Berl Dodd subdivision, north of 15th Street and east of College Ave. The property is zoned R-2 and
contains approximately 0.37 acres.
Ms. Little stated she had no substantive comments from city staff, requested a better legal description and instructed
the applicant to contact Justus Harris regarding same. She asked that the survey plat reflect plat page 563 and she
further requested a vicinity map.
Mr. Beavers had no comments on water and sewer services.
Mr. Burrack, SWEPCO, had no comments.
Mr. Evans, Arkansas Western Gas, had no comments.
Mr. Calloway, Southwestern Bell, had no comments.
Ms. Little stated this request could be approved administratively after receipt of revised plats.
Mr. Miller stated the property was being adjusted to facilitate the sale of property which is currently zoned R-2 for
construction of duplexes as rental property.

LOT SPLIT - DAVID FERGUSON
NW ENGINEERS - 2892 HUNTSVILLE
The next item on the agenda was the lot split request for Preston Ferguson submitted by Northwest Engineers for
property located at 2892 Huntsville Road, north of Huntsville, east of Stonebridge. The property is zoned C-2. The
request is for a total of two lots.
Ms. Little requested that plat page 528 be added to the title block. She requested that the easement widths be
shown. Further, she stated improvement to Stonebridge would include curb and gutter and a 5' sidewalk which
would be guaranteed in the form of a deed restriction. Discussion ensued regarding deferring construction of the
sidewalk and Ms. Little stated that the sidewalk on Highway 16 would have to be constructed but construction of
the sidewalk along Stonebridge might be delayed. At Mr. Ferguson's request, Ms. Little suggested deed restriction
wording to the effect that no further lot splits would be granted until the improvements to the road and sidewalk
were completed by the developer. Further, she requested that the applicant contact Mr. Charles Rutherford
regarding the sidewalk construction.
Fire Chief Mickey Jackson's comments included a concern regarding hydrant location and he requested that a
hydrant be installed at one of the entrances.
Ms. Little requested 50' right-of-way along Highway 16. Discussion ensued regarding the parking area aisle width
and the effect the additional right-of-way would have on same. Ms. Little noted that the adjoining lot which had
been cleared was a portion of this property.
She requested that the zoning of the adjoining properties be reflected on the plat.
Mr. Beaver's in house review comments noted that private sewer cannot cross property lines and he requested the
private lift station be brought up to standard. Mr. Harris stated he had contacted Mr. Beavers regarding that and
they had agreed to show it as a private easement. Mr. Beavers stated that since it was existing they would work it
out.
Mr. Calloway with Southwestern Bell stated he had a dedicated SWB easement adjacent to the right-of-way. He
requested a 20' perimeter easement. Ms. Little stated that only underground facilities would be allowed in the
perimeter easements. Further, she stated that no landscaping in the 25' setback would be allowed.
Mr. Evans with Arkansas Westem Gas requested a 25' easement along the front of the property as well as a general
utility easement along the westem property line.
Ms. Little requested 10' additional right of way for Highway 16 and then the easement dedication parallel to the
right-of-way..

LOT SPLIT - CARTER AND MATTHEWS
1898 HUNTER'S RIDGE
The next item on the agenda was the lot split request for Mike Carter and Hank Matthews submitted by Dennis
Moore for property located at 1898 Hunter's Ridge, south of Mission, east of Crossover. The property is zoned C-2
and contains approximately 1.04 acres. The request is for a total of two lots.
Ms. Little requested that the survey reflect the location of Hunter's Ridge dimensioned from the centerline. She
requested the utility easements be dimensioned as well. Discussion ensued regarding the various locations of the
utilities. Mr. Moore stated water was on the west and sewer was on the east. Mr. Beavers suggested that Mr. Moore
obtain an as -built either from Mr. Jorgensen or the courthouse.
Ms. Little requested a better vicinity map. She also requested that plat page 372 be added to title block. Ms. Little
requested that staff double check to see if Hunter's Ridge had curb and gutter. Ms. Little stated the applicant should
contact Charles Rutherford regarding the sidewalks.
Mr. Lane inquired if there would be a shared parking agreement and Mr. Moore indicated that there would be one
after describing the adjustments to the parking lot to accommodate the split.
Discussion ensued regarding removal of trees in the parking lot.
Mr. Calloway with Southwestem Bell requested a 20' perimeter easement. Ms. Little stated that any facilities in the
perimeter easements would need to be underground. Intense discussion ensued regarding the location of SWB
facilities.
Mr. Evans with Arkansas Western Gas requested an easement along one side. Discussion ensued. Ms. Little stated
that any off site easements needed to be shown on the plat.
Intense discussion ensued regarding dedication of a perimeter easement. Mr. Calloway stated he would meet with
the applicant to determine whether or not the perimeter easement would be necessary. Mr. Beavers requested a
letter regarding the Mr. Calloway's acceptance of an off site easement.
Ms. Little requested that Ms. Thomas draft a letter regarding survey requirements to all the area land surveyors. She
stated revised plats were due 9:00 on Tuesday, May 28 and that the Subdivision Commission would consider the
request on Thursday, May 30.

LOT SPLIT - WILLIAM AND DELORES COOK
2710 COLLETTE
The next item on the agenda was the lot split for Williams and Delores Cook submitted by Dub Dunaway for
property located at 2710 Colette, south of Old Wire and west of Azalea Terrace. The property is zoned R-1 and
contains approximately 0.39 acres.
Ms. Little stated that there was no sidewalk in the area and she was not sure whether or not a sidewalk would be
required. She referred the applicant to Charles Rutherford for that determination.
Regarding Colette, Ms. Little noted it did not connect and it was not a standard city street. She stated this matter
would be addressed by the Planning Commission and a determination made at that meeting.
Ms. Little requested that plat page 293 be added to the title block. Ms. Little requested 4' sidewalks along Yvonne.
Mr. Burrack with SWEPCO stated he had overhead utilities along the front property line with the 2710 being fed
from a pole at the northwest going across proposed lot 3 to the north. He stated this would have to be rearranged.
Mr. Burrack requested 10' easement on Colette. Mr. Burrack inquired regarding additional street lights and Ms.
Little,requested that Ms. Thomas contact Mr. Franklin regarding same.
Discussion ensued regarding the location of a manhole and Mr. Beavers stated it was his opinion that the manhole
was further east.
Mr. Calloway with Southwestern Bell requested a 15' easement along the east.
Mr. Evans with Arkansas Western Gas stated the easements as requested above were fine.
Mr. Lefler with TCA had no comments.
Ms. Little requested a vicinity map.
Ms. Dugwyler requested park fees in the amount of $300.
Ms. Little requested 37 revised copies by 9:00 a.m. on Tuesday, May 28.

FINAL PLAT - PINE VALLEY, PH IV
BMP DEVELOPMENT - S OF MT COMFORT, W OF SHILOH
The next item on the agenda was the final plat for Pine Valley, Phase IV submitted by Kurt Jones, Northwest
Engineers, on behalf of BMP Development for property located south of Mt. Comfort and west of Shiloh Dr. The
property is zoned R-2 and contains approximately 3.05 acres with 8 proposed lots.
Mr. Jones stated he would amend the plat to reflect the street names as directed by Mr. Johnson.
Discussion ensued regarding the construction of the sidewalks and Mr. Jones stated those would be constructed at
the time the houses were constructed.
Discussion ensued regarding the location of utilities. Mr. Jones stated he would contact Don Roberts regarding the
locations of lines under the sidewalk.
Mr. Beavers recommended that the punch list items for the other phases be taken care of in conjunction with this
plat. He instructed that no final inspection would be made on Phase II until those punch list items were in place and
the manhole issue resolved.
Ms. Little stated there was an off site bridge contribution of $480 per duplex and an off site sewer improvement
assessment of $200 per lot.
Ms. Little requested that the water and sewer lines be shown including location and the size of the line.
Discussion ensued regarding the diskette submitted with the plat file.
Ms. Little requested that drainage easements be shown and Mr. Jones responded there was only one as shown.
Ms. Little requested the plat reflect that lots 67, 68, and 69 would require individual drainage permits.
Ms. Little requested a copy of the protective covenants and Mr. Jones stated he would provide those with revised
plats on Tuesday, May 28.
Ms. Little requested that all setbacks be shown. She requested a hydrant icon be reflected in the legend and plat
page 362 be reflected in the title block. She requested a name for street "a" and she stated a street light should be
shown on street "a" as well as a hydrant on Marigold.
Ms. Dugwyler stated the park land dedication had been satisfied for all phases and she requested that the access
easement be reflected on the park land plat. Discussion ensued.
Ms. Sandeen stated she had supplied the applicant with a comment sheet.
Mr. Calloway requested that the off site easement be shown on the plat.
Ms. Little requested that the flood plain be labeled.
Mr. Phipps requested a 4" conduit crossing at a depth of 42" from the northeast corner of lot 72 to the northwest
comer of lot 73. Mr. Jones stated they had installed quad crossings at all locations.

FINAL PLAT - YORKTOWNE SQUARE, PH II
WADE AND PEGGY BISHOP - N OF STUBBLEFIELD W OF OLD MISSOURI
The next item on the agenda was the final plat for Yorktowne Square, Phase I1 submitted by Milholland
Engineering on behalf of Wade and Peggy Bishop for property located north of Stubblefield Road and west of Old
Missouri Road. The property is zoned R-1 and contains approximately 10.74 acres.
Ms. Little requested a corrected legal description and instructed the developer to check with Mr. Harris regarding
same. She also requested a street light be reflected as approved at preliminary plat. She noted that the final
inspection issues be resolved.
Discussion ensued regarding the relocation of a sidewalk to miss a large tree which subsequently was removed. Ms.
Little stated that there were 2 options. She stated the sidewalk could be reconstructed or substantial replacement
planting. Discussion ensued regarding and Ms. Little requested that the applicant contact Ms. Sandeen.
Ms. Little stated that the drainage swale was not completed and same needed additional work. She stated there was
an off site assessment for improvements to Stubblefield Road which would be a condition of approval. Ms. Little
requested that a sign off block be provided for Ms. Sandeen.
Mr. Burrack with SWEPCO requested resolution of the street light at the entrance.
Mr: Calloway with Southwestern Bell requested the building setback along Stubblefield Road also be reflected as an
utility easement.. He requested clarification of the crossing at lot 53 and 54. At lot 56, he requested 10' utility
easement on either side of the lot line. Discussion ensued regarding the off site easements at lot 63 and 35. Ms.
Little requested a separate instrument for that dedication. At lots 34 and 35, Mr. Calloway requested a minimum
easement dedication of 20'. Between Tots 10 and 34, Mr. Calloway requested a minimum 20' easement. Mr.
Calloway noted a conflict between existing lot 7 and lot 36.
Mr. Phipps with Ozarks Electric stated he had two lots in this phase and the easements and crossing as shown were
fine.
Ms. Little requested a copy of the protective covenants.
Ms. Dugwyler stated parks fee were in the amount of $9,300 for 31 units.
Mr. Lefler with TCA Cable requested a crossing at lot 35 and 63.
Mr. Evans with Arkansas Western Bell requested the same crossing as Southwestern Bell.
Ms. Little requested the sidewalk and tree issues be resolved with Ms. Sandeen and Mr. Beavers prior to Tuesday,
May 28.

FINAL PLAT - MAGNOLIA CROSSING
ALAN WALKER - N OF HWY 62 W OF DINSMORE TRAIL
The next item on the agenda was final plat for Magnolia Crossing submitted by Northwest Engineers on behalf of
Alan Walker for property located north of Highway 62 and west of Dinsmore Trail. The property is zoned R-2 and
contains approximately 36.58 acres.
Ms. Little stated the final inspection had been scheduled for June 6, 1996. She expressed concern regarding the
completion of the bridge.
Ms. Little stated Mr. Johnson had a question regarding the location of Cottonwood Street. Ms. Little instructed the
street names issues should be resolved immediately.
Ms. Dugwyler noted that the number of lots had changed since acceptance by the Parks Board. She stated the
duplex lots should be noted on the plat and the amount of park fees was $41,460 based on 107 single family units
and 39 duplexes. Ms. Harris agreed to verify the number the number of lots.
Mr. Burrack stated the applicant should resolved the street light issue with Mr. Franklin and let him know what
would be required. He requested that the easements be dimensioned and labeled. Discussion ensued and Mr.
Burrack stated they would work out the easements. He stated he would serve overhead from the east with multi
phase. Mr. Harris stated the swale would not create any significant changes to the easements. Discussion ensued.
Mr. Burrack stated he would need easements to the street lights and Mr. Harris agreed to provide same.
Intense discussion ensued regarding underground utilities. Ms. Little stated consideration was being given to
requiring all lines 33kv and less be underground.
Mr. Calloway with Southwestern Bell requested the 20' easements between lots 1 and 2, between lots 5 and 6, and
between lots 10 and 11. He requested a 20' easements along the south property line. He requested a 20' easement
between lots 14 and 15. He requested that the plat show a clear 20' easement between lot 78 and 79. He requested
20' easement on the north side property line. He requested a 20' easement along the south side of Cottonwood and
he requested the building setback also be shown as a utility easement. He requested the easement at the west side of
lot 1 be designated an as- setback and utility easement. He requested an easement on either side of Camilla and
along Highway 62.
Mr. Leflar with TCA Cable requested crossings from lot 46 to 39 and lot 34 to 29. He noted the plat reflected
crossing but no easements. He requested a crossing between 52 and 53.

Mr. Evans with Arkansas Western Gas requested the same easements as Southwestern Bell. He requested that the
central 100' easement show the location of gas line. Mr. Evans noted that there were houses at the north of this
property which have private lines extending from the main line. He stated they would not move those lines until
this subdivision is piped. Discussion ensued and Ms. Little requested that the private line issues be resolved and she
requested that Mr. Evans notify the Planning Office. She stated no permits would be issued for lots 75 through 82
until that matter is resolved. Discussion ensued.
Ms. Little requested a table or noted indicating that the following lots would required individual grading plans: Tots
43 through 51, lots 8 through 14, lots 52 through 71, lots 80 through 83, lot 15, 98, 99, 114, 115, 130, 131, and 146.
Discussion ensued.
Ms. Little requested that the drainage easement from lot 180 running south be labeled. She stated that off site
bridge assessment was in the amount of $36,040 which is 68% of $53,000.
Mr. Beavers requested the plat reflect a note that no fences be allowed around the drainage swale and the passage.
Ms. Little requested that plat page 566 be added to the title block.
Mr. Burrack stated the offside easement on the east and west sides were purchased easements.

LARGE SCALE DEVELOPMENT - ELKHART PRODUCTS
NORTHWEST ENGINEERS - N OF SUNRISE MOUNTAIN, W OF HWY 71
The next item on the agenda was the large scale development for Elkhart Products submitted by Northwest
Engineers for property located north of Sunrise Mountain Road and west of Highway 71. The property is zoned I-1
and contains approximately 24.6 acres.
Ms. Little requested proof of notification. She requested the subject plat reflect 6" sewer lines. Mr. Jones stated
those were private.
Ms. Sandeen stated she would provide a fee waiver form.
Ms. Little requested that the adjoining zoning districts be shown. She requested the dimension of Highway 71 from
the centerline as well as the access road. She requested that Mr. Jones contact Charles Rutherford regarding
sidewalk placement in lieu of the existing asphalt walk. Discussion ensued.
Ms. Little requested that all easements be shown and that a sidewalk icon be included in the legend.
Mr. Burrack stated they would serve underground and he requested the necessary conduit and pads.
Mr. Calloway with Southwestern Bell requested the off site easement along the north property line be shown.
Discussion ensued and Mr. Jones stated he would coordinate with Mr. Calloway.
Mr. Evans with Arkansas Westem Gas stated he would work with the developer's engineer.
Mr. Jackson inquired if the building would be sprinklered and Mr. Jones stated that it would.

LARGE SCALE DEVELOPMENT - HANK'S FINE FURNITURE
13 & F ADVERTISING - N OF WEDINGTON, E OF HWY 71
The next item on the agenda was the large scale development for Hank's Fine Furniture submitted by Development
Consultant, Inc. on behalf of B & F Advertising, Inc., for property located north of Wedington and east of Highway
71. The property is zoned C-1 and contains approximately 2.0 acres. The subject tract is within the overlay district.
Ms. Little requested that the street be extended to the north with curb, gutter, and sidewalk. She requested the
applicant contact Mr. Franklin regarding the light at the entrance of the development. She inquired as to the path
trucks would use to get to the loading docks. Discussion ensued regarding the entrance and approach to the dock.
Mr. Brian Ray, Development Consultants, stated the hatched area was a landscaped dumpster area and Ms. Little
requested that he contact Cheryl Zotti, Solid Waste. Further, she requested the dock be labeled on the plat and
suggested it be moved.
Ms. Little noted the city would cost share the sewer extension improvements. She requested all easements and
rights-of-way be dimensioned on the plat.
Mr. Ray pointed out there was only one easement on the property. He also noted they would be giving an additional
10 feet of right-of-way along the roadway.
In response to a question from Ms. Little, Mr. Ray stated the building would be sprinklered. Ms. Little requested
the plat page be shown on the plat and sidewalk be included the legend. She advised landscaping was required and,
since the property was within the overlay district, 25 percent had to be in open space and 80 percent of the open
space had to be landscaped. She noted zoning of the adjacent property also needed to be shown on the plat. She
explained that, depending of the adjacent zoning, screening could be required. She reviewed the screening
requirements.
Mr. Ray asked if the replacement trees could be used for screening.
Ms. Little advised he would need to work with Beth Sandeen, Landscape Administrator regarding both the
landscaping and screening. She also requested the building setbacks be shown on the plat together with easement
widths and dimensions from the centerline of the highway. She advised a monument sign elevation would be
necessary which included the scaled drawings of the signage on the side of the building and a screening elevation.
She reminded him of the public notification requirement.

Beth Sandeen, Landscape Administrator, advised there was a rare tree on the site. She informed Mr. Ray she would
need to discuss the matter with him.
Mr. Dennis Burrack, SWEPCO, noted the 35 -foot light poles would be served from the interior of the building. He
advised there was overhead electric going down Futrall which was single phase. He stated the developer was
required to give the conduit, pad for transformer, etc. He informed Mr. Ray he might need an easement from the
entrance of the building to the entrance of the development for a street light.
Andy Calloway, Southwestern Bell Telephone, advised he would need a 20 -foot utility easement along the east side
of the property, adjacent to Futrall Drive; a 10 -foot utility easement along the north property line and a 15 -foot
easement along the south and west sides of the property.
Mr. Leflar, TCA Cable, advised that, if they planned to have cable television, they would need to provide conduit.
Mr. Rick Evans, Arkansas Western Gas, advised he also would need the 20 -foot easement along Futrall Drive. He
noted they had a 10 -inch line running through the subject property and requested that, before any excavation, they
contact the Gas Company. He further stated any relocation of line would be at the developer's expense.
Ms. Little advised the legal description would not close so they would need to work on the legal.

LARGE SCALE DEVELOPMENT - RABEN MEDICAL BUILDING
CYRIL A. RABEN - 350 MILLSAP ROAD (N OF MILLSAP, W OF COLLEGE)
The next item was a large scale development for the Raben Medical Building submitted by Perry Butcher and
Associates on behalf of Cyril A. Raben for property located north of Millsap, west of College (350 Millsap Road).
The property is zoned C-2, Thoroughfare Commercial, and contains 1.4 acres.
Mr. Elliot Neel, Perry Butcher and Associates, presented a deed for the drainage easement.
Ms. Little stated it was her understanding McClelland Engineering was working on the elevation for the I00 -year
flood plain. In response to a question from Ms. Little, Mr. Neel advised he hoped to have that information prior to
the Subdivision Committee meeting.
Ms. Little explained that, if the building placement was affected, it would affect the large scale development. She
advised there should be no trees on or near water and sewer mains. She requested the following items be added to
the plat: the plat page number in the title block; the dimension of the right-of-way of Millsap Road from the
centerline; 30 feet of right-of-way along Millsap; and the 5 -foot sidewalk be added to the legend. She also noted the
parking ordinance allowed 25 parking spaces and, since more than 25 spaces were being shown, the applicant would
have to file a written request for a waiver. She also requested the zoning of the adjacent property be shown on the
plat. She stated the width of all easements needed to be shown.
Mr. Neel pointed out there was an easement per the survey which did not have parallel sides. He advised he had
shown a distance on one side and an angle on the other side. -
Ms. Little stated they had discussed joint access to the Brewer Building which would have to be located midway on
the subject lot due to trees and power poles. She stated the City wanted a 24 -foot wide drive through to the adjacent
property. She also reviewed notification requirements.
Mr. Dennis Burrack, SWEPCO, stated the existing light poles were owned by Brewer. He advised the site was
served underground. He stated the easements as shown were fine. He further noted that, if the right-of-way of
Millsap was increased, it would affect the utility easement along the front of the subject site. He stated he would be
willing to give up that portion of the easement which would go into the right-of-way.
Mr. Andy Calloway, Southwestern Bell Telephone, stated he had no comments on the easements but would need to
work with the developer on the placement of conduit to the building.
Mr. Leflar, TCA Cable, advised that, if they were going to have cable television, they would need to place the
conduit.
Mr. Rick Evans, Arkansas Western Gas, stated the easements shown were fine. He advised he would need to know
the gas load at the building.

LARGE SCALE DEVELOPMENT - BARBARA'S GARDENS
RANDALL WEBB - S OF SUNBRIDGE DR., E OF GREGG
The next item was a large scale development for Barbara's Gardens submitted by Jorgensen & Associates on behalf
of Randall Webb for property located south of Sunbridge Drive and east of Gregg Avenue. The property is zoned
R -O, Residential Office, and contains approximately 2.79 acres. A conditional use permit has been approved for the
location of a plant nursery on the subject tract.
Ms. Little requested the plat page number be shown in the title block of the plat. She also advised landscaping in
the parking lot would need to be shown on the plat together with the square footage of the retail area. She noted the
five foot sidewalk needed to be added to the legend. She requested they contact Cheryl Zotti, Solid Waste,
regarding location of the dumpster. She further noted the drainage easement needed to be extended to the creek.
Mr. Dennis Burrack, SWEPCO, stated they were in the process of putting in conduit for underground facilities for
the entire subdivision. He advised service for the subject project would come from the northwest corner. He
requested the off-site easement to the north be shown on the plat together with a 10 -foot easement on the west side.
Mr. Andy Calloway, Southwestern Bell Telephone, agreed he wanted the off-site easements shown on the plat
together with the adjacent lot lines.
Mr. Kevin Leflar, TCA Cable, had no comments.
Mr. Rick Evans, Arkansas Western Gas, also requested the off-site easements be shown on the plat.
Ms. Beth Sandeen, Landscape Administrator, requested the developer meet with her on the parking lot.

CONCURRENT PLAT - GLENWOOD SHOPPING CENTER
DON COZART & KEITH CEARLEY - SOUTHEAST CORNER OF HWYS 45 & 265
The next item was a concurrent plat for Glenwood Shopping Center submitted by Kurt Jones, Northwest Engineers,
on behalf of Don Cozart and Keith Cearley for property located at the southeast comer of Highways 45 and 265.
The property is zoned C-2, Thoroughfare Commercial, and contains approximately 14.74 acres.
Ms. Little gave Mr. Jones comments from the Traffic Department. She asked if the right-of-way shown on the plat
for Highway 265 was correct. She stated there needed to be 50 feet from the centerline. She advised Mr. Jones the
Highway Department did have plans for the widening of Highway 265.
Ms. Little explained to the utility representatives the subject tract had originally been reviewed as a large scale
development in 1994. She stated the same tract was now being split into two pieces and then, the two pieces would
be split into four tracts each (which would come back before the Plat Review Committee). She pointed out the
second entryway to the south had originally gone straight but now angled.
She further advised staff had originally told the engineer to base the drainage and grading off the plat which had
already been approved. She stated that, once the entryway had to be changed, the drainage and grading plan would
have to be from the new plat.
Mr. Jones explained the concurrent plat was basically a lot split; that CEI would be submitting a large scale
development on the tract. He stated Northwest Engineers was only handling the lot split.
In response to a question from Jim Beavers, City Engineering, Don Cozart stated the large scale development would
be for the entire tract. He went on to say CEI did have the drainage and grading plan, tree preservation plan, etc.
based on the new plat.
Ms. Little stated staff had requested a single contact person for the project and Don Cozart was the contact person.
She reviewed the items which needed to be shown on the plat: the plat page number; the legal descriptions for block
1 and block 2; a 5 -foot sidewalk to be shown along Highway 265 and Highway 45 (which the owner may defer to
the large scale development). She also reviewed notification requirements. She reviewed the code regarding
drainage plans and informed the developer the grading and drainage plan would be necessary for the large scale
development approval.
Mr. Beavers advised CEI would need to submit a drainage plan showing a detention area was not needed; that the
drainage could not flow over other properties.
Mr. Andy Calloway, Southwestern Bell Telephone, advised the retaining wall along the east side of the property
eliminated the use of the existing off-site easement. He also pointed out the developer needed to decide how he
wanted service to the buildings since they were totally surrounded by concrete and asphalt.
Mr. Kevin Lefler, TCA Cable, also noted he would need conduit under the concrete if they wanted cable television.
Mr. Rick Evans, Arkansas Westem Gas, agreed with Mr. Calloway that the retaining wall would eliminate the use
of the existing off-site easement. He also noted that, if any of his lines needed to be moved, it would be at the
developer's expense.
Ms. Little noted there was an existing tree preservation plan on the subject site.

PRELIMINARY PLAT - ZION VALLEY (A PLANNED UNIT DEVELOPMENT)
ZION VALLEY L.L.C. - S OF ZION RD., W OF OLD MISSOURI RD
The next item was a preliminary plat for Zion Valley, (a Planned Unit Development) submitted by Northwest
Engineers on behalf of Zion Valley L. L. C. for property located south of Zion Road and west of Old Missouri
Road. The property is zoned R-2, Medium Density Residential, and contains approximately 27.72 acres.
Ms. Little advised the number of units had been changed from the 102 shown on the concept plat to 104 units on the
preliminary plat. She stated the total green space fee would be $24,960. She noted the engineer would need to
submit a final design for the water line; stating it appeared a 6 -inch line would be adequate but an 8 -inch line might
be required. She also pointed out the sewer along Stearns was currently 6 inches and might have to be upgraded to
an 8 -inch.
She directed the engineer to the report to the Planning Commission for their meeting of January 8 regarding the
Master Street Plan requirement. She advised they had previously agreed that Frazier Street could be extended from
the east into the subject project and intersect with a loop street. She stated Stearns Street was shown as staff had
agreed even though, if the Master Street Plan were followed, Stearns Street would extend directly west along the
southern portion of the subject site. She again stated staff was in agreement with the subject plat to redirect Stearns
further south and extend it to the west property line of the site. She went on to say the other street which needed to
be discussed was Vantage Street, which would bisect the subject tract. She advised staff was in agreement that
Vantage could be moved to the west property line, requiring a 30 -foot right-of-way off the subject tract She
reminded the engineer that, at the concept plat stage, staff had discussed with the developer constructing a 22 -foot
wide street in the right-of-way and the main entrance being off that street. She noted that was not shown on the
preliminary plat.
Mr. Jim McCord, representing the developer, asked the objection to having the development access from Zion
Road.
Ms. Little stated the City would be requiring improvements to Zion Road as a part of the subject project, as well as
the sidewalk; but, Zion Road was not a standard street and, due to the curve immediately to the west of the planned
entry, staff felt it would be better for the development to exit on the new collector street which would be a standard
street.
Mr. McCord pointed out the developer was willing to make improvements to Zion Road. He asked if the staff
would still be opposed to the entry/exit onto Zion.
Ms. Little pointed out the developer would not be improving the entire length of Zion Road, only that portion
adjacent to the subject tract.
Ms. Little asked that the plat page number be shown in the title block and that sidewalks be added to the legend.
She noted sidewalks would be required along Vantage, Zion and a contribution for sidewalks on Stearns. She also
pointed out 30 feet from centerline of Stearns would needed to be dedicated for right-of-way, a contribution to the
cost of one-half of Stearns Street, 30 feet from centerline of Vantage Street needed to be dedicated for right-of-way
and construction of a 22 -foot street on the western side of the tract. She noted there was plans for a 10 -foot wide
trail along the south side of Zion Road and the developer would be asked to contribute the 5 -foot sidewalk share to
the City and the City would be responsible for building the trail. She stated the City would ask the right-of-way to
be prepared along Zion (brought up to grade).
• Ms. Little then reviewed the comments from the Fire Department: a waterline along Zion Road and an 8 -inch loop
around the complex; two additional hydrants on the west side. She stated the Landscape Administrator's comments

included the fact that rare trees had been identified on the site and a statement on the plat regarding those trees was
needed; the location for storage and cement washout was needed and tree protection specifications were needed.
Ms. Sandeen advised she did want to review the site with one of the developer's representatives. Al Harris,
Northwest Engineers, advised he would meet with Ms. Sandeen.
Ms. Little stated the protective covenants needed to address that the street lights would be owned, maintained and
the utilities paid by the development. She requested the engineer provide staff with address labels for the adjoining
property owners.
Ms. Little also advised that, while the Park Board had recommended money in lieu of land, some of the area
residents had requested park lands. She stated she did not know if that would be an issue at the Planning
Commission meeting.
Mr. McCord advised the developer preferred walking trails throughout the project rather than 4 -foot sidewalks.
Ms. Little stated he would need to request the Planning Commission consider trails on the interior rather than
sidewalks.
Rich Lane, Planning, advised Mike Phipps of Ozark Electric had requested the developer schedule an on-site
meeting with him.
Andy Calloway, Southwestern Bell Telephone, stated it appeared there were proposed easements along the east side
of the property and a 25 -foot building setback along the Stearns extension. He requested the setback be shown as a
utility easement also. He also requested the setback along the west property line be shown as a utility easement
together with the setback parallel to Zion Road. He also requested the setback on the property parallel to the Brown•
property be shown as an easement. He asked if they wanted front or rear lot service on the interior, noting
easements would be required for the interior service. He asked if the intent was to have all the units wired to one
location.
Kevin Leflar, TCA Cable, requested the same easements. He asked if the 50 -foot electric easement running through
the center of the property was an existing easement. He was advised it was existing.
Rick Evans, Arkansas Western Gas, also requested the same easements. He advised he would work with the
developer on the interior easements.
Ms. Little advised the protective covenants would also have to address maintenance of the entrance by the home
owners association and the city would need to be a third party to the covenants. She reminded the developer that,
since this was a Planned Unit Development, it did require 30% open space and the acreage of the open space needed
to be shown as a total amount of land. She stated the open space had to be shown as common area and did have to
be maintained by the home owners association. She added the tennis courts would not be considered green space
but the ponds would be considered. She further stated any area designated as a utility easement was not considered
green space.

PRELIMINARY PLAT - MARVIN GARDEN'S, PHASE 1
ROBERT WESTPHAL - S OF MEANDERING WAY, W OF CROSSOVER
The final item was a preliminary plat for Marvin Garden's, Phase I submitted by Jorgensen and Associates on behalf
of Robert Westphal for property located south of Meandering way and west of Crossover. The property is zoned R-
1, Low Density Residential, and contains 10.02 acres.
Ms. Little advised the Parks Department had requested money in lieu of land in the amount of $7,800 for 26 lots.
She stated the Fire Chief's comments had included a suggestion for a road through to Shadowridge to solve an
existing access problem for fire apparatus and would help with lack of hydrants on top of the hill.
Ms. Little requested the plat page number be added to the title block, the street dimensions added, a flood plain
panel referenced. She stated a temporary cul-de-sac at the south end of Whispering Oaks would be fine and
suggested it could be off-site. She noted a street light needed to be added between lots 13 and 14 and one on the
corner of lot 11.
Dennis Burrack, SWEPCO, advised he had a pedestal between 14 and 15.
Ms. Little suggested putting the street light on the corner of 15 and then another one between 12 and 13.
Mr. Burrack agreed and noted the building setback on lot 15 would also need to be an easement.
Ms. Little also advised Perry Franklin had advised they could remove a streetlight on Lot 10.
Mr. Burrack requested the setback on lot 7 be an easement.
Mr. Jorgensen advised all of the setbacks were noted as utility easements.
There was discussion regarding plantings in easements.
Mr. Jorgensen stated he would make a 15 -foot utility easement parallel to all of the streets instead of 25 feet.
Mr. Burrack advised the existing easement on the north side had been taken as an off-site for Boardwalk, Phase I.
He asked about the off-site easement on the south side of the subject tract.
Mr. Jorgensen stated it would be an off-site easement and he would provide a separate document for the easement.
Andy Calloway, Southwestern Bell Telephone, stated that, on the east side of lots 1 and 27, a 30 -foot utility
easement was shown. He advised 30 feet was not necessary.
Mr. Jorgensen explained it was an existing overhead line. He stated he would check it.
Mr. Calloway requested the easement between 12 and 10 needed to continue down to lot 11. He also requested a
crossing at the end of Marvin Gardens.
Kevin Leflar, TCA Cable, had no comments
Rick Evans, Arkansas Western Gas, requested the same easements and crossings as requested by Andy Calloway.
He requested that easements be shown all the way across a street and that the quads be in the middle of the
easements.
