Mountain, Fayetteville, Arkansas. Deane Street. The property is zoned R-2, Medium Density Residential and contains approximately_1.47 acres with 14 units proposed. The request is to expand the square footage -of -approved -buildings. Odom: We are going to begin the December 28, 2000, Subdivision Committee meeting. The —first item we have before us is LSD 00-27.00 located on Deane Street. The property is zoned R-2, Medium Density Residential and contains 1.47 acres with 14 units proposed. The request is to expand the square footage of approved buildings. Staff's recommendation is for approval at the Subdivision Committee level. Tim, go ahead. Conklin: Basically, Emad Damen large scale development has increased their building size from _1,728 square feet for each building to 2,028 square feet for each building. Basically, bringing the buildings closer together. We brought it back to Plat Review and also brought it back to Subdivision Committee for your approval. Staff doesn't have any objections for it to be approved at this level. They have been working with our Building -Inspections Division with regard to building code requirements for separation between structures. It's my understanding everything is okay on that. He did add two islands in the parking lot from what the Planning Commission approved. Going back and looking at that large scale, we met with Kim Hesse, our Landscape Administrator and we got those two islands added in there. The only other change will be the sidewalk at the _right-of-way line on Deane Street and it will wind through the existing trees on the east side of the project. Those are the changes that have been made. That's all I have at this time. Odom: I have reviewed, just briefly, the Plat Review minutes and I did note that Kim Hesse said something about islands and you talked about that. Other than the sidewalk, is there anything else in Plat Review that staff needed to change or go over? Conklin: No. Unfortunately, Wednesday morning, none of the utilities were here for Plat Review. We are just going to run it by them again because they have placed their easements on the west side and as long as those trees can be preserved there staff doesn't have any problems. We'll work with the applicant. Odom: Any questions? Ward: What are you going to do, add another 150 square feet on each unit? • Subdivision Committee Meeting December 28, 2000 Page 3 Al-Madhoun: Yes sir Ward: Is that going to be another room or something? - : AI-Madhoun:-No-He came back, a lot of the requests he had gotten was that they would like to see • the living room a little bit wider. Conklin:-- --Once again, we are looking at this as a multi -family development. The duplexes will not be able to be split off individually because of their location. It was my interpretation that I did not want to require them to build a roof to connect the two and call it multi- family so we ended up with the duplexes. Al-Madhoun: The only thing on the sidewalk, this will be shifted back to the right-of-way. This second sidewalk will be staggered over to miss the trees so they will not be on the island. Hoover. So the only big difference is the five feet? Al-Madhoun: The buildings used to be 1,700 square foot and now are going to be 2,000, that gives them 1,000 square feet for each unit. Odom: That's actually the only change from the developers. The other ones are from the staff. Al-Madhoun: That's the only change. Odom: Staffs recommendation is for approval at this level. Hoover. Sounds good to me. MOTION: Ward: I'll make a motion to approve LSD 00-27.00 with all staff comments. Hoover: I'll second. Odom: So it's approved. Thank you very much. Sorry you had to wait. • • Subdivision Committee Meeting December 28, 2000 Page 4 AD 00-42.00: Administrative Item McCollum Avenue discussion of using escrow funds to improve the street and the intersection of McCollum and Willoughby Road. Odom: The -next -item that we have before usisAD_00-42.00 which is an administrative item —regarding McCollum Avenue discussion of using escrow funds to improve the street and the intersection of McCollum and Willoughby Road. Conklin: I -have Mr. -Randy Allen here, our Street Superintendent for the City of Fayetteville. He contacted me about a month ago requesting to use the $35,000? Allen: I think it's close to $50,000. Conklin: $50,000 at this point. It was $35,000 that was in escrow, it's up to $50,000, received .when Tri-State Precast came through the large scale development process to improve McCollum Avenue. Randy would like to do some improvements to McCollum Avenue because of the truck traffic going to Tri-State Precast and one homeowner that lives out in that area. Why don't you go ahead Randy? Allen: Again, the request came through Tri-State Precast with Mr. Spurlock, it's called Spurlock Industries at this point. As Tim mentioned, they put up $35,000 for improvement to the roadway. They built Tri-State Precast on south McCollum. At that time, in order to widen the road, put curb and gutter or drainage ditches along the _ __roadway to make it a wider road to meet City standards, the cost was prohibitive, much -more -than the $35,000 that was -put -up-in -escrow. The Citycould not afford to go in there for one property owner and one business to take out the bank and move utilities and create an effectively wide road just for one business. Again, when the business -went -in, -they -said they were -not -really -having -any -problems getting their trucks in and out because there is not a whole lot of traffic on the roadway. However, there is Arthur Miller who lives at the far end of that on the east of the airport down there and he does travel that roadway occasionally on a four wheeler. The intersection of McCollum Road with Willoughby Road does not meet any 90 degree intersection as you can see according to the map there. They were having problems with the trucks entering McCollum Road coming back to the plant with that being a blind corner about 150 feet south of Willoughby with the trees and the high bank on the west side of the roadway which would be to the left on your picture. Mr. Miller and relatives will sometimes be riding a four wheeler coming north on McCollum and a Tri-State Precast eighteen wheeler truck would be coming off of Willoughby and they would sometimes meet there at that blind corner. Mr. Spurlock called me and asked if there was any possibility of using some of that escrow money to straighten out the intersection of • • Subdivision Committee Meeting December 28, 2000 Page 5 McCollum with Willoughby and I told him I would look at that and give him the cost estimate and I did that. They are looking at about $5,000 is what I quoted him is what would have to be used from his escrow account in order to affect that intersection alignment. He was agreeable to that and during our discussions of making that -intersection-improvement; he -asked -since -interest -had -accrued -on -his -escrow account —and it was -fixing -to -be returned to him because the ten years have elapsed, I believe it's been ten years. Is that correct Tim? Conklin: Actually, after five years they can request a hearing before the Planning Commission. You have one of those coming up at your next meeting or two meetings from now. The —Planning Commission has to determine whether or not the improvements are imminent and if they are then you shouldn't refund the money, if there is no plans for any improvements, you can refund the money or you can find another project in the area that would benefit the development. - Allen: That's really what has happened at this point. I think they are at the point they are requesting that escrow money be returned to them but while we were in discussion with the intersection improvements they said that they would be willing to utilize that escrow money for paving McCollum Road. Again, there still is not sufficient money available to do a lot of widening and bring this into City street standards or anything by any stretch of imagination but it will make improvements to a gravel road. We will be able to widen it maybe a couple feet with what is in existence there and maybe improve some of the drainage a little bit down through there. They've offered to help with some drainage pipe because that's really what they manufacture at Spurlock Industries. With all the numbers that I gave him, he is willing to commit this approximately $50,000 to improving McCollum Road to a hard surface road and make the alignment with Willoughby Road a 90 degree intersection and much safer. That intersection improvement will involve a little utility relocation but mainly with our own utilities in- house, specifically our water department. There is a fire hydrant there that will need to be moved We researched most of the nght-of-way issues and, at this point, there doesn't seem to be any issues as far as the realignment that is going to be across City -property that the -City. owns currently. .. -- Ward: The City owns all this right here? —Allen: That's-correct—That little -triangle -there that -runs -from -the east side of McCollum Road back over to the existing McCollum where it comes in at an angle off of Willoughby. Other than meeting grades where a sewer manhole, which doesn't have to be located we will just match the grade of that manhole and then relocating the fire hydrant, the • • • Subdivision Committee Meeting December 28, 2000 Page 6 alignment is fairly straight forward. We cannot get any width on McCollum Road to City standards at this point in time with available money. I don't know that our Street Committee would ever want to say they want to commit the money just because of one business on this -roadway -to_doa cost share. Weare looking -at -something in the =neighborhood-ofmaybe $250;000to-widenthis road -to City -standards. — - - Conklin: There is not much traffic on there either. Allen: Again, there is only the one business which is Spurlock Industries and then Arthur Miller who is a farmer who owns the property on the east side of McCollum. Odom: It makes sense to me to actually use the money to go towards the improvement of the road even if it's just for the intersection as opposed to just giving all the money back and not getting any improvements at all. My question is, why is this before us? Conklin: When Randy contacted me I got the file back in 1994 when this was approved and what was discussed and what was approved was one half of a City standard street for the length of the property, escrow that money and apply it to construction of a full width street. Randy said "Tim, can you go ahead and approve something different, have not a standard City street and redo the intersection?" I said "I really don't want to make that decision on my own." Odom: I understand now. I thought maybe we were just spending City funds which we don't -have the authority to do. -__ -=- - - - - Conklin- No. Just changing the condition of how those funds will be spent. Odom. Changing the conditions of approval. Conklin: Before, we were going to cost share with them to do a full City street down to their property. As Randy stated, you've got drainage ditches, you've got utilities, we have --to go -to the Street CommitteeandCity Council and ask for probably three times or a lot more money to improve a street that doesn't have very much traffic. I guess the only question I have Randy, how wide will that surface be on McCollum? Allen:—We-are-only-looking at maybe -getting -15 -or -16 feet maximum out of it. Odom: That's a start at least. Subdivision Committee Meeting • December 28, 2000 Page 7 • • Allen: Again, that's what I looked at is an improvement from a gravel street which is endless as far as maintenance on my part goes. The business calls, they need the road graveled and they need more gravel on the road, I think we have to respond because it is a City street. The problem developed back at this stage, early_on, when negotiations were - taking -place -for -improving -McCollum -Road -and -how much -money -should -have been putinto escrow, estimates of how much it was going to cost to improve that road to City street standards were either way below what were actual costs or that was just a negotiated figure, I don't know. But, obviously it is going to take probably a quarter of a million dollars to affect a city street down there to City standards and they only put up $35,000 and the City is not going to put the other $200,000 with it for one business. Odom. Do we have to send this to Planning Commission or can we approve it here? Conklin: _ I would say approve it here. MOTION: Ward: _ _I'll go ahead and make a recommendation we approve AD 00-42.00 which is the administrative item of using the escrow funds to straighten out McCollum Road to Willoughby Road and that also includes taking out the old road and put it back to natural Conklin: _ And paving it down to the south property line of Spurlock Industries.
