Mountain, Fayetteville, Arkansas. Buckner on behalf of Ell Dee Sexton for property located at 5415 Wheeler Rd. The property is in the Fayetteville planning area and contains approximately 4.00 acres. The request is to split the property into two tracts of approximately 2.00 acres each. James Buckner was present on behalf of the request. Staff Recommendations Staff recommends approval subject to the following: 1. The county requirements need to be met and include the following: a. 911 addresses need to be added to the plat. b. Add the county signature blocks. c. Add a note to the plat, "NOTICE. THIS ROAD IS NOT CONSTRUCTED TO THE COUNTY STANDARDS. THE MAINTENANCE OF THE ROAD IS THE RESPONSIBILITY OF THE CURRENT AND FUTURE PROPERTY OWNERS. THE ROAD WILL NOT BE ACCEPTED FOR MAINTENANCE BY THE COUNTY UNTIL IT IS CONSTRUCTED TO THE COUNTY STANDARD AT THE EXPENSE OF THE PROPERTY OWNERS " 2. The Master Street Plan calls for the private road running north/south along the eastern property line to be a collector. This requires 35 feet from the center line to be reserved for right of way. Thus, 20 additional feet of right of way needs to be dedicated. This will move the utility easements, building setbacks, and property lines back. 3. City water is not available unless a public line is extended from Wheeler Road across Tract A to the north side of Tract B 4. This is subject to all Plat Review and Subdivision comments. Staff must approve the final detailed plans, specifications, and calculations for grading, drainage, water, sewer, fire protection, streets, sidewalks, parking lots and tree preservation. The information submitted for the plat review process was reviewed for general concept only. All public improvements are subject to additional review and approval. All improvements shall comply with the City's current requirements. • 6. All city and county requirements must be met and the City must approval stamp all documents prior to the transfer of property. Minutes of Subdivision Committee December 30, 1999 Page 3 Committee Discussion Warrick. I would like to introduce our new Development Coordinator, Sara Edwards. This particular project is a lot split. It is not within the city limits. The eastern boundary of each of these tracts is located on the Master Street Plan as a street which is called out to be a collector in the future. We are asking that the right of way be dedicated to accommodate 35 feet from the centerline for that future collector. We are also looking for all the county requirements to be met. This project did have to be approved by County Planning and there were a few items that needed to be added to the plat before it's filed of record. We will look for those to be added before we sign off on it. City water is not available. Sidewalks, park fees, and landscaping are not required because this is a county project. Odom: Jim, do you have anything? Beavers: No. Odom: Mr. Buckner, would you like to make a presentation? Buckner: I have a question about the signature block. Warrick: That is a county requirement. It needs to be on the platted survey. You can contact County Planning for the exact verbiage that they look for on that. Odom: Do you have any problems with the conditions as they are outlined? Buckner: No. Public Comment None. Further Committee Discussion Odom: Lot splits can be approved at this level. Ward: Go back over number 2 and the collector street. Warrick. It would be a collector street from Wedington Drive north and connect to Wheeler Road where it turns to the north, south of Double Tree Estates Subdivision. It's designated on the Master Street Plan. It's going to be driven by development in the area with regard to when it will become a collector. We're asking right now that the right of way be dedicated so we will • • • Minutes of Subdivision Committee December 30, 1999 Page 4 have the opportunity in the future to build that as a collector. I would assume with the new sewer treatment plant out in that area, we'll see some additional development on the west side of town. I think it's reasonable to expect that to happen. We'll look for that to be shown on the final platted survey before it's filed of record at the county. MOTION Mr. Ward made a motion to approve LS99-24 subject to staff conditions. Mr. Bunch seconded the motion. Mr. Odom concurred. • Minutes of Subdivision Committee December 30, 1999 Page 5 PP99-15: PRELIMINARY PLAT APPLEBY ESTATES, PP250 This item was submitted by Dave Jorgensen of Jorgensen & Associates on behalf of Bleaux Barnes for property located south of Appleby Road and west of Appleby Apartments. The property is zoned R-1, Low Density Residential and contains approximately 8.08 acres with 18 lots proposed. Chris Brackett was present on behalf of the request. Staff Recommendations 1. Fencing needs to be indicated along the drip line of the 50 inch elm designated for protection. 2. Two hackberry trees, located just south of the 36 inch elm, shall be located and tree protection indicated on the grading plan. • 3. Vehicular access must be provided to the backyard manholes. 4. Provide the Storm Water Management, Drainage and Erosion Control Permit Application with the appropriate review fees. 5. All pipes, open swales and channels outside of the street right of way are private and will be privately maintained by the POA, HOA, or similar entity. 6. If requested by the Water & Sewer Superintendent, make provisions for future irrigation systems to include a 2 inch water main and gate valve for street crossings. 7. Approval is subject to all Plat Review and Subdivision comments. 8. Staff must approve the final detailed plans, specifications, and calculations for grading, drainage, water, sewer, fire protection, streets, sidewalks, parking lots, and tree preservation. All improvements shall comply with the City's current requirements. 9. Payment of parks fees in the amount of $7,990 for 17 new lots at $470 per lot. • 10. Sidewalk construction in accordance with current standards to include a 4 feet sidewalk with a minimum 6 feet green space on Dorchester, and a minimum 6 feet sidewalk and 10 Minutes of Subdivision Committee December 30, 1999 Page 6 feet green space along Appleby Road 11. (Added) No construction, including fencing, is allowed in the flood plain. Committee Discussion Warrick: This property recently came before the Planning Commission as a rezoning request. At that time, R-1 zoning was granted by the Commission as well as the Council. This is located between Quail Creek Subdivision and Appleby Apartments. The subdivision consists of one culdesac street which is stubbed out to the south property line and in the future, we expect it to connect to Dorchester Drive which is a street that is stubbed out within the Quail Creek Subdivision. Odom: This says Ripley Creek Drive. Warrick. Further south, Dorchester curves around. We expect for that to connect and the 911 Coordinator has advised us to go ahead and name this Dorchester Drive as well. This will be the north leg of it. This is located in the northwest park quadrant and it is zoned R-1. The billing address is Bleaux Barns and Sam Mathis, 1772 West Sunset, Springdale, Arkansas 72762, 750- 9100. The Parks & Recreation Board met on December 1, 1999 and voted to accept money in lieu of land in the amount of $7,900 for 17 lots at $470 per lot. This fee is based upon the present park land formula and Ordinance 4068 requires the formula base to be updated every 2 years to the current average market price. Therefore, the actual park land fee will be determined on the date of Planning Commission approval unless it is approved at the Subdivision Committee level. There is an existing home on the property and it is being incorporated into the subdivision and parks fees are not required for that because it is an existing residential structure. Rutherford: Everything is fine. Beavers: No other comments. Hesse: Are you going to be able to save that elm? Brackett: I believe we can. After we get the new center line, we can change the culdesac. Warrick. This is a preliminary plat, so it will need to be forwarded to the full Commission. Public Comment None. • • • Minutes of Subdivision Committee December 30, 1999 Page 7 MOTION Mr. Ward made a motion to forward preliminary plat 99-15 with all staff comments. Bunch: On this long creek bed, that is part of lots 1-9. Correct? Brackett: Yes. Bunch: I noticed for Technical Plat Review there were confluents on fencing. Brackett: This is all wooded and actually, from the existing drive to the west, nothing will be done. It's extremely steep. All that will remain as it is now. Bunch: I think that would be up to the individual property owners. Warrick: That would be individually owned by each of the lot owners to the western property line. Bunch: Should that be designated as an unbuildable lot but would stay with the development? That would ensure that no fence would cross the creek. Brackett: It would be extremely expensive to build a fence. They won't be able to fence across the road because of the access to the manholes. If they built a fence, it would have to stop there, have a gap, and then go down. I don't see anyone needing or wanting that. Beavers: That is in the flood plain and we wouldn't allow any work. Odom: You can't build a fence in the flood plain? Beavers: Not without coming to Tim for a permit. You could add a note to the plat. Brackett: That wouldn't be a problem. Odom: Add that condition. Brackett: No construction in the flood plain. Mr. Bunch seconded the motion. Mr. Odom concurred. • • Minutes of Subdivision Committee December 30, 1999 Page 8 LS99-31: LOT SPLIT ARKANSAS RESEARCH & TECHNOLOGY, PP247 This item was submitted by Wayne Ledbetter on behalf of the City of Fayetteville for property located at lot 35 of Arkansas Research & Technology Park fronting Moore Lane near Shiloh Drive and Moore Lane intersection. The property is zoned I-1, Heavy Commercial/Light Industrial and contains approximately 286.78 acres. The request is to split the property into two tracts containing 2.84 acres and 283.94 acres. Jim Beavers was present on behalf of the request. Staff Recommendations 1. This lot split is subject to all Plat Review and Subdivision comments. Staff must approve the final detailed plans, specifications, and calculations for grading, drainage, water, sewer, fire protection, streets, sidewalks, parking lots and tree preservation. The information submitted for the plat review process was reviewed for general concept only. All public improvements are subject to additional review and approval. All improvements shall comply with the City's current requirements. 3. Sidewalks will be installed by the developer as the subdivision is constructed. 4. (Amended) Sidewalks will be installed by the City as the subdivision is constructed. Committee Discussion Warrick: We have very few, if any comments. The City is requesting that we split out one additional lot. We have done one lot split to create lot 1. We have also approved the preliminary plat for the first 10 lots of the park. In order for the developer of this lot to be able to get in and start construction, they are requesting that it be split out so it is technically finaled before the rest of Phase I. There is access provided by way of Moore Lane. Additional access will be constructed as phase I builds out and that is from Internet Drive. This is a pending sale for lot 35 of the Park. Sidewalks will be installed by the City as the development progresses. Parks fees are not required because this is Industrial/Commercial development. Landscape preservation will be considered at the time of large scale development. These will come through as large scales. Odom. It says sidewalks to be installed by the developer as the subdivision is constructed. • Warrick: I guess that should be the developer of the subdivision and that would be the City. • • Minutes of Subdivision Committee December 30, 1999 Page 9 Odom: Why don't you put sidewalks will be installed by the City as the subdivision is constructed? That way it doesn't make it sound as if the developer of lot 35 is responsible for the sidewalk. Warrick: Okay. That's all I have. Odom: Anybody else have comments? Bunch: When will the sidewalks go in? Warrick: As the streets are constructed. Bunch: We granted a waiver. Warrick: There is no waiver contemplated for this. Bunch: This is being delayed until Moore Lane get done. Warrick: Is Moore Lane going to be improved? Beavers: It will be improved this summer. This was discussed when the plat came through and they talked about the wetlands. That has delayed our street construction. They have requested to sell lots and start on their buildings. The street plans should be done in March or April. The wetlands should be resolved sometime in the summer and construction would begin in the summer and continue through the year 2001. The sidewalks will be a part of the city construction for this area and not on Shiloh. Warrick: Shiloh is the only area that a waiver was granted for. Where this lot adjoins Moore Lane and Internet Drive, there will be sidewalks. Bunch: I'm concerned about the saleability of this. Right now, we only have 2 tenants. The sooner the infrastructure is completed, the more marketability the Park will have. Having sidewalks and Moore Lane paved, will make it more attractive to prospective tenants. Odom: So hopefully, they'll begin road work this summer. Bunch: Is there going to be a sign up on the woodland preserve indicating that is what it is? Warrick: We can make that recommendation. • • Minutes of Subdivision Committee December 30, 1999 Page 10 Bunch: Same way with the wetlands. We should be proud of it and advertise it. Since this is a city project and we've done a wonderful job. We should be the leaders in setting an example for other developers. By leaving not just green space but habitat, it would be nice to call attention to it. Warrick: That is a good comment. We can carry that comment forward. At the time �f final plat, we will be looking at the signage and the final touches to the subdivision will be taken care of. Between now and then, we can initiate those kinds of issues. Public Comment None. MOTION Mr. Bunch made a motion to approve LS99-31 for the Arkansas Research & Technology Park subject to the conditions of approval. Mr. Ward seconded. Mr. Odom concurred.
