A regular meeting of the Subdivision Committee was held on Thursday, October 28, 1999 at

PP99-6.1: PRELIMINARY PLAT
• SILVERTHORNE SUBDIVISION, PP474
This item was submitted by Brian Moore of Engineering Services on behalf of John Deweese
and Mike Schmidt for property located west of Double Springs Road and south of Highway 16
west. The property is zoned R-1, Low Density Residential and contains approximately 47.98
acres with 59 lots proposed.
• Brian Moore was present on behalf of the request.
Staff Recommendation
Staff recommended forwarding this preliminary plat to the full Planning Commission for
consideration with a recommendation for approval contingent upon the following conditions:
1. Payment of sanitary sewer assessment in the amount of $11,800 (59 lots @ $200 each)
for a future force main exiting from Lift Station No. 7 in the Hamestring Creek Basin.
• 2. The applicant was asked to contact Paul Hawkins at OMI concerning lift station capacity
for this development
•
3. Truck access shall be provided for all backyard manholes.
4. An off-site utility easement is necessary for the proposed waterline connection.
Acquisition of this easement is required for final plat approval or on the construction
plans.
4. (Amended) An off site utilityeasement is necessary for the proposed water line
connection. Acquisition of water and sanitary sewer easements are required for
preliminary plat approval.
5. Payment of parks fees in the amount of $22,125.00 (59 lots @ $375 each) prior to
acceptance of the final plat. (Note: This assessment is based on current parks fees. As
these fees are periodically adjusted, the amount will be finalized at the time of the final
plat.)
• 6. Payment of off-site improvements assessment in the amount of $6,566 for new bridge
construction on Double Springs Road.
• 7. No curb cuts for residential driveways shall be permitted onto Double Springs Road.

8. Sidewalk construction in accordance with current standards to include 6 foot sidewalks
• with a minimum 10 foot green space along Double Springs Road, 4 foot sidewalks with a
minimum 6 foot green space along all local street including Mesa and Silverthorne and 4
foot sidewalks with a minimum 5 foot green space along one side of residential streets
including Durango and Pagosa. Residential streets are shown on the plat to have
sidewalks on both side. If this is desirable, additional right of way, totaling 42 feet will
be necessary.

(Amended) Sidewalks construction in accordance with current standards to include 6 foot
sidewalks with a minimum 10 foot green space along Double Springs Road, 4 foot
sidewalks with a minimum 6 foot green space along all local streets including Mesa and
Silverthorne and 4 foot sidewalks with a minimum S foot green space along one side of
residential streets including Durango and Pagosa. Residential streets are shown on the
plat to have sidewalks on both sides. If this is desirable, additional right of way totalling
42 feet will be necessary. Streets lights at 300 foot intervals along all public streets.
9. Need to review sight distance calculations.

11. Staff approval of final detailed plans, specifications, and calculations for grading,
drainage, water, sewer, fire protection, streets, sidewalks, parking lots and tree
preservation. The information submitted for the plat review process was reviewed for
general concept only All public improvements are subject to additional review and
approval. All improvements shall comply with the City's current requirements.
12. Preliminary plat approval is valid for one calendar year.
13. Adjust the easements between lots 19 and 20.
Committee Discussion
Conklin: This property was recently annexed and rezoned. The Parks Board did
recommend for money in lieu of dedication of park land and that was accepted on October 19,
1999.
• Petrie: I want to clarify condition number 4. We wouldn't expect those easement to be
acquired before the preliminary plat is approved. These are for water and sewer and not for
drainage.
• Hof an: Is that at final plat or before final plat?

Petrie: Before final plat.
Hoffman: Let's change the wording on number 4 to reflect that.
Warrick: We can change it to read that acquisition will be required before final plat
approval.
Hoffman: Let's say what kind of utilities. Include water and waste water. What about
drainage?
Petrie: The applicant has submitted all the required drainage All of the drainage will be
discharged into Owl Creek without going through somebody else's property. I do have some
minor comments on easements. On the utility easement going across lot 19, we would ask you to
line that up to the manhole so there won't be agog. Also, the easement between lots 19 and 20,
we would expect the sanitary sewer centered within the easement.
Hoffman: We don't have any critical clearing or creek bed issues or anything?
Petrie: No.
Warrick: I have one comment on the notes. Number 8 says, "Street lights will be installed
per city ordinance every 300 feet along Double Springs Road." Instead of Double Springs Road,
just put along all public streets. Each of these streets will be public.
Conklin: The existing house on Lot 43 is being demolished and will be removed. Is that
correct?
Moore: Yes.
Conklin: That is located along Double Springs Road.
Hoffman: Does the plat show that?
Moore: No.
Hoffman. Can we make a note?
Moore: Sure.
Hoffman: What about the driveway?

Moore: That will be taken out. That will be a lot with a house that won't front Double
Springs Road.
Public Comment

Further Discussion
Moore: I have contacted Paul Hawkins and he said to go ahead and build it. He said there
is capacity in the lift station.
Hoffman: Is he going to write you a letter?
Moore: I don't know if he will or not. I think he was going to fax something over to one
of the staff. I can contact him, if I need to.
Hoffman: Didn't we have this issue on another project?
Conklin: Yes. If he can fax something over to either the Planning office or to Ron Petrie,
that will be acceptable
Moore: On condition 8 regarding sidewalks, I just kind of put it on both sides. I think the
developer will just want it on one side on residential streets. I'll show that correction.
Hoffman: Can you explain the connectivity to us?
Conklin: They are proposing a stub out to the west. There is vacant property located to the
west. To the south, there are lots already platted and several houses built. To the north is Owl
Creek. We didn't see any potential for any future stub outs to the north because of the creek.
Once again, the developer is participating in the bridge replacement project. To cross Owl
Creek, another bridge would be necessary. Staff does not feels like future development to the
north would allow that connection.
Hoffman: Is all this in the city limits?
Warrick: It has recently been annexed.
Petrie: On site distance, have you had Perry out there?
Moore: Yes. I talked to Perry and he asked that we stake it and he would go out and look

at it. We have done that. I haven't talked to him since last week. I'll get with him Monday or
Tuesday and get this worked out.
Hoffman: We'll have a formal recommendation on that before this goes to the Commission.
Petrie: Double Springs is a minor arterial. At this point, staff is recommending that thalf
the street be widened to local street standards which is 14 feet wide from centerline with curb and
gutter and storm drainage.
Conklin: They are dedicating the right of way.
Hoffman: The right of way will be there.
Conklin: With regard to Double Springs Road bridge, that is a federal aid project which has
an 80/20 cost share. The city is required to provide any utility relocation. The calculation I used
to determine their share is on file.
Petrie: This is scheduled within a year
Hoffman: They are in agreement?
Moore: Yes, that is fine.
MOTION
Ward: I move to forward this to the full Planning Commission.
Hoffman: I will second and we will need the revisions on the plat by Monday, November 1,
1999.

LS99-20 AND LS99-21: LOT SPLIT
• DAGGETT, PP289
This item was submitted by Ed Daggett for property located at 2623 N. Gregg Street. The
property is zoned R-2, Medium Density Residential and contains approximately 6.5 acres. The
request is to divide the property into 3 lots containing 3 acres, 1.56 acres, and 1.41 acres. These
are the second and third lot split requests for the parent tract.

Ed Daggett was present on behalf of the request.
Staff Recommendation
Staff recommended approval subject to the following:
1. Additional legal description information is required in order to place this request in the
City's mapping system. This information must be received prior to the Planning Division
sign off.
• 2. Parks fees in the amount of $750 for the two new residential lots. This fee must be
received prior to Planning Division sign off.
3. Only single family, residential, homes shall be located on these lots.
4. If construction of any type is planned in the floodplain and/or floodway a grading plan
and flood plain development permit are required by ordinance.
All Plat Review and Subdivision comments.
6. Staff approval of final detailed plans, specifications, and calculations for grading,
• drainage, water, sewer, fire protection, streets, sidewalks, parking lots and tree
preservation. The information submitted for the plat review process was reviewed for
general concept only. All public improvements are subject to additional review and
approval. All improvements shall comply with the City's current requirements.
Committee Discussion
• Conklin: The request is to divide the property into 3 lots These are the second and third
splits of the parent tract which means that any future divisions on this property would have to
come back through as a subdivision. Previous actions on this property include a conditional use
• for a landscaping business; a lot split with conditional use for a tandem lot; and, a property line
adjustment. With these requests for additional lot splits, no further division of any piece of the

parent tract will be permitted without subdivision approval. The subject property is located off
• of Gregg Street, west of the right of way owned by Arkansas Missouri Railroad. Basically, if
you are heading north on Gregg Street, you'll have an intervening piece of property with active
Arkansas Missoun rail service. They do not have any frontage directly on Gregg Street. There is
right of way that they will be dedicating that is existing off of Gregg Street. They will be
dedicating additional right of way to get the frontage for the lots. Staff recommends approval
subject to the above conditions.
• Petrie: I requested that the water line and any existing easement be shown on this plat.
Daggett: I thought he put that on here.
Petrie: It doesn't show a water line.
Hoffiiian: Is the water line going to be in the access easement?
Petrie: More than likely.
• Daggett: He put access and utility easement.
Petrie: That is private easement for service lines. There is a large, 6 inch main.

Daggett: That goes up the south side of the property to a fire hydrant. He didn't put that in
there?
Petrie: No. I need that shown.
Hoffman: Can you wait to sign off on that?
Petrie: They have to provide a revised legal and we will need the easement to be shown
with that revision.
Hoffman: You can hammer that out.
Petrie: I have to sign off on the building permit, too. I'll be sure and check it.
• Hoffman: Anything else about the flood way?
•
Petrie: Just that if there is any construction within the flood way or flood plain, we will
require a separate grading plan and a flood plain development permit.

Hoffman: Should he put a note to that effect on this plat?
Warrick: We would not be able to issue a building permit because this shows flood way on
our plat pages that we permit off of.
Conklin: This is a unique situation. This has a one lane concrete bridge or culvert that
crosses Skull Creek. Only single family, residential homes shall be located on these lots. This is
zoned R-2. The city does not want to see duplexes or apartment develop.
Hoffman: Using the one lane bridge?
Conklin: The applicant has stated this is what he would like to have built out here. We did
a conditional use for a tandem lot for Kenneth and Cynthia Knott. They use the one lane bridge
and come up the existing easement.
Ward: So everybody is going to be using the 25 foot easement to access their property.
Daggett: One of the potential buyers is planning access off the 50 foot access and put in a
• culvert, so he won't be using the existing easement. I am going to put in a restrictive covenant
which will be filed with the plats limiting this to single family dwellings and other things. What
is involved in dedicating the land for a culdesac to the City?

Conklin: When you bring us the revised plat with the correct legal description and
easement, we will sign off on this and have you file it at the County. That will dedicate the right
of way for the culdesac.

Ward: I'll move approval of LS99-20 and 21 with all staff comments plus showing the
water line on the plat.
Hoffman: They have to revise the legal description to clear up the curve data.
