Mountain, Fayetteville, Arkansas. ITEMS CONSIDERED ACTION TAKEN LS99-15: Conley, pp320 Approved MEMBERS PRESENT MEMBERS ABSENT Don Bunch Lorel Hoffman Lee Ward Conrad Odom STAFF PRESENT STAFF ABSENT Tim Conklin Janet Johns Ron Petrie Dawn Warrick Transcript of Subdivision Committee July 29, 1999 Page 2 LS99-15: LOT SPLIT CONLEY, PP320 This item was submitted by Mike and Regina Conley for property located at 5345 West Wheeler Road. The property is in the planning growth area and contains approximately 8.91 acres The request is to split the property into two tracts of approximately 2.03 and 6 88 acres. The applicant was not present on behalf of the project. Staff recommended approval subject to all plat review and subdivision comments. Committee Discussion Hoffman: The applicant is not present. However, we will proceed with the meeting. Conklin: From plat review, they have made all of the corrections and are showing the necessary easements on this plat. We recommend that the Subdivision Committee approve it at this level. Hoffman: In reading the plat review comments, the only thing I noted was that there was a -- you were asking them to share the same driveway easement and that has been agreed to and is not problem. Warrick: My understanding is that is correct and they are showing a 30 foot access easement that spans the lot line between the two proposed tracts. There is also an easement for an 8 inch water line. Hoffman: What is this coming down the middle of the lot with no easement? I don't understand what that is. Conklin: That looks like a power pole. Ward: Power pole. Hoffman: Okay. The SWEPCO guy hadn't been out there but he was saying something about a 30 foot easement. Should we note that on this plan? Warrick: Where was that referred to? • Conklin: "I didn't get out to look at this. I know where Conley's place is out there. That will have a 30 foot easement. Show the existing power lines on there with the 30 foot easement." Transcript of Subdivision Committee July 29, 1999 Page 3 Ward: I don't think you'd need one. That's across private property. Warrick: They showed the power line. Hoffman: It's across 2 lots Conklin: They showed the power line. Hoffman: He could stop it if there's no easement. It would stop there and then it wouldn't go there. If we entertain any motions, I suggest that before it's released that they would show a 30 foot easement or that they relocate it so that the tract B could get power from that. I think that is all I saw on this. The health department has been called on the septic and it's all alright? Petrie: They don't review those. Warrick: They don't review them until they are actually requesting a septic permit. At that time -- the Washington County approval is conditioned on their septic approval. Hoffman: So if they build on tract A -- Conklin: If they can't get the permit through the health department then the county approval is void. MOTION Ward: I will recommend approval of LS99-15 with all comments. Hoffivan: I want to specifically include an electric easement. Bunch: I'll second. Hoffman: I concur. Meeting adjourned at 8:50 a.m.
