MINUTES OF A MEETING OF THE
SUBDIVISION COMMITTEE
A regular meeting of the Fayetteville Subdivision Committee was held on January 29, 1998, at
8:30 a.m. in Room 111 of the City Administration Building located at 113 W. Mountain Street,
Fayetteville, Arkansas.
ITEMS REVIEWED: ACTION TAKEN
1. LS98-3.00: Lot Split - Bobbie Jean January Approved

LS98-3.00: WAIVER OF SUBDIVISION REGULATIONS (LOT SPLIT #1)
BOBBIE JEAN JANUARY (pp 486) - 407 E. LAFAYETTE
The only Item on the agenda was a request for waiver of subdivision regulations (lot split #1)
submitted by Alan Reid for property located at 407 East Lafayette. The request is to separate the
parent tract containing approximately 1.0021 acres into two lots containing 0.3851 acre and
.6170 acre, respectively. The property is zoned R-1, Low Density Residential..
Staff Findings: The property is located in the historic district between Lafayette and Sutton
Streets. There is a house and a detached garage on the property facing Lafayette. The part of the
lot (which is being requested to be split off) facing Sutton Street has a creek running through it.
There is extensive topography and a number of stone retaining walls constructed on the site.
Staff believes the lot is virtually unbuildable without a great deal of engineering work. The lot
and the improvements thereon contribute to the historic district.
Staff Recommendation: Denial of request based upon the lot facing Lafayette Street being made
non -conforming with the loss of the Sutton Street frontage and the unbuildable nature of the lot
to be created facing Sutton Street. If the Subdivision Committee chooses to approve the project,
staff recommends the following:

Plat Review and Subdivision comments (to include written staff comments mailed to the
applicant or his representative, and all comments from utility representatives - Arkansas
Western Gas, Southwestern Bell Telephone, Ozark Electric, SWEPCO, and TCA Cable.

2. All improvements shall comply with City's current requirements.
3. Approval of variance request for a lot (facing Lafayette) which does not meet the
minimum frontage requirement in an R-1 zoning district. This item must be considered
by the Board of Adjustments.
4. Payment of parks fees in the amount of $375.00 for the creation of one new residential
lot.
5. Sidewalk construction in accordance with current standards to include the replacement of
a 4'6" x 11' section along Lafayette Street which currently poses a safety hazard.
6. A formal grading and drainage plan will be required prior to any earthwork or building
which may occur on the new lot facing Sutton Street.
Ms. Little noted there had been some discussion regarding the City purchasing the new lot facing
Sutton Street for park lands.
Nancy Dugwyler, Parks Department, advised the Parks Board and staff had visited the site at the
request of residents in the area She noted the item was on the Parks Board agenda at their
February 2, 1998 meeting.
George Faucette, representing Mrs. January, advised the width of the lot was similar to most of
the lots along Lafayette Street. He also showed a survey of the property, pointing out the
location of the creek. He advised there was a portion of the property, located at the southeast
corner of the lot, which was buildable. He contended the drainage from the lot would go into the
creek which ran across the property.
Public Comment:
There was no public comment.
Mr. Reynolds stated it would be nice to have a park at that location; that the neighborhood
needed one.
Mr. Fomey stated he was not concerned with the 67 -foot frontage; and, since there were two
streets, each lot would have easy access. He further stated he knew the site and the slopes and
agreed with Mr. Faucette that steeper slopes had been developed. He also advised he did not
believe the possibility of the land being purchased for a park should have anything to do with the
Subdivision Committee's decision regarding the lot split. He did, however, express his belief the

neighborhood would miss the property if it were developed as a private home site. He stated he
could find no reason to not approve the lot split.
Ms. Johnson agreed with Mr. Forney. She asked if staff agreed with Mr. Faucette that the lot
was buildable without serious drainage problems.
Ms. Warrick advised Engineering had required a formal grading and drainage plan for the lot as a
condition of approving a building permit application.
Mr. Faucette stated his client was in agreement with all staff conditions.
MOTION
Ms. Johnson moved to approve the lot split subject to staff comments.
Mr. Forney seconded the motion.
The motion carried 3-0-0.
