MINUTES OF A MEETING OF THE
SUBDIVISION COMMITTEE
A regular meeting of the Fayetteville Subdivision Committee was held on March 13, 1997, at
9:00 a.m. in Room 111 of the City Administration Building located at 113 W. Mountain Street,
Fayetteville, Arkansas.
MEMBERS PRESENT: Conrad Odom, Bob Reynolds, and John Forney
STAFF PRESENT: Rich Lane, Jim Beavers, Chuck Rutherford, and
Heather Woodruff.
PP97-3.00: PRELIMINARY PLAT FOR DEERFIELD PLACE (pp571)
GORDON WILKINS-N. OF HWY 16E AND W. OF MALLY WAGNON RD.
The preliminary plat for Deerfield Place was resubmitted by Dave Jorgensen of Jorgensen and
Associates on behalf of Gordon Wilkins for property located north of Hwy 16E and west of
Mally Wagnon Road. The property is zoned R -O (Residential Office ) and R-1 (Low Density
Residential) and contains approximately 11.72 acres with 33 lots proposed.
Mr. Jorgensen stated the developer had resubmitted the Preliminary plat because the project had
become unfeasible to pursue without additional lots. He explained lots 9 and 10 had been added
to the northwest corner. Lots had been added on the south end near the R -O lots, lots 2 and 32,
but would be built as single family throughout the subdivision. They were no longer going to
build duplexes.
In response to a question from Mr. Jorgensen, Mr. Beavers stated the cul-de-sac would be
permanent until the adjacent property owners, the Lanes, decided to develop.
Mr. Jorgensen stated Mr. Lane had not wanted the stub out.
Mr. Forest Lane, adjacent property owner, stated he had no objections to the stub out. His
objection was that the subdivision's westem property line did not coincide with his eastern
property line.
Mr. Reynolds confirmed the property line dispute had been discussed at the pervious Subdivision
Meeting.
Mr. Forest Lane stated there was an overlay of 5.22 feet.
Mr. Jorgensen thought it was odd that the property line ran so far west of the existing ditch. The
current property line was running into Mr. Lane's blueberry field. He added they had no
intention of building on Mr. Lanes property.

In response to a question from Mr. Reynolds, Mr. Jorgensen stated they would have the property
line dispute taken care of before the Planning Commission Meeting.
Mr. Reynolds stated that if the problem had not been solved the Planning Commission would not
not hear the project.
Mr. Jorgensen stated they would have a survey crew out to the property as soon as the weather
cleared. He added the current survey had been done by a another company, Allen Reed.
Mr. Forest Lane expressed concerns about drainage. The proposed street ran where there was an
existing intermittent stream. He explained all of the south side of Hwy 16 drained under the
culvert and into the ditch and from the mid point of his farm to the east to Mally Wagnon also
drained into the ditch.
Mr. Jorgensen stated they were aware of the situation and were taking care of the problem by
using drainage pipes.
Mr. Forest Lane explained the ditch ran north into an old sump. He added there was an
underground outlet through the fractures in the substrata that drained for five to ten days into the
property to the north which appeared to be a spring.
Mr. Beavers stated the City engineers would review Mr. Jorgensen's calculations. He added
engineering did not support the developer's request to narrow the street from 28 feet to 24 feet
because if the property to the west was to develop, the traffic flow would exceed the amount
allowed for a 24 foot street.
Mr. Jorgensen stated they had reconsidered and would prefer to go with 28' streets.
Mr. Reynolds added the developer needed to place a marker at the end of it stating the cul-de-sac
was a future street extension.
In response to discussion between the commissioners, Mr. Beavers explained the sidewalk
needed to extend straight to the property line. It would not wrap around the cul-de-sac.
Mr. Forest Lane asked the ultimate destination of the drainage.
Mr. Jorgensen stated a portion of the water would drain to the east but the majority of the water
would drain to the west and into the natural drainage path on Curtis Drumans property. The
eastern portion would drain to the east to Mally Wagnon and onto Mr. Wilus property. They had
spoken with Mr. Wilus about a drainage easement.

Mr. Beavers stated the developer was only required to detain the runoff he would be adding.
Mr. Forney explained the drainage ordinance would not allow the development to increase the
rate of runoff. The detention pond would release at the same rate as the existing runoff.
Mr. Reynolds asked what they had planned to do to Mally Wagnon Road.
Mr. Jorgensen stated Mally Wagnon would be widen and paved 26' from the south end of the
property to the north end of the property.
Mr. Rich Lane stated the revisions would be due Monday at 10:00. He added lots 1 and 33
would have to go through large scale development process when developed.
MOTION
Mr. Forney moved to forward the item to the Planning Commission.
Mr. Reynolds seconded the motion.
The motion carried unanimously.

LS97-4.00: LOT SPLIT FOR HAZEN
JAMES HAZEN- 2160 RUPPLE ROAD
The lot split was submitted by the applicant for property located south of Mount Comfort Road
and east of Rupple Road at 2160 Rupple Road. The property is zoned R-1 and contains
approximately 70.4 acres. The request is for a second lot split creating a parcel containing
approximately 0.636 acres.
Mr. Rodney Phillips stated he was purchasing the land from Mr. Hazen.
Mr. Lane stated this was the second lot split and there would be a sidewalk requirement for any
newly created lots.
Mr. Rutherford stated there would be a sidewalk required at the time of development. They were
not requiring a sidewalk on the existing parcel. The sidewalk would have to be constructed
before the final inspection.
Mr. Lane stated the City would be collecting parks fees in the amount of $300 at the time of
• issuance of building permit.

MOTION
Mr. Forney moved to approve the lot split with all of staff comments.
Mr. Odom seconded the motion.
The motion carried unanimously.
The meeting adjourned at 9:50 a.m.
