HomeMy WebLinkAbout1997-02-27 - MinutesMINUTES OF A MEETING OF THE SUBDIVISION COMMITTEE A regular meeting of the Fayetteville Subdivision Committee was held on February 27, 1997, at 9:00 a.m. in Room 111 of the City Administration Building located at 113 W. Mountain Street, Fayetteville, Arkansas. MEMBERS PRESENT: Jerry Allred, Bob Reynolds, John Forney, and Lorel Hoffman. STAFF PRESENT: Alett Little, Rich Lane, Jim Beavers, Dawn Warrick, Chuck Rutherford, Beth Sandeen, and Heather Woodruff. LS97-2.00: LOT SPLIT FOR TIPTON MARVIN BOHANNON-DOT TIPTON RD. The lot split was submitted by Marvin Bohannon on behalf of D. W. Tipton for property located south of Dot Tipton Road and west of 54 Street. The property is in the county and contains approximately 3.49 acres. • Ms. Warrick stated the staff had no outstanding issues and were recommending approval subject to the staff comments in the plat review minutes. PUBLIC Mr. Charles Alexander believed Mr. Bohannan was not allowed to enlarge his property under the subdivision's covenants. Mr. Allred explained the restrictive covenants of a subdivision were enforce by a class action lawsuit from the neighbors. Neither the City nor the County had jurisdiction over the restrictive covenants. Ms. Calhoun stated this was a lot line adjustment and their contract specifically stated that the property was not restricted to any of the covenants in the Subdivision. Mr. Alexander stated the subdivision had restrictive covenants. Mr. Bohannon stated the property would not restricted by the covenants because it was outside the 20 acre subdivision. • Ms. Little stated the City had never restricted people from adding to their property. It was their right. • Subdivision Meeting February 27, 1997 Page 2 • • Mr. Forney asked how Mr. Bohannon would be able to develop the new property brought into the existing subdivision. Ms. Little stated he could not further develop it or make more lots out of it without going through the subdivision process. He would then have to include a road so all the lots would have frontage. Mr. Alexander asked who had the authority to add or take way from the existing subdivision. Ms. Little stated as a citizen of the United States, Mr. Bohannon had the right to acquire property. What the City and the County were overseeing during a property line adjustment was the public frontage and Mr. Bohannon had frontage along the county road. Mr. Reynolds stated they did not enforce private covenants. MOTION Mr. Forney moved to approve the lot split subject to the staff comments. Mr. Reynolds seconded the motion. The motion carried unanimously by a vote of 3-0-0. FtS Zoo Subdivision Meeting February 27, 1997 Page 3 LS97-3 00: LOT SPLIT FOR CRONIN SUSAN CRONIN- 356 SKELTON RD The lot split was submitted by Susan Cronin for property located north of Skelton Road and east of Hwy 71 B at 356 Skelton Road. The property is zoned R-1 (Low Density Residential) and contains approximately 4.89 acres. Ms. Warrick stated the staff recommended approval based on plat review comments and staff recommendations. Ms. Little stated Ms. Cronin would be required to install sidewalks. Mr. Allred asked if one of the lots would be land locked. Ms. Little stated it had the frontage along Skelton Street, 60.2 feet. The required frontage had been waived by the Board of Adjustments. • MOTION Mr. Reynolds moved to approve the lot split. Mr. Forney seconded the motion. The motion carried by a vote of 3-0-0.
