MINUTES OF SUBDIVISION COMMITTEE MEETING
A meeting of the Fayetteville Subdivision Committee was held on
Thursday, June 29, 1995 at 10:30 a.m., in Room 111 of the City
Administration Building, 113 West Mountain Street, Fayetteville,
Arkansas.
MEMBERS PRESENT: Jerry Allred, Robert Reynolds, Charles Nickle
Jana Britton
OTHERS PRESENT: Alett Little, Elaine Cattaneo, and
others.
PRELIMINARY PLAT - EMERALD SUBDIVISION, PHASE II
DAVE JORGENSEN - NORTH OF TOWNSHIP, NORTH OF WESTVIEW DRIVE
The first item discussed was the preliminary plat for Emerald
Subdivision, Phase II submitted by Dave Jorgensen on behalf of J.B.
Hays for property located north of Township, north of Westview
Drive. The property was zoned R-2, Medium Density Residential and
contained 3 lots within 2.13 acres.
Ms. Little advised there were two big issues in regard to this
plat: the fire service and the street issue.
Jorgensen advised he had cleared the fire service with the Fire
Chief and noted there would be a fire hydrant installed at the very
end of the cul-de-sac and a loop line would be considered. He
noted there was already a fire hydrant located within 240' of the
end of the street.
In response to Reynolds comments regarding the grade of the land,
Jorgensen advised all three of the lots would require a grading
permit.
Britton expressed concern about the stability of the soil in this
area.
Little advised this plat was tabled at the June 1st meeting pending
a review by the Parks Board.
Jorgensen advised the Parks Board had recommended money in lieu of
land.
In response to comments from Little, Jorgensen advised he had done
the public notification and he would submit that to the staff.
Little advised that the street going into this area had failed
according to the Street Department. She advised it would have to
be redone in order to be a valid street and discussion had taken
place as to whether the developer should have to pay off-site
improvements. She noted the City Engineer had stated that may be
an excessive assessment since there were only three proposed lots

in this development. She explained the street had already been
accepted by the City and had failed after the one year time limit.
Allred inquired as to whether Emerald Street had been built to City
standards and inspected. Jorgensen advised that it had.
Little pointed out even though the street had been accepted by the
City, it didn't hold.
Jorgensen advised that there were some cracks going lengthwise
along the street which were similar to cracks which had occurred on
Township Avenue.
Little advised the Code stated if the development was going to be
accessing a street that was substandard, then the developer may be
required to bring it to City standards. She inquired as to what
the Subdivision Committee members needed in order to make an
assessment of this situation.
Nickle requested a report from the Street Department in regard to
the condition of the street and a report from the City Engineering
Department in regard to what it would take to repair it.
Jorgensen requested a written directive from the staff as to what
the developers needed to do in regard to the street.
Reynolds recommended that the developer should at least be required
to put up a certain amount of money for the repair of the street in
the future.
Britton pointed out there would be heavy trucks traveling this
street during the construction as well as the normal use of the
trash truck and contended it should be repaired now.
Little advised the staff would get a report on the condition of the
street, what it would cost to repair it, and would try to get a
recommended share of the cost of repair.

FINAL PLAT - HIDDEN LAKES
MEL MILHOLLAND - NORTH OF MISSION BLVD, WEST OF RAMSEY
The next item discussed was a final plat of Hidden Lakes
Subdivision submitted by Mel Milholland on behalf of BMP
Development for property located north of Mission Blvd, west of
Ramsey. The property was zoned R-1, Low Density Residential and
contained 15.0 acres.
Britton stated she had been under the impression that curb and
gutter and everything was supposed to be in before the final plat
was reviewed. Little advised the ordinance stated that had to be
done prior to approval of the final plat; therefore, Planning
Commission approval could be obtained, but it couldn't be signed
off on until the improvements were in or bond had been posted.
Little advised that there weren't any outstanding issues on this
plat.
Milholland advised he had obtained a standard form for a deed for
the parks. Little advised he would also need one for highway
dedication.
Britton expressed concern about the open concrete swell and the
safety of children in the neighborhood. Milholland advised there
would be a grate with bars over it.
Little requested that a note be on the final plat advising that the
lots would be accessing the interior street and not Highway 45.
She also requested a copy of the protective covenants
In answer to a question from Britton, Milholland advised there
would be a full-fledged properly designed cul-de-sac with a turn-
around.
MOTION
Nickle made a motion to forward this final plat onto the Planning
Commission for approval subject to staff comments, seconded by
Reynolds. The motion passed unanimously.

FINAL PLAT - MADISON AVENUE
MEL MIHOLLAND- S OF MISSION BLVD, E OF STARR RD
The next item was a final plat of Madison Avenue submitted by Mel
Miholland on behalf of S & S Development for property located south
of Mission Blvd, east of Starr Road. This property is zoned R-1,
Low Density Residential and contains 10.18 acres.
Britton inquired as to the status of the corner lot which is R -O,
Residential -Office. Milholland advised the renters had it leased
until the end of the year.
Little advised that a sidewalk is required along Highway 45 and any
waiver of that would need to go to the City Council. She added a
bond can't be posted on a sidewalk. She referred to the prior
Minutes of the Planning Commission meeting in regard to the
preliminary plat which informed the developers of the requirement
for a sidewalk on Highway 45.
It was pointed out that lots 14 & 15 were required to access off of
Hailey Street although the prior Minutes had incorrectly noted lots
15 & 16.
Milholland advised he would note on the plat that all lots would
access to interior streets.
MOTION
Nickle made a motion to forward this plat on to the Planning
Commission for approval subject to the staff comments, seconded by
Britton. The motion passed unanimously.
OTHER BUSINESS
Discussion took place in regard to the possibility of the staff
sending the final plats on to the Planning Commission and bypassing
the Subdivision Committee in an effort to streamline the process
and to save time. Also, the possibility of having a consent agenda
for the subdivision Committee meeting was discussed. No decision
was reached, but further discussion was to take place at a later
date.
