HomeMy WebLinkAbout1994-09-29 - Minutes• • • MINUTES OF A SUBDIVISION COMMITTEE MEETING A meeting of the Fayetteville Subdivision Committee was held on Thursday, September 29, 1994 at 10:30 a.m., in Room 326 of the City Administration Building, 113 West Mountain Street, Fayetteville, Arkansas. MEMBERS PRESENT: Kenneth Pummill and Tom Suchecki OTHERS PRESENT: Don Bunn, Jerry Rose, David Cox, Harry Gray, Chester Dean, Sharon Langley, and others FINAL PLAT - STERLING ESTATES CARL LEDBETTER - W OF HILLSIDE TR., E OF HWY 265 The first item was a final plat for Sterling Estates submitted by David Cox, Engineering Services, on behalf of Carl Ledbetter, for property located on the west side of Hillside Terrace, east of Highway 265. The property is zoned R-1, Low Density Residential, and R-2, Medium Density Residential and contains 6.85 acres with 24 proposed lots. Mr. Cox explained hie client was bringing the final plat back through in order to avoid numerous lot splits. He stated the development had originally been for duplex unite but the new plat showed townhouse lots. MOTION Mr. Suchecki moved to forward the plat to the Planning Commission. Mr. Pummill seconded the motion. Subdivision Committee Meeting • September 29, 1994 Page 2 • • LARGE SCALE DEVELOPMENT - SWEPCO SUBSTATION SWEPCO - W OF HWY 265, S OF MANOR DR. The next item was a large scale development for the SWEPCO Substation submitted by Harry Gray on behalf of SWEPCO for property located west of Highway 265 and south of Manor Drive. The property is zoned R-1, Low Density Residential and contains 4.78 acres. Mr. Gray advised SWEPCO was proposing to construct a substation on the east side of Fayetteville, behind the fire station on Crossover. He explained would provide services for a large portion of the east side of Fayetteville. He noted it had been approved by the Public Service Commission. He stated all of the plans (grading, drainage, landscaping, etc.) had been submitted. Mr. Bunn advised his office had received the grading and drainage plan. He also noted the Fire Chief had requested an additional hydrant which was now shown on the plat. Mr. Gray stated SWEPCO recognized this was a sensitive area in a residential neighborhood. He explained the plans, as presented, provided all reasonable protection. He went on to point out the 7 -foot cedar fence along the east side of the substation; the grading plan which sets the substation down 12 to 15 feet on the east side with a 12 to 15 foot fill on the west side; the perimeter to be fenced by a galvanized 4 -foot chain link fence (coated with green vinyl); hand clearing of the wooded area. He further noted normally SWEPCO used an 8 -foot chain link fence around the substation but in this case they were putting a 4 - foot exposed aggregate fence with wrought iron gates. Mr. Hornaday of SWEPCO explained the fence would be a block concrete panel wall. Mr. Pummill stated it was his understanding this matter had been before an administrative judge who had made a ruling as to where the site would be located. Mr. Hornaday agreed. Mr. Pummill asked what the Planning Commission and Subdivision Committee needed to review. Mr. Jerry Rose, City Attorney, explained they needed to review the normal items: grading, drainage, access, etc. He advised they were not present to review any other issues on the location of the substation. An attorney representing the Randalls stated it was her understanding the Public Service Commission gave SWEPCO permission for a substation but had not directed the site. She went on to say Mr. Randall did object to the location for environmental reasons, health and safety reasons, and devaluation of his property. Mr. Rose advised he believed the Order directed the location of the substation. Mr. Rick Johnson, 25 S. Crossover, asked if the lines leaving the substation, which would tie into the existing 161KV line, were not a part of the items being reviewed by the Planning Commission. Mr. Pummill stated that would not be reviewed by the Planning Commission. Mr. Johnson explained he had originally heard the power lines were to leave the substation, go through a proposed development (The Cliffs), and tie in on Steve Cummings property. He further stated that, since that time, he believed the path • Subdivision Committee Meeting September 29, 1994 Page 3 of the line had been changed to exempt the proposed development and tie in on his property. Mr. Hornaday stated the approval SWEPCO had with the Public Service Commission was for the line to tie in on the Cummings property. He explained that was the only approved route and that was the route they planned to follow. Mr. Johnson explained this project would encircle his house with 160KV line with other lines on the bottom of the poles. He expressed concern regarding the emission of EMF's as a threat to his family. Mr. Ted Jones, the president of the Fayetteville Firefighers Association, pointed out if the fire station was lot located in front of the proposed site, SWEPCO would not be doing massive dirt work. He explained the firefighters did not put a command post within 200 feet of a high hazard and contended they should not have to sleep within 200 feet of a high hazard. He pointed out the substation was less than 200 feet from the fire station. He contended the fire station was being used as part of the landscaping to block the view of the substation. He also advised that a 7 foot concrete wall would be needed to block the EMF flow. He further contended the east side of Fayetteville's public safety facility should not be risked by a high hazard within 200 feet of the facility. Dr. Tony DePalma advised a 7 -foot concrete wall would not block EMF's. He stated the magnetic component of EMF's would go right through a concrete wall. He stated he was concerned about the drainage, the trees and the environmental destruction the project would cause. He asked if the Master Street Plan showed • Ridgely Drive extending. He also expressed concern about storm drainage and pointed out the topography of the area. Mr. Jones also pointed out numerous houses in Fayetteville had slid off of mountains due to the high static water pressure under the ground. He advised he had numerous conversations with a Mr. O'Neal in Farmington who was an expert in this field. He went on to say that, when the back side of the lot received 15 feet of fill, there was the possibility of causing unstable ground. Mr. Pummill explained the City Engineer signed off on the grading and drainage plans and the Planning Commission assumed he was doing a good job. Dr. DePalma pointed out there was an Arkansas Western Gas Company line in the vicinity of the site. Mr. Bunn advised there was a gas line running parallel with Highway 265. Dr. DePalma asked if SWEPCO would have to cross Highway 265 to service the Hyland Park area. • Mr. Hornaday stated there was existing service in Hyland Park and there was no plan to change that service. He stated there was an existing distribution line along Highway 265 which served Hyland Park and that fed would continue. MOTION Mr. Suchecki moved to forward the plat to the Planning Commission. Mr. Pummill seconded the motion. Dr. DePalma asked if the substation met the requirements of Section 159.3 through 159.33 of the City Code (the subdivision regulations). • • • Subdivision Committee Meeting September 29, 1994 Page 4 Mr. Rose pointed out the Large Scale Development ordinance required the city to comply with Sections 159.30 through 159.32 of the Subdivision Regulations pertaining to streets, surface drainage system, water system, sanitary sewer system. Mr. Bunn advised staff believed the project did satisfy the requirements of the city code. Dr. DePalma expressed concern that the project did not met those regulations. • Subdivision Committee Meeting September 29, 1994 Page 5 • • LARGE SCALE DEVELOPMENT - ARKANSAS BOOK SERVICES STERLING ANDERS - W OF SHILOH DR., S OF MT. COMFORT The last item was a large scale development for Arkansas Book Services submitted by Harry Gray on behalf of Sterling Anders for property located on the west side of Shiloh Drive, south of Mt. Comfort. The property is zoned I -I, Heavy Commercial - Light Industrial, and contains 1.49 acres. Mr. Gray advised the applicant was planning on almost doubling the size of the Book Services building. He explained it would be a warehouse area and some parking would be added. Mr. Pummill asked if this project would be affected by the overlay district. Mr. Chester Dean advised the property was exempt. In response to a question from Mr. Suchecki, Mr. Gray stated they planned to add to the existing building. MOTION Mr. Suchecki moved to forward the plat to the Planning Commission. Mr. Pummill seconded the motion. The meeting adjourned at 10:55 a.m.
