HomeMy WebLinkAbout1994-09-15 - MinutesNEIL • • • MINUTES OF A SUBDIVISION COMMITTEE MEETING A meeting of the Fayetteville Subdivision Committee was held on Thursday, September 15, 1994 at 10:30 a.m., in Room 326 of the City Administration Building, 113 West Mountain Street, Fayetteville, Arkansas. MEMBERS PRESENT: Kenneth Pummill, Chuck Sickle, and Tom Suchecki OTHERS PRESENT: Alett Little, Tim Conklin, Mandy Bunch, David Leib, Richard Doyle, Harry Gray and Sharon Langley PRELIMINARY PLAT - BRIDGEPORT SUBDIVISION, PHASE II CREEKWOOD HILLS DEVELOPMENT - S OF MT. COMFORT, W OF RUPPLE The next item was a preliminary plat for Bridgeport Subdivision, Phase II, submitted by David Leib and Cindy Jones on behalf of Creekwood Hills Development, Inc. for property located south of Mt. Comfort, west of Rupple Road. The property is zoned R-1, Low Density Residential, and contains 17.23 acres with 47 proposed lots. Ms. Little advised staff had requested a concept plat showing how the phases fit together and how the entire development fit in with other adjoining subdivisions. She stated the developer was donating park lands (in excess of that required by ordinance) but staff needed to determine from the Parks Department what type of access they wanted to the park. She pointed out the 20 foot access to the park which would allow park vehicles and pedestrians access. She also advised the current access to the subdivision was a low water bridge; that the developer had agreed to obtain a performance bond for the construction of the required bridge. She noted the developer had to receive Corps of Engineers approval which had delayed the project. Mr. Suchecki asked if the Planning Commission had not directed no building permits could be issued until the bridge was constructed. Me. Little stated it was. She explained that, if the developer obtained a performance bond for the cost of the bridge, insuring the construction of the bridge, the City would be willing to issue building permits. Mr. Suchecki asked about the plans for the bridge. Richard Doyle, one of the developers, advised the plans for the bridge were complete. He further stated the Corps of Engineers had approved the plans. He stated Don Bunn was now going over the calculations approved by the Corps of Engineers and the developers were waiting for approval from Don Bunn. He advised a contract had been let for the construction of the bridge. Ms. Bunch stated the Corps of Engineers had approved the hydraulic calculations only. She advised Jim Beavers, Engineering Department, was checking the structural calculations. She noted the Engineering Department had problems in getting the structural calculations from the developer's engineer. Mr. Doyle assured the Subcommittee that, once the city had approved the calculations, they would start the actual construction the next day. He advised the contract required the bridge to be constructed within six weeks. He further noted the pre -cast bridge was complete; all they had to do was install the piers and beams. Ms. Little advised staff had been on the site the previous day. She asked if Mr. Doyle had been contacted by city staff regarding erosion control. She explained there was mud flowing in Hamestring Creek. Subdivision Committee • September 15, 1994 Page 2 Mr. Doyle stated the street crossings had caused some muddy water. He advised they had been on site after the installation of the crossings and had cleaned the bank. He explained Ro-Ark would hydroplane the banks after putting in top soil. He advised that, by Friday, the banks would be cleaned up and protected so they would not have to worry about erosion. Ms. Bunch advised there had been no erosion control on the banks. She stated there had been a bucket scooping mud out of the creek. She advised it was a very bad situation. • • Ms. Little explained Hameetring Creek fed into Clear Creek which fed into the Illinois. She reminded the Committee the State was under severe mandates regarding discharges into the Illinois. Mr. Doyle assured the Committee he would contact BB&B immediately after the meeting and the controls would be set up immediately. In response to a question from Ms. Little, Mr. Doyle assured her the street names had been approved by Jim Johnson, 911 Coordinator. Ms. Little stated Mr. Johnson normally required the street name to change when the street changed direction. Mr. Doyle stated he had personally taken the plans to Mr. Johnson and had received approval. Mr. Suchecki asked if the donation of parks lands had been approved. Me. Little stated the Parks Board had approved the land but had not yet received a deed. Mr. Doyle advised the deed was prepared but, since he was not totally finished with the park improvements until the following week, he had not filed the deed. Mr. Conklin advised the Subcommittee the developer was planning on annexing additional land to the north of Phase I. Mr. Doyle explained they had purchased the additional property so they would not have to construct the creek bank so high. He further explained they would be using the additional property for a road. Me. Little asked if cable would be installed. Mr. Doyle stated they would not be installing the cable at the time of development. Mr. Conklin asked if the agreement for street light maintenance had be signed. Mr. Doyle advised the covenants would require the POA to maintain the street lights, the landscaping and the park, if it were not maintained. In response to a question from Mr. Nickle, Ms. Little stated the cost share for the pump station would be brought before the Planning Commission. MOTION Mr. Suchecki moved to forward the plat to the Planning Commission. Mr. Nickle seconded the motion. Subdivision Committee • September 15, 1994 Page 3 • • PRELIMINARY PLAT — PINE VALLEY, PHASE III BMP DEVELOPMENT — SOUTH OF MT. COMFORT, WEST OF PORTER The next item was a preliminary plat for Pine Harry Gray on behalf of BMP Development for Comfort, west of Porter. The property is zoned and contains 8.7 acres with 26 proposed lots. Valley, Phase III submitted by property located south of Mt. R-2, Medium Density Residential, Ms. Little explained there was a revised preliminary plat because there had been approximately a 100 -foot error in the original preliminary plat. She also pointed out the street alignment had been changed and a stub out had been provided to the west. Staff reviewed the floodplain and floodway on the property with Mr. Gray. There was also discussion regarding a barrier at the end of Pine Valley. It was determined there should be some type of a more permanent barrier with reflective paint. Mr. Gray requested staff discuss the matter with Randy Allen, Street Division, and determine the type of barrier the city wanted. Ms. Little also noted one of the easements needed to be moved totally onto the subject property, as discussed at the Plat Review meeting, to eliminate the need for an off-site easement. Staff reviewed some of the other items requested at Plat Review which were not reflected on the plat. Ms. Little advised the deed to the park lands also needed to be filed. Mr. Gray explained the park land was dedicated for both Pine Valley and Pine Crest. He stated he would like to have one deed for the entire tract. Ms. Little requested the park lands be shown on the final plats of both subdivisions. In response to a question from Mr. Nickle, Mr. Gray advised Pine Valley was zoned R-2 and Pine Crest was zoned R-1.5. He reminded the Subcommittee there had been a $50,000 fee from both of the subdivisions for a bridge over Hamestring at Salem Road. Ms. Bunch requested erosion control methods be used along the creek. Mr. Gray explained he was responsible for erosion control during development of the subdivision but, once the builder purchased a lot, the builder became responsible for the erosion control. After discussion, Ms. Langley advised the builder did have to sign an erosion control statement at the time of building permit application. MOTION Mr. Nickle moved to forward the plat to the Planning Commission. Mr. Suchecki seconded the motion. Subdivision Committee • September 15, 1994 Page 4 • • FINAL PLAT - FIELDSTONE SUBDIVISION, PHASE I CASTLE DEVELOPMENT - N OF HWY 16, W OF CARLSBAD TR The next item was a final plat for Fieldstone Subdivision, Phase I, submitted by Harry Gray, Northwest Engineers, on behalf of Castle Development for property located north of Highway 16 West, west of Carlsbad Trace. The property is zoned R-1, Low Density Residential, and R-1.5, Moderate Density Residential, and consists of 24 acres with 68 lots. Mr. Conklin asked that lots 37 and 38 face Boxley rather than Franciscan. He reminded Mr. Gray the utility company representatives had made that request at the Plat Review meeting. Ms. Little advised the Parks Department had requested land. She explained the developer had purchased additional land from Northwest Acres, Phase IV as the land dedication. She noted the park lands would fit in with park lands from other, adjoining subdivisions. Mr. Nickle reminded the Committee that, at one time, they had established a cut off for the higher density developments. Mr. Gray advised the dividing line was the western border of the subject project. In response to a question from Mr. Nickle, Ms. Little explained the property was zoned R-1.5 but had received a variance in order to have townhouse lots. MOTION Mr. Nickle moved to forward the plat to the Planning Commission. Mr. Suchecki seconded the motion. The meeting adjourned at 11:00 a.m.
