MINUTES OF A SUBDIVISION COMMITTEE MEETING
JULY
A meeting of the Fayetteville Subdivision Committee was held on Thursday, d+me-
14 -39,, 1994 -at 10:30 a.m., in Room 326 of the City Administration Building, 113
West Mountain Street, Fayetteville, Arkansas.

PRELIMINARY PLAT - SPRING PARK, PHASE III
CLARY DEVELOPMENT - N OF JOYCE ST., W OF MALL LANE
The first item was a preliminary plat for Spring Park, Phase III submitted by
Development Consultants, Inc. on behalf of Clary Development Corporation for
property located north of Joyce Street, west of Mall Lane. The property is
zoned C-2, Thoroughfare Commercial, and contains 13.264 acres with 1 lot.
Ms. Little advised staff was still awaiting information on vacating a number
of easements. She explained this was a replat and the developer wanted to
plat over several of the easements. She stated another issue which needed to
be resolved was that the plat was taking in land to the north of the existing
tract. She further stated the developer was purchasing land from the
Northwest Arkansas Mall but the sale had not been finalized. She advised that
issue needed to be resolved prior to taking the plat to the full Planning
Commission.
She advised the final issue dealt with fire flows and fire pressure but the
Fire Chief had determined that matter could be reviewed at the time of large
scale development.
In response to a question from Ms. Little, the developer advised they did not
know when the sale would be final.
Ms. Little stated the Mall would either need to join in the filing of the plat
or the plat would need to be held until the sale was finalized.
A representative for the Mall advised they might be able to send the City a
letter joining in the filing of the plat prior to the Planning Commission
meeting. He stated he would discuss it with Mr. Clary.
MOTION
Mr. Reynolds moved to forward the plat to the Planning Commission with staff
comments and all issues resolved.

TRISTATE JOINT VENTURE - W OF SHILOH, N OF JOYCE
The next item was a large scale development for the Northwest Arkansas Mall
presented by Kurt Jones, Northwest Engineers, on behalf of Tristate Joint Venture
for property located west of Shiloh and north of Joyce. The property is zoned
C-2, Thoroughfare Commercial, and contains 124.94 acres.
Ms. Little explained the plat covered an expansion for Northwest Arkansas Mall
which included a proposed building addition to the front (3 stories in height),
proposed addition to the existing Sears store, a proposed addition to the
existing Penny's store, and a demolition of a portion of the Penny's store. She
added the bank located to the front of the Mall would also be demolished.
She advised notification had not been made to the adjoining property owners so
this matter would have to be re -heard at the next Subdivision Committee meeting.
She further noted there were people from out-of-town present so staff had
believed it would be a benefit to hear their comments.
Ms. Little stated the developer would be filing an application for a street
vacation for Shiloh Drive to the north of the Mall. She further stated the
developer was requesting Shiloh Drive be blocked off to the south of Sheppard
Drive. She explained there was a letter in process to the Highway Department
requesting permission for a full signal at Sheppard Lane, allowing turns in and
out for both north and southbound traffic. She further stated there was also a
request for the opening of Georgetown Street for 71 southbound traffic only. She
explained the plat would have to be approved contingent upon the approval of the
Highway Department.
In response to a question from Mr. Reynolds, Ms. Little stated that, since Shiloh
Drive could not be extended any further to the north, staff was in favor of the
vacation.
There was discussion regarding the property immediately north of the Mall. Mr
Pilars advised the ownership of the property had been in question but they were
resolving the problem.
Ms. Little further advised there were a number of off-site improvements
requested. She noted city staff and the developer were currently in negotiation
and expected to reach a resolution in the near future.
Mr. Reynolds asked about the notation for a lighted monument sign shown on the
plat.
Ms. Little explained the developer would need to make application through the
Inspection department to the Board of Sign Appeals. She explained City Code
allowed one free-standing commercial sign per lot was allowed. She pointed out
the Mall was requesting a number of signs and a waiver from the Board of Sign
Appeals would be required.
There was also discussion regarding the extension of Joyce Boulevard. Me. Bunch
advised staff was currently working on the extension and was in negotiation with
adjoining property owners. She expressed hope the roadway would be complete
within the next year.
There was also discussion regarding the Highway Department improving access to
71 in the subject area. Ms. Little expressed her belief it would be a minimum
of five years before any improvements would be made by the Highway Department.

Mr. Jones advised they would be contacting SWEPCO regarding moving their easement
to the north. He explained there was already an Ozark easement and they wanted
the SWEPCO easement to run parallel in order to save a number of trees to the
north and west of the mall.

SIDEWALK WAIVER
ROBERT N. SCHMITT - 1278 OVERCREST
Ms. Little stated Mr. Robert Schmitt had requested a sidewalk waiver on his
property at the northwest corner of Overcrest and Old Wire Road. She explained
that, at the time the lot split for the subject property was approved,
construction of sidewalks was one of the conditions of approval. She further
stated she had reviewed the site and would recommend taking a Bill of Assurance
for the sidewalk along Old Wire Road.
MOTION
Mr. Reynolds moved to grant a Bill of Assurance for the sidewalk.
Mr. Pummill seconded the motion.

Mr. Conklin advised this matter had been reviewed at the last Subdivision
Committee meeting but proper notification had not been given to adjoining
property owners so it would need to be reviewed again.
Mr. Nickle pointed out it appeared there would be significant fill to the west
of the existing Mall.
Mr. Jones stated it was not as significant as it appeared. He explained the
lower level of the mall- would be at 1261 and the parking area would be a 2% slope
below the mall.
Mr. Pilarz, Mall manager, explained the first floor would be even with the
parking lot and the second floor was the existing mall level.
In response to a question from Mr. Nickle, Mr. Jones stated they would have to
get some fill from off-site.
Mr. Nickle advised the grading plan did require a number of conditions from the
developer when filling a site.
Mr. Jones stated they would be preparing a complete grading plan and drainage
report.
Ms. Bunch stated a preliminary drainage report had been submitted and there were
no major changes to existing drainage.
There was further discussion regarding traffic flow for the mall and the
developer assured the Commission there would be better flow than currently
existed, explaining the new configuration of the roads.
Ms. Bunch advised there had been numerous meetings between Mall staff, Clary
Development, the City and the State Highway Department. She stated those
negotiations were still in progress.

SIDEWALK WAIVER - NOAH ROBERTS
HIGHWAY 16 & ED EDWARDS,ROAD
Mr. Roberts explained his realtor was also supposed to be present with a plat of
the tract but had, apparently been detained. He advised the Planning Commission
had approved a lot split earlier in the year for Samantha Neal. He explained
that, in order for the split to be approved, a sidewalk had been required along
Highway 16.
In response to a question from Mr. Suchecki, Mr. Roberts stated there were no
sidewalks on either side of Highway 16 at that location. He further stated there
were no sidewalks along Highway 16 to the east of Watson's Grocery Store.
Mr. Conklin advised that on February 17, 1994 the Commission had denied the
sidewalk waiver. He pointed out homes were being constructed in Sequoyah Meadows
which was not very far from this tract.
MOTION
Mr. Nickle moved to grant a Bill of Assurance for the construction of the
sidewalk.
Mr. Suchecki seconded the motion.
