MINUTES OF A SUBDIVISION COMMITTEE MEETING
A meeting of the Fayetteville Subdivision Committee was held on Thursday, July 1, 1993
at 10:30 a.m , in Room 111 of the City Administration Building, 113 West Mountain
Street, Fayetteville, Arkansas.
MEMBERS PRESENT: Jerry Allred, Kenneth Pummill, and Bob Reynolds
OTHERS PRESENT: Tim Conklin, Don Bunn, Murphy Hartshorn, Robert
Brown, Dave Jorgensen, Robert Eoff
FINAL PLAT - SPRING PARK SUBDIVISION, PHASE II, LOTS 4, 6, 8, & 11
CLARY DEVELOPMENT CORPORATION - W. OF SHILOH, ON JOYCE BLVD.
The first item was a request for approval of a final plat for Spring Park Subdivision, Phase 11,
Lots 4, 6, 8, & 11, presented by Robert Brown, Development Consultants, Inc., on behalf of
Clary Development Corporation, for property located west of Shiloh on Joyce Blvd. The
property is zoned C-2, Thoroughfare Commercial, and contains 45.70 acres
Mr. Conklin noted sidewalks would be on both side of Joyce Boulevard with the extension to
the west. He stated the sidewalk crossings had to meet ADA (handicap) requirements and be
set back five feet from the curb.
Mr. Brown noted a small cluster of trees were present on the western area of the development
and several scattered trees throughout the rest of the acres. He stated a 40 foot utility
easement was present in the western area mentioned.
Mr. Conklin explained that with the site being a final plat and a commercial development,
the Tree Ordinance requirements did not apply. He noted that since the preliminary plat was
approved, changes were not made at the final plat stage.
Mr. Brown stated it was obvious this site would have large scale developments, and tree
preservation and design would most likely be left up to individual developers.
Mr. Bunn explained the city would have to participate in the cost of the Joyce Boulevard
extension which would consist of at least four lanes and eventually tie into Gregg Street.
Mr. Brown explained the next step was to prepare estimates for quantity and costs for Mr.
Bunn to approve. He advised funds would be escrowed for construction of a two-lane road,
with curb, gutter, and drainage. He stated the city's cost in the future would be for the
additional two -lanes.
In response to a question from Mr. Reynolds, Mr. Brown stated a wetlands survey had been
conducted on site and the ponds surveyed did not fall under federal guidelines and regulation
and therefore were drained.

Mr. Brown explained along with the final plat a separate application had been filed to vacate
a portion of Mall Lane Avenue right-of-way. He stated this was shown on the preliminary
plat and would be one of the primary entrance ways and private access drive into the
development. He also stated the street width would be maintained. He noted they had
requested vacation of easements that were part of the original lot 5.
Mr. Bunn stated when future large scale developments came through in the future, any need
for additional easements or modifications will be provided for at that time.
In response to a question from Mr. Brown, Mr. Conklin noted the Tree Ordinance would
apply to all large scale developments on site which would require additional Planning
Commission approval He stated for C-2 zoned development, 15% of the tree canopy area
would need to be preserved.
MOTION
Mr. Pummill moved to forward the plat to the full Planning Commission subject to staff
comments.
Mr. Reynolds seconded the motion.

PRELIMINARY PLAT - WILLOW SPRINGS ADDITION
RALPH WALKER- N. OF WEDINGTON, W. OF RUPPLE RD.
The next item was a preliminary plat for Willow Springs Addition presented by Dave
Jorgensen on behalf of Ralph Walker, for property located north of Wedington and west of
Rupple Road. The property is zoned R-1.5, Moderate Density Residential, and R-2, Medium
Density Residential, and contains 15.25 acres with 68 proposed lots (Single Family Homes).
There was discussion regarding the accesses to the site. Mr. Conklin noted on the previous
concept plat, access was shown through Mr. Randell Barnes' property and from Fransician
Trail. The Committee discussed changes made in the original concept plat and decided the
new concept plat, showing additional access to Highway 16, was an improvement. The
Committee requested a stub -out to be shown on concept plat to provide access to Carriage
Way.
Mr. Bunn requested that access to Highway 16 be shown as dedicated right-of-way on the
plat and not as an access easement. He also requested that the use be noted on the plat.
Mr. Jorgensen stated some trees were present along the fence line and in the northern portion
of the site.
Mr. Conklin stated the trees needed to be indicated on the plat and a Tree Preservation
provided.
There was discussion regarding the capability of the existing sewer line. Mr Jorgensen
explained the present 6 inch sewer line would reach its' capability at a point not too far after
the development project.
MOTION
Mr. Reynolds moved to forward the plat to the full Planning Commission together with staff
comments.
Mr. Pummill seconded the motion.

FINAL PLAT - NORTHWEST ACRES, PHASE IV
DR. JAMES MOORE - N. OF WEDINGTON, W. OF RUPPLE
The next item was a final plat for Northwest Acres, Phase IV, presented by Dave Jorgensen
on behalf of Dr. James Moore for property located north of Wedington Drive, west of Rupple
Rd. The property is zoned R-1.5, Moderate Density Residential, and contains 10 acres with
23 proposed lots.
In response to a question from Mr. Conklin, Mr. Jorgensen stated the pond near lot 22 had
been filled. He noted there was no spring present, just bedrock, under the pond. He also
noted the developer to the east wanted the pond filled.
MOTION
Mr. Pummill moved to forward the plat to the full Planning Commission together with staff
comments.
Mr. Reynolds seconded the motion.

WAIVER TO SUBDIVISION REGULATIONS - SIDEWALKS
ROBERT C. EOFF (EOFF & CO.) - 600 E. HUNTSVILLE RD
The final item was waiver to subdivision regulations for a sidewalk. The property is located
at 600 E Huntsville Rd.
Mr. Conklin explained Mr. Eoff had applied for a building permit for a residential repair and
remodel. The location for which the building permit was applied for required a sidewalk
along Huntsville Rd. and Mashburn. He stated there was a sidewalk present on Mashburn,
but not on Huntsville. He explained for the building permit to be issued, Mr. Eoff had to
agree to put in a sidewalk along Huntsville Rd.
Mr. Eoff stated that it would not have been economically possible or practical to install a
sidewalk on Huntsville Road. He noted the State Highway Department had placed a
drainage culvert and a step pyramided embankment along Huntsville. He explained if a
sidewalk was installed, it would be difficult for water to drain properly from the house. He
stated no one could benefit from just one short piece of sidewalk.
Mr. Reynolds stated if a sidewalk was installed, it could possibly lead to other neighbors
• installing sidewalks along the way.

Mr. Pummill stated nothing was accomplished with putting in bits and pieces of sidewalks
here and there.
Mr. Allred explained any new subdivision should be required to have sidewalks, not existing
residences that need repairing and remodeling.
There was discussion on the installations, the placements, and the continuity of sidewalks
around the city regarding existing and new structures.
Mr. Conklin noted this subject could be put on the agenda and discussed while the
ordinances were being updated.
Mr. Allred stated caution should be used when granting sidewalk variances. He stated there
was no point in placing a burden on Mr. Eoff, when there was no thought of tying in the
sidewalks. He also stated the city should cooperate with lower income developments.
Mr. Reynolds explained the front part of the lot should be cleaned up and bushes trimmed
backed from obstructing the view of the drivers on Mashburn.
