HomeMy WebLinkAbout1991-10-31 - Minutes• MINUTES OF A SUBDIVISION COMMITTEE MEETING A meeting of the Fayetteville Subdivision Committee was held on Thursday, October 31, 1991 at 10:30 a.m., in Room 111 of the City Administration Building, 113 West Mountain Street, Fayetteville, Arkansas. • MEMBERS PRESENT: MEMBERS ABSENT: OTHERS PRESENT: • Joe Tarvin and Jana Britton Charles Nickle Becky Bryant, Sharon Langley, Jim Cybert, Jim Phillips, Glenn Woodruff, Kim Fugitt, and Al Harris PRELIMINARY PLAT - RIDGEWOOD SUBDIVISION JIM PHILLIPS & RICK ROBLEE - E OF OLD MISSOURI, S OF ZION The first item on the agenda was a request for approval of a preliminary plat for Ridgewood Subdivision presented by Jim Phillips and Jim Cybert for property located east of Old Missouri Road and south of Zion Road. The property consists of 26.59 acres with 16 proposed lots. The property is zoned A-1. Mr. Cybert explained he was present to represent his son-in-law, Rick Roblee. Ms. Bryant stated they had not corrected the legal description nor had they provided access to lots 8 or 9, leaving them as tandem lots. Ms.Britton noted there was no reason for the tandem lots since there was not a terrain problem. She pointed out, however, that the cul-de-sac was already 500 feet long. Ms. Bryant explained the ordinance provided that in new subdivisions tandem lots were prohibited unless the developer could prove that the terrain justified such lots. • Ms. Britton stated the right-of-way needed to go all the way to the end so that at some future date another development could connect to it. • Ms. Bryant pointed out the lots were very large and there would not actually be that many vehicles on the cul-de-sac. She stated the lot sizes might mitigate the problem with a long cul-de-sac. The committee then discussed various streets giving ingress and egress to the area. Ms. Bryant stated that she and Don Bunn had revisited the site and felt that Stearns should be extended along the south border. • Subdivision Committee April 14, 1'991 1c -31A1 Page 2 Mr. Cybert stated that was too much of a burden for the subject tract to carry. He explained he believed the best access to the property to the east was from Joyce Street not from Stearns. He stated he believed it was arbitrary and capricious for them to request a road from Highway 265 over the mountain, down the hill, • through Stearns over to Highway 71. He stated that, with two through streets already in the vicinity (Zion Road and Joyce Street), the construction of a third (Stearns) was too much of a burden for the property. • • Ms. Bryant explained they had to have circulation throughout the city, otherwise they would be forcing too much traffic on certain streets. Mr. Tarvin pointed out the fire chief had requested the right-of- way to the tandem lots be paved 50 feet wide. He explained that it would be cheaper to run the cul-de-sac up to lots 8 and 9. He stated the Planning Commission would have to approve the extended cul-de-sac. He stated his second point was that, if they ran Stearns Street to the south of the subject property, there should be very little impact on the subdivision. Mr. Cybert stated he believed this subdivision could be an attractive subdivision and a good tax base, but when they started putting concrete all over it, it would spoil it. He further stated the property to the east, owned by Dr. Rudko, would also be developed in the near future into large lots. Mr. Tarvin stated they were not only talking about carrying traffic from the subdivisions but also about another east -west connection between Highways 265 and 71. Mr. Cybert explained that the only place to come off 265, using their plan, was the crest of a hill. He further explained that below the hill, to the south was Joyce Street and Zion Road to the north. He also pointed out that the street would have to turn to go around approximately 110 apartment units. In response to a question from Ms. Bryant, Mr. Phillips stated that, if they were required to make the suggested changes, they would probably not do the subdivision. Ms. Bryant explained they could present their requests to the Planning Commission. She further explained that, even if they just split the subject property into two lots, the city could by eminent domain take a portion of the land on the south for Stearns Street. • Mr. Phillips also noted that, should they not subdivide the property, they would not want the zoning change from A-1 to R-1. • Subdivision Committee 41=1U -44 -7 -1 -9 -9 -1 - Page 991 Page 3 MOTION Ms. Britton moved to not approve the preliminary plat as it stood. Mr. Tarvin seconded the motion. • LARGE SCALE DEVELOPMENT - McILROY BANK GLEN WOODRUFF - SE CORNER OF STEARNS & JOYCE • • • The next item to be reviewed by the Subdivision Committee was a request for approval of a Large Scale Development for Mcllroy Bank to be located at the southeast corner of Stearns and Joyce, presented by Glen Woodruff. The property contains approximately 1.26 acres and is zoned C-2. Mr. Woodruff stated several changes had been requested at the plat review and he believed they were all reflected in the revised plat. He explained one was a sidewalk on Joyce Street and they were showing the sidewalk on the portion of their property which abutted Joyce. He pointed out the property owned by the City and stated the bank would like to landscape and maintain that property. Ms. Britton stated that, they needed to be sure the landscaping did not cause visibility problems. Mr. Woodruff stated there had also been discussion regarding 30 feet between the curb cuts which caused a design problem because they would like the customers to drive straight through. Ms. Bryant checked the code and found the curb cuts only needed to be 25 feet apart. It was determined there could be three ingress/egress points. Mr. Woodruff stated there had also been concern that the ATM was only four car lengths off of Joyce Street. They had moved the ATM up so there was now five car lengths between it and the street. Ms. Bryant stated they had done a great job in accommodating the requests made at the plat review meeting. Mr. Woodruff stated there was one other problem with an easement requested by telephone company but they would work that out. Ms. Britton explained that had to be worked out with the phone company before the development could be approved. Ms. Bryant stated they would need a letter from the telephone company approving the change of easement. • Subdivision Committee nom_„ 1Q01 10„31-ql Page 4 • • MOTION Mr. Tarvin moved to recommend the large scale development be approved. Ms. Britton seconded the motion. Ms. Bryant left the meeting. PRELIMINARY PLAT - SEQUOYAH MEADOWS SUBDIVISION C. W. COMBS - S OF HUNTSVILLE, W OF ED EDWARDS RD. The next item to be reviewed was a request for approval of a preliminary plat for Sequoyah Meadows Subdivision, located south of Huntsville and west of Ed Edwards Road. Mr. Al Harris appeared representing C. W. Combs. The property consists of 47 acres with 99 lots proposed, and is zoned R-1. Ms. Britton stated the street named Tallgrass Drive was too long of a route without a break. She explained that, while the other property was not in the city limits now, there should be some right-of-ways along the strip to provide access for the future. She suggested as an alternative that the cul-de-sac (Milo Way) be brought all the way through. She further stated she did not like the tandem lots. Mr. Harris explained the basis for the tandem lots was in order to keep the lake. After discussion, it was suggested that two points of right-of-way needed to be dedicated (one to the east and one to the west) off of Tallgrass Drive between the entrance and the curve, that a side outlet to the east from Fescue Court, dedication of right-of-way to the north property line of Fescue Court, and the cul-de-sac being extended to the proposed tandem low, a cul-de-sac to come in off of Tallgrass Drive to access tandem lot 86. MOTION • Mr. Tarvin moved to recommend the plat for approval to the Planning Commission with the suggested changes. • Ms. Britton seconded the motion. The final item to be reviewed by the subdivision committee was a preliminary plat for Pine Haven Addition, requested by Al Harris on behalf of Gordon Wilkins for property located east of Azalea Terrace and south of Old Wire Road. The property contains 1.25 acres with four lots being proposed. The property is zoned R-1. Ms. Britton stated she was concerned that eventually the owners of the lots would ask for lot splits on all four lots. Mr. Harris explained all utilities and streets were in. Ms. Britton suggested bringing a cul-de-sac into the center, making the lots not so long and more square. Mr. Tarvin agreed that it would be a much more attractive development. Ms. Britton stated they could probably even get five or six lots instead of the four if they put in a cul-de-sac. Mr. Tarvin suggested they send the plat to the Planning Commission with no recommendation. Ms. Britton agreed. Mr. Tarvin asked at what point the city got involved in deciding how something should be developed. Ms. Britton stated there was also the possibility the owner would come back in and ask for R-2 for multi -family housing. The meeting adjourned at 11:45 a.m.
