HomeMy WebLinkAbout1991-05-16 - Minutes• • • MINUTES OF A SUBDIVISION COMMITTEE MEETING A meeting of the Fayetteville Subdivision Committee was held on Thursday, May 16, 1991 at 9:00 a.m., in Room 111 of the City Administration Building, 113 West Mountain Street, Fayetteville, Arkansas. MEMBERS PRESENT: MEMBERS ABSENT: OTHERS PRESENT: Joe Tarvin and Jack Cleghorn Charles Nickle Don Bunn, Sharon Langley, Kirby Walker, Tom Hooper, Dave Jorgenson Rick Simmons, and Don Nelms LARGE SCALE DEVELOPMENT - KIRBY'S RESTAURANT KIRBY WALKER - E OF FRONT ST, N OF SAIN The first item reviewed by the Committee was a request for large scale development for Kirby's Restaurant to be located east of Front Street and north of Sain. The property contains 1.98 acres and is zoned C-2, Thoroughfare Commercial. In response to a question from Mr. Tarvin regarding flooding, Tom Hooper explained when the basin had been re -graded it had been based on the FEMA flood plain. He further explained the lots splits that had been submitted, which contained the subject property, set the minimum elevation at 11.99, two feet above the 100 year flood plain. He further stated it had been submitted to FEMA and it had been approved. Mr. Bunn stated he had no additional comments except those mentioned in plat review. Mr. Hooper stated the developer was concerned regarding the 15 foot easement along the lot line. He requested an opportunity to review that again. Mr. Bunn stated Mr. Hooper would need to review the matter with the utility companies before the Planning Commission Meeting. He explained that, if the utility companies would agree to modify the easements, the city would agree. MOTION Mr. Cleghorn moved to recommend approval of the large scale development. Mr. Tarvin seconded the motion. III Subdivision Committee May 16, 1991 Page 2 FINAL PLAT - BROOKHOLLOW SUBDIVISION, PHASE III JERRY SWEETZER - S. OF ZION RD., W OF OLD MISSOURI RD The next item to be considered was a final plat for Brookhollow Subdivision, Phase III, located south of Zion Road and west of Old Missouri Road. The property is owned by Jerry Sweetzer, zoned R-2, Medium Density Residential, and consists of 5.81 acres to be divided into 19 lots. Mr. Dave Jorgenson, representing Jerry Sweetzer, stated the changes requested at plat review had been completed. He pointed out the 25 foot setback was now also a utility easement along the south side of Frazier, there was now a 15 foot easement instead of 10 feet between lots 6 and 8 and also between lots 17 and 18, and a 15 foot utility easement between lots 10 and 13 running east and west. Mr. Tarvin stated he had noted the property was zoned R-2; however, was being developed as R-1. He asked if the demand for housing was the reason the property was being developed as R-1. Mr. Jorgenson stated he believed the developer had elected to develop it as R-1 in keeping with adjoining property. He further • explained that ERC had made an agreement with the Mr. Sweetzer that, if he developed the land, they would buy it. • Mr. Bunn explained there were many areas that had been zoned R-2 and had been developed as single family housing. He pointed out that an advantage of R-2 zoning was that the frontage requirements were less than in R-1, allowing a few more lots. Mr. Tarvin stated he did not care for the location of lots 10 and 11 with the access easement between lots 12 and 13. Mr. Jorgensen stated they had made a request to the Board of Adjustment to reduce the access easement to 15 feet from each lot but their request had been denied. Mr. Tarvin stated he believed the reason for the location of lots 10 and 11 was in order to avoid a street and a cul-de-sac, which would eliminate one lot. He explained that, under R-2 zoning, the lot could have been gained back by making the frontages smaller. Mr. Bunn stated Mr. Jorgenson needed to check the setback requirements for tandem lots and show them on the plat. MOTION Mr. Tarvin moved to recommend approval of the final plat. COLLEGE The next item to be heard was a large scale development for a drive-in bank for Mcllroy Bank to be located at 1947 N. College. The property consists of 1.15 acres, with C-2, Thoroughfare Commercial, zoning. Mr. Don Bunn explained this item became a large scale development because of the parking requirements and additional access. There was discussion regarding removal of trees. Mr. Rick Simmons, representing Kim Fugitt, stated the only trees being removed were in the parking area. He pointed out on the plat the trees that would remain. MOTION Mr. Cleghorn moved to recommend approval of the large scale development. Mr. Tarvin seconded the motion. LARGE SCALE DEVELOPMENT - DON'S WHOLESALE CAR SALES DON NELMS - W OF COLLEGE, N OF TOWNSHIP The last item to be reviewed was a large scale development for Don's Wholesale Used cars, located to the west of College and on the north side of Township, presented by Don Nelms. The property consists of 1.74 acres and is zoned C-2, Thoroughfare Commercial. In response to a question from Mr. Tarvin, Mr. Bunn pointed out the requested easements. Mr. Cleghorn questioned when the state would be widening the roadway. He expressed concern that the project would be completed and then the state would require parts of it to be torn out. Mr. Nelms stated that would not be a problem because he was locating the buildings back from the right-of-way. Mr. Bunn stated it was always possible the state would request additional right-of-way, but he doubted they would in this case since there appeared to be sufficient right-of-way. Mr. Nelms discussed the proposed explained the front would be graded feet, solving drainage out into the topography of the lot.
