MINUTES OF THE SUBDIVISION COMMITTEE
OF THE FAYETTEVILLE PLANNING COMMISSION
A meeting of the Subdivision Committee of the Fayetteville Planning
Commission was held on Thursday, November 29, 1990 at 10.30 a.m. in
Room 111 ofthe City Administration Building, 113 West Mountain
Street, Fayetteville, Arkansas.

XPRELIMINARY PLAT OF ZION PLACE SUBDIVISION
JOHN LARGENT - OUTSIDE CITY LIMITS(W.C. 87)
The first item was a preliminary plat of Zion Place Subdivision
submitted by John Largent and represented by Milholland Engineers
for property located outside city limits(W.C. 87). The property
contains 80 acres with 16 proposed lots.
Jeff Staggs of Milholland Engineers was present at the meeting.
Vice -Chair Springborn stated that there didn't seem to be any
problems with this development at the Plat Review meeting.
Commissioner Nickle stated that he had noted that there isn't a
fire hydrant located anywhere near this. Mr. Staggs stated that
Mr. Milholland had suggested to the owner that a fire hydrant be
put in.
Archie Knight, who owns property north of the subject property,
stated that he is concerned about whether or not his property would
be taken in to Fayetteville or Springdale City Limits. Mr. Bunn
advised that this subdivision is partly in the Fayetteville growth
area, but the property to the north isn't. He added that the
approval of this doesn't mean anything as far as what the City of
Fayetteville will eventually take in to the City Limits. He noted
that the City of Fayetteville doesn't have any claim on property
north of this subdivision. The property to the east is partly in
the growth area. He added that the City of Fayetteville doesn't
have any plans as a part of this development to annex anything.
Although, there is a future possibility of annexation of the growth
area.
• Mr. Knight asked if water and a fire hydrant will be put in this
development. Mr. Bunn stated that the water will come off of the
36' line on County Road 543. He added that there isn't a city

requirement that fire hydrants be placed outside the city. He
noted that the staff has suggested that putting in a fire hydrant
would be advisable.
Commissioner Nickle noted that, the Fire Chief had recommended that
a 6" water line be put in off of the 36" line for a fire hydrant.
Mr. Knight advised that several acres of this land near of the
creek is under water each time it rains. He noted that they
would need a drainage system for any houses built here. In
answer to a question from Mr. Bunn, Mr. Staggs stated that this
isn't in the flood plain.
Mr. Knight noted that there has been a property dispute over the
location of his back property line between his property and the
property west of it because of a survey done by Milholland
Engineers. Commissioner Nickle advised that the property line
dispute that was mentioned wouldn't have any bearing on this
proposed development.

Commissioner Nickle stated that it seems the drainage problems
to be addressed before any recommendation is made.

Vice -Chairman Springborn agreed that they would not feel
comfortable making a recommendation until the drainage is looked
into. He explained that the city growth area is outside the city
• limits and is considered a growth area for the City for possible
annexation in the future. However, at the present time, there
are no plans to take any of that area in.

Mr. Bunn noted that the City isn't planning any annexations of
growth area property at this time and have no claims on property
lying outside the growth area.
Mr. Burge, who owns property close by, was present but didn't have
any comments.
Commissioner Nickle stated that they will not be making a
recommendation to the Planning Commission at this time.
Mr. Bunn advised the audience that this plat will be considered at
the Planning Commission meeting.

FINAL PLAT OF AARON SUBDIVISION
DUB DUNAWAY - NW CORNER OF HUNTSVILLE & CHERRY
The second item was a final plat of Aaron Subdivision submitted by
Dub Dunaway and represented by Dave Jorgensen of Jorgensen &
Associates. The property contains 1.34 acres with five proposed
lots and zoned R-1, Low Density Residential.
Mr. Jorgensen stated that they first attempted to submit this
development as lot splits, but was advised that it would need to be
submitted as a subdivision. He added that they would be giving a
lien on some of the lots in the amount of the cost of on-site
improvements which need to be made if those improvements aren't
finished by the time they begin development.

In answer to a question from Commissioner Nickle, Mr. Bunn advised
that they will need to provide some surety for the off-site
improvements that are required as well.
MOTION
Commissioner Nickle moved to recommend approval of this final plat
• subject to the staff's comments, seconded by Springborn. The
motion passed 2-0-0.

X STEVE & DONNA COMBS - W OF DOUBLE SPS RD, S OF WEDINGTON DR
\The third item was a final plat of Double Springs Estates submitted
by Milholland Engineers on behalf of Steve & Donna Combs for
• property located west of Double Springs Road and south of Wedington
Drive. The property is located outside the City Limits and
contains 10 acres with four proposed lots.
Commissioner Nickle asked if there is a fire hydrant in this area.
Mr. Bunn advised that there wasn't and it is the City's policy not
to allow fire hydrants to be placed on any water line under 6".
MOTION
Commissioner Nickle moved to recommend approval of this final plat,
seconded by Springborn. The motion passed 2-0-0.
PRELIMINARY PLAT OF DOUBLETREE ESTATES
LESLIE HOWELL - MT COMFORT RD (W.C. 84)
The fourth item was a preliminary plat of Doubletree Estates
submitted by Leslie Howell and represented by John Mahaffey of

Mahaffey Engineers or property located on Mt. Comfort Road(W.C. 84)
for property containing 23.09 acres with 10 proposed lots.

In answer to a question from Commissioner Nickle, Mr. Mahaffey
stated that there is an existing residence on the property. In
answer to a question from Vice -Chair Springborn, Mr. Mahaffey
advised that they changed the plat to reflect two streets names
instead of just one, even though the County had requested that they
change it to one name.
Elaine Cattaneo, City Planning Secretary, advised that she had
spoken with Jim Johnson of the Water Meter Division who had stated
that he would prefer two street names. She added that she would
check with them to make sure "Doubletree Drive" doesn't duplicate
an existing street name.
In answer to question from Commissioner Nickle, Mr. Bunn stated
that since this in outside the City Limits the City doesn't have
the authority to require improvements on the existing street. He
advised that this has been approved by the County. He added that
the City Limits line is between sections 31 & 32.
Mr. Mahaffey advised that the County has approved the preliminary
plat and were only waiting on the soil tests which they now have.
• Vice -Chairman Springborn advised that as a consequence of the last
few Planning Commission meetings, he suggested that they include a
provision in their deed restrictions or covenants that no lot
splits on these lots could be taken before the Planning Commission.
He noted that in some older area of the City Limits where big lots
were originally platted, there have been requests before the
Planning Commission for lot splits. A lot of neighbors have been
concerned about this. The Planning Commission can't consider
• contracts(covenants) between individual land owners within a
subdivision. However, it might be worded in such a fashion that
no one could bring a lot split before the Planning Commission
without the approval of the neighbors which would help secure the
size of the lots they are proposing now.

Mr. Howell advised that they have already put a provision in the
covenants that no lot splits will be allowed. Vice -Chair
Springborn advised that provision on its own wouldn't stop someone
from bringing a lot split application on these lots before the
Planning Commission. Mr. Howell stated that he would consider
that idea.
Mr. Howell advised that there are some houses being built only
about 10' away from the road right-of-way in this area. He noted
that he realizes that no building permits are required outside the
city, but it seems that there should be a minimum setback from a
County Road in the growth area. Mr. Bunn advised that he can
control that within his subdivision through the covenants, but he

should take that problem up with the County because the city
doesn't have the power to control it.
MOTION
Commissioner Nickle moved to recommend approval of the preliminary
plat, seconded by Springborn. The motion passed 2-0-0.
There being no further business, the meeting was adjourned.
