OF THE FAYETTEVILLE PLANNING COMMISSION
A meeting of the Subdivision Committee of the Fayetteville Planning
Commission was held on Thursday, November 15, 1990 at 10.30 a.m. in
Room 111 of the City Administration Building, 113 West Mountain
Street, Fayetteville, Arkansas.

LARGE SCALE DEVELOPMENT PLAN FOR UNIVERSITY BAPTIST CHURCH
GARY CARNAHAN - 315 WEST MAPLE AVENUE
The first item was a large scale development plan for a youth
building at University Baptist Church for property located at 315
West Maple. This property is zoned R -O, Residential -Office.
Chairman Tarvin stated that there didn't seem to be any problems
brought up at the Plat Review except the parking issue.
Becky Bryant, Associate Planner, advised that the staff had
obtained a list of the different uses and the square footage from
the church and had determined that the parking is more than
adequate. In addition to the parking, the church had some
incorrect information from a report that some consultants had done.
They thought that the zoning was R-3 but it is actually R -O.
Therefore, the correct side setback requirement is 10' and 30' from
the street, so they don't have any problems with setbacks. She
noted that the church has filed a conditional use application for
their expansion, which will be reviewed at the same Planning
Commission meeting as the development.
Chairman Tarvin stated that they would have another option to
request a rezoning to P-1, Institutional. Danny Wright,
representing the church, stated that it had been brought to their
attention that none of the church property has ever been granted a
conditional use, so they might request a rezoning at some point in
the future.
Ms. Bryant stated that if they have any revisions, they need to
submit thirteen revised plats. If there are no revisions, they
need to submit six more copies of the latest plat.

MOTION
Commissioner Nickle moved to recommend approval of the large scale
development plan, seconded by Tarvin. The motion to approve passed
2-0-0.
LARGE SCALE DEVELOPMENT PLAN FOR OFFICE AND WAREHOUSE
PAT PINNELL - S OF 6TH STREET, E OF BEECHWOOD AVENUE
The second item was a large scale development plan for office and
warehouse submitted by Pat Pinnell and represented by Neal
Albright, engineer, for property located south of 6th Street and
east of Beechwood Avenue and zoned I-1, Light Industrial & Heavy
Commercial.
In answer to a question from Chairman Tarvin, Mr. Albright stated
that the issue of the discrepancy in the survey on the north
property line is being resolved. It appears that the property line
will be moved to the south by 10' to the existing fence line.
Therefore, the building will shift 10' to the south.
Becky Bryant asked how they will have enough room to access the
parking if the property line is shifted 10' to the south. Mr.
Albright stated that they are in the process of making an agreement
with the people to the south to purchase 10' on that side. He
noted that will be taken care of before the Planning Commission
meets. He added that he will revise his plan to show eighteen
spaces. Also, there is a fire hydrant near the southwest corner
of the property, which is less than 200' from the farthest corner
of the building, and will comply with the requirements.
In answer to a question from Chairman Tarvin, Mr. Albright stated
that the proposed use of the building is for Mr. Pinnell's
contracting business. Later on, the use might change but he will
make the modifications as necessary at that time.
Ms. Bryant stated that she had checked with John Merrell, Planning
Management Director, regarding whether the access to the trash
dumpster would need to be paved. He stated that it would need to
be paved.
In answer to a question from Mr. Albright, Commissioner Nickle
stated that they would be required to pave the minimum sufficient
for the trucks to go in, pick up, and turnaround without the
potential of getting stuck in wet weather.
Mr. Albright stated that Mr. Pinnell doesn't have any definite
plans for the back of the property as of yet, but they will satisfy
whatever is needed to make the turnaround for the dumpster. In

Mr. Pinnell doesn't have any plans to fence the property.
MOTION
Commissioner Nickle moved to recommend approval of this large scale
development subject to the staff comments and Plat Review comments
specifically those concerning adequate access to the dumpster and
the issue of the 10' off the north boundary being resolved,
seconded by Tarvin. The motion passed 2-0-0.
Ms. Bryant advised that they will need to submit twelve revised
plats by Monday.
YPRELIMINARY PLAT OF BROOKHOLLOW - PHASE III
JERRY SWEETSER - N OF JOYCE ST, W OF OLD MISSOURI RD
The third item was a preliminary plat of Brookhollow - Phase III
submitted by Jerry Sweetser and represented by Dave Jorgensen of
Jorgensen & Associates for property located on the north side of
Joyce Street and west of Old Missouri Road. The property is zoned
R-2, Medium Density Residential.
Becky Bryant stated that the staff has no problems except the
tandem lot question. The 25' tandem lot access width can not be
waived. It is not part of the Subdivision Regulations.
Mr. Jorgensen stated that the developer would like to request a
waiver of this access width to be allowed 15' for each lot instead
of 25'.
In answer to a question from Chairman Tarvin, Mr. Jorgensen stated
that this isn't in a 100 year flood zone. He added that he did
size the drainage structure that goes under Frazier Terrace to
accommodate the flows that occur from the north. In fact, the
plans on this have already been approved and sent to the Health
Department. He noted that Mr. Sweetser was approached with a
offer by ERC Properties who builds the type of houses that need to
have smaller lots which is the reason for the re -submittal. He
added that hehasadded a note on the plat that the usage is going
to be single-family.
Mr. Jorgensen stated that the possibility that they may have to
name the private street going back to the tandem lots had been
brought up at the Plat Review meeting. However, he contacted the
Water Meter Division who didn't insist upon it being named at this
particular point. They wanted to wait and see how it will turn
out. Also, they stated that a name wasn't needed on the cul-de-
sac.
