MINUTES OF THE SUBDIVISION COMMITTEE
OF THE FAYETTEVILLE PLANNING COMMISSION
A meeting of the Subdivision Committee of the Fayetteville Planning
Commission was held on Thursday, October 11, 1990 at 10.30 a.m. in
Room 111 of the City Administration Building, 113 West Mountain
Street, Fayetteville, Arkansas.
MEMBERS PRESENT: Charles Nickle and J.E.
Springborn
MEMBERS ABSENT: Joe Tarvin and Jack Cleghorn
OTHERS PRESENT: Sid Norbash, Dave Jorgensen, Dub Dunaway and
Doug Hemingway
PRELIMINARY PLAT OF NORTH POINT SUBDIVISION
MCILROY BANK AND TRUST - N OF HALL AVENUE, E OF HWY 71 BYPASS
The first item was a preliminary plat of North Point Subdivision
submitted by Doug Hemingway of Hemingway & Associates on behalf of
Mcllroy Bank and Trust for property located north of Hall Avenue
and east of the Highway 71 Bypass. The property is zoned C-2,
Thoroughfare Commercial, containing 5.82 acres with eight proposed
lots.
Commissioner Springborn stated that a note is needed on the plat as
to what areas are wooded. He added that there isn't an easement
shown on the street along the east side. The telephone company
representative noted that it is acceptable to locate the line in
the street. However, they can dig up the street to make repairs.
Mr. Hemingway stated that the telephone line is 4 or 5' east of the
fence and the curb of the street will be 9.5' to the west of the
fence. Therefore, there will be at least 10' between the curb and
the telephone line.
Commissioner Nickle clarified that the 50' shown is for the street
right-of-way, but the pavement will only be 31' back-to-back.
Commissioner Springborn advised that Ozarks Electric requested a
15' easement between lots 4 & 5. Mr. Hemingway stated that they
have given that easement.
Commissioner Springborn asked if they have approval from the
Highway Department for the entrance to Highway 112. Mr. Hemingway
stated that he has contacted them and sent a plat for their review.
He added that the Highway Department representative, Mr. Walker,
will be meeting with him by next week to look at this.
Mr. Hemingway stated that they have changed the street name from

"North Point Circle" to "Point Circle" which has been approved by
the Water Meter Division. That representative stated that he
didn't have a problem with the name of the subdivision.
Mr. Hemingway advised that there are two existing fire hydrants:
1) one by the Custom Embroidery property to the south, and 2) one
at the north corner of the property. They will be installing a
third one at the corner of Lot 3.
Commissioner Nickle asked about the 5' water line easement. Mr.
Hemingway stated that with the sidewalk going in next to the curb
on the west side of the road, they will only have 4.5' to the
right-of-way. If they put the water line on the right-of-way,
there would be 9.5' for an easement. Sid Norbash, Assistant
City Engineer, stated that it should be at least 10'. He noted
that the sidewalk could be built in the easement. Mr. Hemingway
stated that they have been allowed the 5' from the sidewalk before
in another subdivision. Commissioner Nickle stated that he would
be interested in hearing the City Engineer's comments on this.
Commissioner Nickle stated that would like to see the sidewalk
butted up against the right-of-way with the water line on the other
• side of that.
Mr. Hemingway stated that they could provide whatever width is
needed.

In answer to a question from Commissioner Nickle, Mr. Hemingway
stated that the City Engineer was requesting the water line to be
put in front because of the water meters. He was suggesting that
they could talk to the Water Meter Division about possibly locating
the water meters in the back, but he didn't think they would agree.
Commissioner Springborn stated that they don't show the property
line distance on the east side of two lots. Mr. Hemingway stated
that he will put that on the plat.
In answer to a question from Mr. Hemingway, Commissioner Nickle
stated that it would be good to request the waiver on the length of
the cul-de-sac in written form.
MOTION
Commissioner Nickle recommended that the preliminary plat be
approved, seconded by Springborn. The motion passed 2-0-0.
Mr. Hemingway stated that he had not received the certified mail
green slip back from one of the adjoining property owners yet
because of a problem with the mailing address.

PRELIMINARY PLAT OF AARON SUBDIVISION
DUB DUNAWAY - N OF HUNTSVILLE RD, W OF CHERRY LN
The second item was a preliminary plat of Aaron Subdivision
submitted by Dub Dunaway and represented by Dave Jorgensen of
Jorgensen & Associates for property located north of Huntsville
Road and west of Cherry Lane. The property is zoned R-1, Low
Density Residential, containing 1.34 acres with five proposed lots.
Commissioner Springborn stated that the telephone company requested
that the 25' building setback along Cherry Lane be designated a
utility easement. Mr. Jorgensen stated that they did that.
Commissioner Nickle asked if this could have been done with lot
splits. Mr. Dunaway stated that there are a maximum of 3 lot
splits allowed and this is four splits.
Commissioner Springborn noted that the other utility companies
stated that they had no problem serving this.
In answer to a question from Commissioner Springborn, Mr. Dunaway
stated that he had contacted the Parks Department regarding whether
a lot with an existing house would have to have a parks fee. They
advised him that it would not and noted they would make a
correction in their recommendation in the amount of money in lieu
required.
Commissioner Springborn stated that the City Engineer had asked
that they show the size of the water line on the plat. Mr.
Jorgensen stated that they will need to put in at least a 2" line
and maybe larger. He added that there is an existing 8" line that
runs along the south side of the property.
In answer to a question from Commissioner Nickle, Mr. Norbash
stated that the City Engineering Division doesn't have a policy on
up-sizing existing water lines. He stated that he will talk to
the Maintenance Division about this. He noted that a 2" line
would be adequate for 5 or 6 houses, but they might want to switch
over the houses that are on the existing 1" line to the new line.
In answer to a question from Commissioner Nickle, Mr. Jorgensen
advised that there is some property to the north that is owned by
another person. Part of this subject property goes in back of it
and will be purchased by that owner. That part of the property was
not shown as a part of the subdivision.
In answer to a question from Mr. Norbash, Mr. Dunaway stated that
there is an existing fire hydrant on the corner of Huntsville Road
and Cherry Lane.

In answer to a question from Commissioner Springborn, Mr. Jorgensen
stated that they have no problem with construction of the sidewalk.
Mr. Dunaway stated that they do have a problem with a surety for
improvements on half of Cherry Lane. He added that he is going to
request that the Commission approve this without that surety.
Mr. Dunaway stated that they did a development like this recently
on Dockery Lane and one on Ray Street. They are having trouble
with bills of assurance as far as loan companies making loans on
them and getting title insurance.
Mr. Jorgensen stated that they have been having a hard time getting
surety bonds too.
Mr. Dunaway stated that he talked with Mr. Bunn about all of this
before he submitted his plat. Mr. Bunn stated that he would have
to recommend the surety for the improvements and it would be up to
the Planning Commission. Mr. Dunaway added that he agrees that
the improvements should be made, but they couldn't realize that
much of a profit just by obtaining two more lots. (Three of the
lots could be done as lot splits.)
Commissioner Springborn stated that he could come up with a pro -
rata ratio of what extent he would benefit from having two more
lots vs. having to do the improvements to present to the Planning
Commission. It might not be a bad idea to ratio it on footage.
Mr. Norbash stated that, even if they do lot splits instead of a
subdivision, they would be required to do the improvements on
Cherry Lane.
Mr. Jorgensen stated that they had planned to put a street light on
each of the existing poles. He added that he will show it on the
plat.
MOTION
Commissioner Nickle moved to approve the preliminary plat without
a recommendation on the off-site improvements, seconded by
Springborn. The motion passed 2-0-0.
There being no further business, the meeting was adjourned.
