OF THE FAYETTEVILLE PLANNING COMMISSION
A meeting of the Subdivision Committee of the Fayetteville Planning Commission
was held on Thursday, July 12, 1990 at 10.30 a.m. in Room 111 of the City
Administration Building, 113 West Mountain Street, Fayetteville, Arkansas.

LARGE SCALE DEVELOPMENT PLAN OF COLT SQUARE - PHASE II
BILL & DICK KEATING - LOTS 1 & 2, BLK 2 OF COLT SQUARE
The first item was a large scale development plan for Colt Square
submitted by Bill & Dick Keating and represented by Albert Skiles,
for property located on lots 1 & 2 in Block 2 of Colt Square and
Thoroughfare Commercial.

Albert Skiles, Architect, advised that the Plat Review meeting, the staff
requested that they show the contours, the drainage, and the sidewalk location
on the plat which they have done. Also, their plan to reduce the 50' building
setback on the east side to a 25' setback by putting in landscaping between the
building and the street has been noted on the plat. He advised that they have
contacted Hal Morton of the Solid Waste Management Department regarding the
trash dumpster service drive and location. Mr. Morton has stated that it meets
all of the requirements.
Mr. Skiles noted that the utility companies requested that they indicate the
easements on the plat which they did.
In answer to a question from Commissioner Nickle, Mr. Keating stated that there
are two existing fire hydrants and from their calculations they meet the 400'
distance requirement. Mr. Skiles noted that the hydrants aren't shown on the
plat because they aren't on this site. He added that the hydrant distances
will be confirmed before any building permits are issued, and if an additional
one is needed, they will provide it.
In answer to a question from Commissioner Ozment, Mr. Skiles stated that they
have shown the names of the streets on the plat as requested.
In answer to a question from Commissioner Nickle, Mr. Skiles stated that they
will submit proof of their notification of adjoining property owners as soon as
they get it.

MOTION
Commissioner Nickle moved to recommend approval to the Planning Commission
subject to the Plat Review comments and the proof of notification to the
adjoining property owners, seconded by Ozment. The motion passed 2-0-0.
FINAL PLAT OF KEATING ESTATES
RICHARD AND GEORGE KEATING - N OF TOWNSHIP RD, W OF PRIMROSE LN
The final plat of Keating Estates was submitted by Richard & George Keating for
property located on the north side of Township Road, west of Primrose Lane and
zoned R-1, Low Density Residential. The property contains .78 acres with 3
proposed lots.
Commissioner Ozment asked if he and the staff had worked out the contract for
the construction of water and sewer. Mr. Keating stated that, as he
understands it, the Parks Department is going to give some money towards the
project. It is really a question of the two developers, Mr. Kennedy and
himself, working out how they are going to share the cost of bringing the water
across the street.
In answer to a question from Commissioner Nickle, Mr. Keating stated that the
City Engineer was going to review this to determine if a variance from the
distance between street lights would be needed. He added that there is an
existing light in front of the Winwood Baptist Church.
Commissioner Nickle stated that, as he remembers it, when the preliminary plat
of this development was approved by the PLanning Commission, the only conditions
placed on the developer was that adequate driveways be constructed so that cars
won't be backing into the street. Commissioner Nickle stated that the building
permits should reflect this driveway requirement.
In answer to a question from Commissioner Ozment, Mr. Keating stated that he
is in agreement with the Parks Department's recommendation.
Commissioner Ozment advised that they will address the street light issue at the
Planning Commission meeting.
MOTION
Commissioner Ozment moved to recommend that the final plat of Keating Estates
be approved subject to Plat Review comments, seconded by Nickle. The motion
passed 2-0-0.
PRELIMINARY PLAT OF WATERMAN WOODS SUBDIVISION
G. TOMLINSON & B. BROOKS - S OF CLEVELAND, E OF SANG
The third item was the preliminary plat of Waterman Woods Subdivision submitted
Gerald Tomlinson & Bill Brooks and represented by John Mahaffey of Mahaffey
Engineers for property located on the south side of Cleveland, east of Sang

Avenue and zoned R-1, Low Density Residential. The property contains 11.42
acres with 23 proposed lots.
John Mahaffey advised that the developers don't have the covenants finished yet.
Commissioner Nickle stated that there was an easement requested from lot 18 to
lot 17 which isn't reflected on the plat. Also, the Plat Review minutes reflect
that the easement between lots 20 & 21 can be taken out. He asked if they met
the fire hydrant minimum distance. Mr. Mahaffey stated that all the lots are
within the required minimum distance.
Commissioner Nickle stated that the staff requested that the present owner and
the wooded areas be shown on the plat. The Planning Secretary, Elaine
Cattaneo, advised that the staff would prefer that there either be a note
reflecting that all the property is wooded or a tree outline on the areas that
are wooded.
In answer to a question from Commissioner Nickle, Mr. Mahaffey advised that a
sidewalk is shown on Cleveland.
Commissioner Ozment advised that the City Engineer indicated that there might
be a requirement to construct half of the street on Sang Avenue and Cleveland.
Ms. Cattaneo noted that the city engineer would be looking into the additional
right-of-way needed on both streets to ensure that what is shown on the plat
will be adequate.
Commissioner Nickle requested that the City Engineer determine if the fire
hydrants and the additional right-of-way comply with the requirements.
Mr. Mahaffey stated that they found an old deed which shows the 10' of
additional right-of-way on Cleveland has already been dedicated.
Ms. Cattaneo advised that the Water Meter Division has requested that one part
of Archer Drive be named something else since part of it runs east/west and part
of it runs north/south. She suggested that Mr. Mahaffey contact Jim Johnson
in the Water Meter Division regarding this. She further stated that the staff
would like Mr. Archer to be listed on the plat as the owner since he presently
owns the property.
Mr. Bonner, who owns property across Cleveland from the proposed development,
was concerned about the classification of Cleveland and whether additional
right-of-way will be required. Commissioner Ozment advised that the City
Engineer will be looking into that. Mr. Bonner stated that the Planning
Commission should take a look at the existing sidewalks in that area and the
problems with them. There is a sidewalk down the other side of Cleveland to
about Ashwood. At that point it stops because of a cement drainage ditch. He
advised that something should be done about having an integrated sidewalk coming
down Cleveland for safety purposes for the children who walk to Leverett School.

Commissioner Nickle stated that the issue of the sidewalks in that area would
need to be discussed at the full Commission meeting.
Mr. Fields, who owns property to the west of the proposed development asked if
the City has any intention of carrying the additional right-of-way offset from
this development on to the corner of Cleveland and Sang. Commissioner Nickle
stated that the City Engineer will be researching the right-of-way needed for
that street. Mr. Fields stated that they would object very strongly to that
street being widened because it would put their front door right on the street
and their driveway would be destroyed. Commissioner Nickle stated that he
doesn't know what the future plans might be, but they are requiring this
developer to provide 10' additional right-of-way at this time.
In answer to a question from Mr. Fields, Commissioner Ozment stated that
everything indicates that the utilities will be below ground.
In answer to a question from Mr. Fields regarding curb and gutters on Sang
Avenue, Commissioner Nickle stated that the City Engineer hasn't made that
determination yet.
In answer to a question from Mr. Fields, Ms. Cattaneo advised that the City
Engineer will submit a staff report stating the requirements for this
development by Wednesday or Thursday of next week.
Commissioner Ozment advised that the City Engineer's report should address the
curb, gutter & drainage on Sang Avenue, the off -set of right-of-way on Cleveland
and the sidewalk situation along Cleveland Street.
Mr. Fields stated that they feel that the sidewalk should be continuous all the
way down Cleveland Street and should be on the north side of the street to tie
in with the existing sidewalks.
Commissioner Ozment suggested that the Planning Staff should take a look at the
sidewalk situation along Cleveland before the Planning Commission meeting.
MOTION
Commissioner Nickle recommended that this preliminary plat be approved subject
to Plat Review comments and the city engineer's comments, seconded by Ozment.
The motion passed 2-0-0.
Elaine Cattaneo, City Planning Secretary, stated that they will need to submit
12 revised copies of the plat to the Planning Office by Monday, July 16th.
