MINUTES OF THE SUBDIVISION COMMITTEE
OF THE FAYETTEVILLE PLANNING COMMISSI0N
A meeting of the Subdivision Committee of the Fayetteville Planning Commission
was held on Wednesday, February 7, 1990 at 10.30 a m in Room 111 of the City
Administration Building, 113 West Mountain Street, Fayetteville, Arkansas.

PRELIMINARY PLAT OF FERGUSON ADDITION
FRANCIS FERGUSON - W OF HWY 265(CR0SS0VER), S OF OLD WIRE RD
The first item was a preliminary plat of Ferguson Addition submitted by Francis
Ferguson and represented by Harry Gray of Northwest Engineers. Property is
located west of Highway 265 (Crossover Rd) and south of Old Wire Road containing
18 acres with 24 proposed lots.
This item was removed because the rezoning request on this property from A-1,
Agricultural to R-1, Low Density Residential was denied.

The second item for review was the preliminary plat of Regency Estates which is
being developed by Parks & Russell L'td Partnership and Spring Creek Addition
II which was submitted by Charles Sloan. These are adjacent to each other and
are platted on one plat and both are represented by Harry Gray of Northwest
Engineers. Property is zoned R-1, Low Density Residential.
Harry Gray submitted proof of notification of the surrounding property owners.
Vice -Chairman Springborn advised that the staff report recommends approval of
both of these subdivisions subject to: 1) Plat Review comments, 2) the
dedication of additional right-of-way along Old Wire Road to allow for a total
right-of-way width of 80 feet, 3) payment of the parks fees, 4) construction
of the sidewalks, 5) subsequent approval of water, sewer, street and drainage
plans and 6) submittal of a revision of Spring Creek Addition I showing the
changes reflected ont he Spring Creek II plat which could be done by a re -plat
of Lots 13 through 16 or by a revised Final Plat of the entire subdivision.
Don Bunn, City Engineer, stated that the Master Street Plan designates Old Wire
Road as a "collector" street in this location which requires a right-of-way of
60' to 80'. The staff's policy has been to ask for a dedication of right-of-
way with any new development in this area to acquire a total of 80'. He noted
that he thinks they would need to dedicate 10' in this case.
Mr. Gray stated that they wouldn't have any problem with dedicating 10' of
right-of-way there or any of the other conditions.

Mr. Bunn stated that the water, sewer and drainage plans will be approved as
submitted.
Mr. Gray stated that it will depend on whether they have already prepared
abstracts on the lots in Spring Creek I. If so, they will replat that portion
of Spring Creek I.
Mr. Bunn advised that the staff met with Mr. Gray and the owners to discuss how
the street should tie through and the staff felt like this tie -through from
Street "C" to Ash Street would be satisfactory. Mr. Gray stated that they will
need a variance on Ash Street since it has a 700' cul-de-sac.
Mr. Bunn noted that a parks fee will not be required on the lot(Lot 6 of Spring
Creek Addition II) that has an existing residence.
Vice -Chairman Springborn asked for clarification on what Mickey Jackson, Fire
Chief, requested. Mr. Gray stated he requested a fire hydrant at the south end
of the new Ramsey Street because there are no fire hydrants at all on that
street. Also, they discussed in general other locations that will meet the
requirements. In answer to a question from Vice -Chairman Springborn, Mr. Gray
stated that Mickey Jackson agreed that a tie -through from Street "C" to Ash
would be best.
In answer to a question from Becky Bryant, Associate Planner, Mr. Gray stated
that they are showing a sidewalk along Old Wire Road.
Mr. Bunn stated that a Bill of Assurance or a contract of some sort between the
developer and the City with a sufficient time period specified which would run
longer than 5 years would be best for the widening of Old Wire Road along the
frontage of Old Wire Road. An alternative to that could be for the developer
to pay the City an equivalent cost now. In this case, it would be whatever cost
is judged to be involved in widening to a 31' street with curb, gutter and storm
drainage. Mr. Bunn advised that the answer might be to have the contract to
run a certain length of time and then if the City hasn't called it, require the
developer to come in and pay that specific money amount and put it in a fund to
be used when the widening takes place.
Mr. Bunn noted that an "impact fees" ordinance is going to be considered in the
new ordinances.
MOTION
Commissioner Cleghorn moved to approve the preliminary plat subject to staff
comments, the dedication of right-of-way, variance on the length of Ash Street,
a decision on what to do about the widening of Old Wire Road, seconded by
Ozment. The motion passed 3-0-0.
