HomeMy WebLinkAbout1989-04-05 - Minutes• • MINUTES OF THE SUBDIVISION COMMITTEE OF THE FAYETTEVILLE PLANNING COMMISSION A meeting of the Subdivision Committee of the Fayetteville Planning Commission was held on Wednesday, April 5, 1989 at 1:30 p.m. in Room 111 of the City Administration Building, 113 West Mountain Street, Fayetteville, Arkansas. MEMBERS PRESENT: MEMBERS ABSENT: OTHERS PRESENT: Julie Nash & Jack Cleghorn J. E. Springborn & David Ozment James Cramer, Doug Hemingway & Jim Lindsey and others PRELIMINARY PLAT OF MELANDA WEST SUBDIVISION NORMAN GABBARD - VELDA COURT, WEST OF ONE MILE ROAD The first item was a preliminary plat for Melanda West Subdivision submitted by Norman Gabbard and represented by James Cramer of C & F Surveyors for property located on Velda Court on the west side of One Mile Road containing 1.85 acres with 8 proposed lots. The property is zoned A-1, Agricultural and they are petitioning to rezone it to R-1, Low Density Residential concurrently with this plat. In answer to a question from Chairman Nash, James Cramer of C & F Surveyors, 3390 West Sixth Street, stated that there was never an original subdivision plat filed with the County. Chairman Nash stated that according to the Plat Review comments, the utility companies had no problems with this subdivision. The Planning Director commented that he didn't feel very strongly about requiring additional right-of-way. In response, Don Bunn who is the City Engineer stated that Velda Court is an existing 25' curbed and guttered street with a cul-de-sac and a 40' right-of-way. The houses are existing and are constructed so that any increase in the right-of- way would make the houses non -conforming. Since it is all existing and has been there since it came into the City, the staff doesn't feel any need to require the street to 31' width nor to increase the right-of-way. Chairman Nash asked what had been decided about the fire hydrant that was requested. Mr. Cramer answered that they plan to install one. Chairman Nash advised that notification to the adjoining property owners is not required nor are parks fees per Jim McCord, City Attorney. Chairman Nash asked if One Mile Road is a "collector" street. Mr. Cramer answered that it probably wasn't since it was so short and deadends at Old Farmington Road. In answer to a question about street lights, Mr. Cramer stated that there is a street light on Velda Court. Chairman Nash asked Mr. Cramer to explain why they are bringing this before them since it is already existing. Mr. Cramer stated that Mr. Gabbard had bought this 100 • • Subdivision Committee April 5, 1989 Page 2 as one tract with the houses already existing and now he wants to sell lots with a house off separately. Don Bunn explained that they would not be allowed to split this property enough times to sell all of the houses off so the most convenient thing to do was to subdivide it. MOTION Commissioner Cleghorn moved to approve this preliminary plat subject to the Plat Review Comments, seconded by Nash. The motion passed 2-0-0. PRELIMINARY PLAT OF SHERWOOD FOREST ESTATES - PHASE II JOE FRED STARR - ON THE EAST END OF LOVERS LN & CANTERBURY RD The second item of consideration was a preliminary plat of Sherwood Forest Estates, Phase II submitted by Joe Fred Starr and represented by Jim Lindsey and Doug Hemingway for property located at the east end of Lovers Lane and Canterbury Road containing 20.09 acres with 6 proposed lots and zoned R-1, Low Density Residential. Chairman Nash stated that she was a little confused as to what they were talking about at Plat Review when they mentioned a "gravel driveway" -.and a "street". Are these two the same? Don Bunn stated that the "gravel driveway" mentioned by the Fire Chief is the driveway for the two proposed tandem lots. The "street" mentioned is the one shown as "Canterbury Circle" which was originally named "Fred Starr Circle". Mr. Bunn explained that Lots 1 & 2 of Block 1 and Lots 1 & 4 of Block 2 have the required street frontage but Lots 2 & 3 of Block 2 will be tandem lots. The driveway back to the tandem lots is required by ordinance to be paved so many feet back and be maintained for fire trucks and emergency vehicles to travel it although sanitation won't be picked up down there. Don Bunn stated that they will be putting in a fire hydrant to satisfy the requirement mentioned at Plat Review. Mr. Bunn advised that Lots 2 & 3 of Block 2 cannot get into the sewer by gravity so they will need to have septic systems and are large enough for them. In answer to a question from Chairman Nash, Mr. Hemingway, Surveyor, stated that the perc tests have not been done but they plan to do them after the preliminary plat is approved. Mr. Bunn advised that if the perc tests fail, they have the option of putting in individual pumping systems and go back to the gravity sewer. Chairman Nash asked if they were willing to offer a Bill of Assurance that the perc tests will be done and the sewer will be worked out. Mr. Hemingway answered, yes. Chairman Nash advised they would need to take care of the land dedication or parks fee for the Parks requirement. Mr. Hemingway stated that they plan to do that. Mr. Hemingway submitted proof of notification of adjoining property owners to the Planning Secretary. 101 • • • Subdivision Committee April 5, 1989 Page 3 W. A. Vaughn who has property adjoining this on the southeast corner of this project stated that they don't object to this but there primary concern is that they are given some assurance that this wouldn't prevent future access to the North, to the East and to the South which would inhibit future development of the City as it grows on to the East. He advised that when they bought their tract of property, they had a 55' easement written in for future access or utilities running the full length of their property north/south to the full length of the Mott property to the North. He added they are concerned that there would be future access to the West from their property. He noted that he is a firm believer that there should be access on all four sides of your property. Chairman Nash stated that access on all sides is not required. Mr. Vaughn stated that they access to Fred Starr Road on the east side currently but he would like to see Canterbury Circle have an opening to the east. As it is now the Fire Department that they depend on is located on Hyland Park and they have to come all the way down Wyman Road and up the hill to their property. Mr. Lindsey stated that he recommended to Mr. Starr, the owner, that this proposed setup would be superior to a subdivision back here with several lots. Mr. Bunn stated that there would be no problem with extending the right-of-way of Canterbury Circle to the property line to the East but this would have to be worked out with the developer. Whether the owner would agree to any other easement would have to be determined. Chairman Nash suggested that this be resolved between the owner and the adjoining property owners before the Planning Commission meeting. In answer to a question from Chairman Nash, Mr. Bunn stated that they would be submitting detailed drainage plans when they submit their plans for the street, etc. Chairman Nash advised that the present subdivision ordinance states that any protective covenants are supposed to be filed with a preliminary plat. She asked that they attach their covenants, if any, to the plat before the Planning Commission. Chairman Nash advised that they are also supposed to show the location of all existing buildings in the vicinity as well as any existing parks, creeks, location & size of any wooded areas, any underground installations, bridges or culverts this subdivision will impact. Mr. Bunn stated that they are showing a street light and a sidewalk on the plat. Mrs. James Haynes asked that they not take out all the trees because they have a bird sanctuary there and a lot of wild animals around there. Chairman Nash advised that the Planning Consultant who is in the process of developing a new General Land Use Plan and zoning ordinances has submitted a "Slope Analysis" map which designates this area as one that they would hope would /01 • Subdivision Committee April 5, 1989 Page 4 not be developed until the new ordinances are in effect. Mr. Lindsey stated that he would like to point out that if they tried to develop this land under the standard method that Mr. Starr had outlined in earlier plans, the damage would be far in excess to what this plan will have. MOTION Commissioner Cleghorn moved to approve this preliminary Assurance and the engineer's approval of the sewer, the the Plat Review comments, seconded by Nash. The motion plat subject on a Bill of parks fees being paid and passed 2-0-0. 103
