HomeMy WebLinkAbout1988-05-04 - Minutes• • MINUTES OF THE SUBDIVISION COMMITTEE OF THE FAYETTEVILLE PLANNING COMMISSION A meeting of the Subdivision Committee of the Fayetteville Planning Commission was held on Wednesday, May 4, 1988, at 10:30 a.m. in Room 111 -of the City Administration Building, 113 West Mountain Street, Fayetteville, Arkansas. MEMBERS PRESENT: Butch Robertson (arrived late), Julie Nash and B.J. Dow OTHERS PRESENT: Dave Jorgensen, Mel Milholland, T.M. "Bud" Tomlinson, Sam Mathias, Todd Graham, Mrs. Howard Guinn, Karl Neumann, Andy Kitsinger, Jim Lindsey and Don Bunn PRELEIENARY PLAT - TOWNSHIP SUBDIVISION BILL LAZENBY - SW CORNER OF TOWNSHIP & OLD WIRE ROAD The first item of consideration was the preliminary plat of Township Subdivision submitted by Bill Lazenby and represented by Dave Jorgensen. Property located at the southwest corner of Township and Old Wire Road and zoned R-1, Low Density Residential. Dow asked Dave Jorgensen if he had proof of notification to the adjoining property owners. Mr. Jorgensen answered, Yes, that he would bring it in. Dow asked if the City was going to be rebuilding the intersection there at this property and putting in a stop light. Mr. Jorgensen answered, Yes. Dow asked if the easements had been worked out with Southwestern Bell. Mr. Jorgensen answered, Yes, they had complied with everything that was requested in the Plat Review minutes. He stated that the original layout had two more lots on it, but they had decided to make Lot Ill (the one that the existing house sits on) one big corner lot. Dow asked if the driveway on lit is going to remain where it is. Mr. Jorgensen answered, Yes. Dow referred to Perry Franklin's comments in the Plat Review minutes about the traffic on Old Wire Road blocking the driveways and stated that she is very concerned about this. She noted that Don Bunn had mentioned consideration df common driveways. Mr. Jorgensen stated that he had pointed out that they might be better off to do that. Don Bunn stated that they would need a waiver granted by the Planning Commission in order to do this. He stated that there is a requirement to be so far back from the property line and that would have to waived. Dow asked if that could be done at this Subdivision Committee meeting. Bunn answered, Yes. Nash clarified that he needs a waiver in order to have common driveways at the property line. Bunn answered, Yes. 60 Subdivision Committee May 4, 1988 Page 2 Dave Jorgensen asked if having common driveways was a requirement. Bunn answered that it was a suggestion but the Planning Commission can make it a requirement. Dow noted that sidewalks will be required on both Old Wire Road and Township Road. Mr. Jorgensen stated that they would probably request a Bill of Assurance on that. Dow asked if the additional right-of-way discussed in the Plat Review minutes had been worked out. Mr. Jorgensen answered, Yes, they have given the additional right-of-way required. Bunn stated that it looked satisfactory and that it should match up with the right-of-way given further to the West except right at the intersection. Mr. Jorgensen added that there is so much room at the corner lot now, if they need more temporary or permanent easement they will have room. Nash stated that the big problem is the off-site improvements. She felt that they should be required even though they weren't required on the subdivision west of there. Bunn stated that Dave was involved with the subdivision just opposite Cardinal Drive (south of Township to the East of Old Wire Road) as well as the Valley Subdivision and he said that no off-site improvements had been required at either of these. Also, the subdivision off of Township to the West of this development was not required to do off-site improvements. Dow stated that she thought that Bud Tomlinson's Valley Subdivision was required to do off-site improvements. Mr. Tomlinson stated that they had not been required to do them. Nash stated that if they go by the idea that they don't have to require improvements on this because we didn't on the other, then eventually they won't require them at all. She stated that it had been explained to her that the sale of the land may be contingent on this question and that does affect the way she feels about this. She stated that she would be willing to require the off-site improvements at this committee meeting, but that they could ask for a waiver at the Planning Commission meeting and get the vote of the full commission on it. Bunn stated that he felt it needed to be brought up at the Planning Commission. Dow stated that she has a problem with the frontage on the lots on Old Wire Road not being consistent, because of the critical traffic problem although the traffic light will help some. MOTION Nash moved to approve the subdivision preliminary plat based on Plat Review comments with the requirement that they contribute to off-site improvements, seconded by Dow. The motion passed 2-0-0. • • • • • Subdivision Committee May 4, 1988 Page 3 PRELIMINARY PLAT OF YORKTOWNE SQUARE, PHASE III WADE BISHOP - NORTH SIDE OF STUBBLEFIELD ROAD The second item of consideration was the preliminary plat of Yorktowne Square Subdivision, Phase III submitted by Wade Bishop and represented by Mel Milholland. Property located on the north side of Stubblefield Road and zoned R- 1, Low Density Residential. Dow stated that she had obtained a copy of the City Board of Directors minutes to be able to establish whether they had specified where the additional ingress - egress point should be when the next Phase of Yorktowne Square was developed and she found that it didn't specify. Mel Milholland stated that they had verbally agreed to develop Phase III before Phase II. Dow asked if they had proof of the proper notification of adjoining property owners. Wade Bishop stated that they have it and they will bring them in. Dow stated that she understood that they plan to tie into Manchester which will loop back in from Phase II. Mr. Milholland stated that Phase III will provide the loop. Dow stated that for now they will have a temporary cul-de-sac at the west end of Manchester Drive. She asked how long the temporary cul-de-sac would be there. Mr. Bishop answered that it would probably be a couple of years. Dow stated that they would need a waiver on the cul-de-sac length. Dow referred to Mickey Jackson's comment where he recommended that the two waterline systems be looped together. Mr. Milholland stated that they had discussed the looping since the flow was bad and they were planning to do this. He stated further that they have the fire hydrants on the plat in the locations that he and Mickey had agreed on after the meeting. The fire hydrants will be located between lots 6 & 7, Block 7 and between lots 6 & 7, Block 8. Dow noted that they would need to submit some drainage plans and specifications to Don Bunn. Bunn stated that they would submit those for specific approval after this had been approved. Nash asked Mr. Milholland if they had offered a Bill of Assurance for the street improvements along Stubblefield Road. He answered, yes. Dow asked if everything was squared away with the Parks Department. Mr. Milholland answered, yes. Mr. Milholland noted that they would need a waiver of the street light locations. 6). MOTION Nash moved to approve this preliminary plat based on Plat Review comments, a waiver of the length of the cul-de-sac, the Bill of Assurance for street improvements, the City Engineer drainage approval when Phase III is finished, a waiver of the street light locations, and presentation of proper notification, seconded by Nash. The motion passed 2-0-0. PRELIMINARY PLAT OF CEDAR GROVE ESTATES D.M. TOMLINSON & SAM MATHIAS - CORNER OF OLD WIRE ROAD & SKILLERN ROAD The third item of consideration was the preliminary plat of Cedar Grove Estates submitted by D.M. Tomlinson and Sam Mathias and represented by Mel Milholland. Property located at the corner of Old Wire Road and Skillern Road, east of Hwy 265 and zoned A-1. Mel Milholland stated that they have received a response from their notifications from all the adjoining neighbors except one, Harry Dixon. A member of the audience stated that Mr. Dixon no longer owns that property, it is now owned by J.D. Kraft. Bunn stated that they need to notify this person today. Dow stated that this will have to come up to the full commission for the rezoning request and it is on the agenda for the next meeting. Dow noted that the Parks Board had stated that they will probably request money in lieu of the green space. Dow asked about the blanket easement that the gas company has on this property. Bunn stated that the gas company is going to release that blanket easement. Dow asked if all the easements are in order. Bunn answered that they appear to be in order. Mr. Milholland stated that the gas line is going to be relocated. Dow noted that the fire chief had suggested an 8" water line. Mr. Milholland stated that Don Bunn had suggested that the larger line should go down Skillern Road when the water system is expanded. Bunn advised that the water system is limited by the size of this existing line. The only reason for a larger line in here would be the flows and he hasn't gotten any information on the flows as yet. If the flow calculations show that an 8" line is needed, then one would need to go in. Nash noted that Don Bunn had suggested the possibility of tying Renee Court into Skillern Road rather than having a cul-de-sac there. Nash asked if there was a reason why they didn't want access out into Skillern Road. Generally speaking, with the less accidents. Road is a major collector street. Also Heather the future. He stated that this layout will sale; some with a cul-de-sac and some on a main a major collector, the less entrances on it - Nash stated that she is concerned about the lots along Skillern Road having their backyard literally onto a street that they can't get to. Bunn asked if their are any subdivision covenants associated with this. Mr. Tomlinson answered that there would be some covenants. Bunn asked if they were going to require the frontage to be on Renee Court; would they allow driveways on Skillern Road. Mr. Milholland answered that they intended for the frontage to be on Renee. Mr. Tomlinson stated that they would note that in the subdivision covenants. A member of the audience stated that he was concerned about the sharp curve at the intersection of Old Wire Road and Skillern Road. This subdivision would bring more traffic on it and it would be even more dangerous. Is there any plan to increase the size of that bend or do something about it. Dow noted that the access to Old Wire Road from this subdivision is on the straight -a -way, but there is a problem with the curve. Mr. Milholland stated that they placed the entrance onto Old Wire where it is shown because there is better visibility there which makes it safer. Dow asked about off-site improvements frontage on Old Wire Road. Mr. Milholland stated that they propose as shown on the plat to improve Old Wire Road to City standards 15 1/2 feet from the center of the asphalt back to the curb. Dow noted that they would not be doing anything to the curve there. Mr. Milholland stated that they didn't feel that this development would contribute to any traffic along Skillern Road to the East. Mr. Tomlinson asked if driveway access on Skillern Road. Would it be put just into this subdivision, not past it at all. Bunn answered, yes. Mr. Graham asked if he builds on his property, could he hook onto the sewer line. Bunn stated that this wouldn't be a private line, Mr. Graham could tie onto it and extend it to his property. Mr. Graham asked if this property was rezoned how would it affect his property. Bunn stated that he wouldn't think it would affect it at all. Mr. Graham stated that at the back of this property, there was a 50' strip of property that runs east and west from Old Wire Road on the north side of this property that Mr. Skillern kept to be used as a street if it was ever to be all developed. What happens to it? Mr. Milholland stated that he would check into that. Mr. Graham asked how many houses would be in the subdivision. Mr. Milholland answered, thirty-four. Mrs. Howard Guinn, an adjoining property owner to the northwest of this property, asked if the gas line was relocated, what would it do to her yard. Mr. Milholland answered that it shouldn't affect her yard because it will be on subdivision property. Karl Neumann, an adjoining property owner on the north side of this property, asked if when they lay the sewer line for this subdivision, are they going to make plans to ever include his property. Mr. Milholland stated that they propose to run the sewer line along the low side of Heather Way and they don't have any plans to go up to his property line. Don Bunn stated that he would have to look at the situation, it would be entirely possible to extend the main line up there but the owners would be responsible for paying for it. Mr. Neumann asked how much it would cost. Bunn answered that the cost would depend on a lot of variables, but probably $10 to $15 a foot. Dow asked about the drainage. Bunn stated that they wanted to see how the drainage was getting on over to the creek there. They will have to submit their storm drainage plans to him for approval. Bunn asked Mr. Milholland if he could look at providing an easement for a future sewer line to be able to extend the sewer line to the adjoining property owners if necessary. Mr. Milholland stated that he could probably work around it and work with them. They may have to get together to pay for an encasement across Heather Way. They would have to talk with the developers. • • • • • • • • Subdivision Committee May 4, 1988 Page 7 MOTION Nash moved to grant the preliminary plat of this subdivision based on the successful rezoning of the property, the Plat Review comments, the waiver of the length of the temporary cul-de-sac at the east end of Heather Way, and notification of the last adjoining property owner, seconded by Robertson. The motion passed 3-0-0. LARGE SCALE DEVELOPMENT PLAN - AT THE INTERSECTION OF HWY 265 & HWY 45 LINDSEY CONSTRUCTION - LINDSEY MERCANTILE The fourth item of consideration was a Large Scale Development Plan for Lindsey Mercantile submitted by Lindsey Construction and represented by Andy Kitsinger of Fugitt & Associates Property located on the northwest corner of the Hwy 265 & Hwy 45 intersection and zoned C-1, Neighborhood Commercial. Dow asked if they had presented the notification of the adjoining property owners. Andy Kitsinger answered that E.J. Ball is the only adjoining property owner and he has been notified. Dow asked if the easements had been taken care of Andy Kitsinger answered, yes, the telephone company had asked for a 15' easement along Hwy 45. Dow asked if the access on Hwy 45 line up with the current one across the street at the Hot Wheels. Mr. Kitsinger stated that their proposed access is about 20' east of the current one across the street. Dow stated that she was concerned about this because of the potential traffic problem. She felt that this access should be as far to the west as possible. Mr. Lindsey stated that he agreed with Dow that it would be safer if it was farther west. Mr. Kitsinger stated that the highway department had said that the further away it was from the corner the better it would be. Robertson asked how far the proposed access is from the corner. Mr. Kitsinger answered that it was about 150' from the corner. Dow stated as it is now it would line up at least one lane with the access across the street. Robertson stated that he felt that 150' from the corner is adequate. Mr. Lindsey stated that the building had been moved farther back on the lot so that the someone coming in could go straight to the area they wanted to go to. He stated that their first thought was whether they could line them up. • Subdivision Committee May 4, 1988 Page 8 MOTION Robertson moved to approve the Large Scale Development Plan as submitted, seconded by Nash. The motion to approve was passed 3-0-0. LARGE SCALE DEVELOPMENT PLAN - WEST SIDE OF HWY 265, SOUTH OF KANTZ DRIVE LINDSEY CONSTRUCTION - KANTZ APARTMENTS The fifth item of consideration was a Large Scale Development Plan for Kantz Place Apartments submitted by Lindsey Construction and represented by Andy Kitsinger of Fugitt & Associates. Property located on the west side of Hwy 265, south of Kantz Drive and zoned R-0, Residential -Office. Dow asked if the adjoining property owners had been notified. Andy Kitsinger stated that E.J. Ball was the only adjoining property owner and he has been notified. Bunn stated that there will be two letters in the agenda from the only two adjoining property owners (Jim Lindsey and E.J. Ball) which offer no objections to this development. Dow referred to Mickey Jackson's comment about needing another fire hydrant installed in front of the 2649 Building. Mr. Lindsey asked if he wanted it in front or behind the building. Bunn answered that he thought Mickey Jackson had been talking about putting it somewhere in the island there. Dow noted that they would need to submit the drainage plans to Don Bunn for approval. Also, there are some regulations on the screening. She asked what zones this property is adjacent. Bunn stated that he wasn't sure that screening is required in this instance. Jim Lindsey stated that under a conditional use they have sought to be able to continue to be able to use it for apartments. Originally, apartments were allowed in an R-0 zone. Nash asked if they had talked with sanitation about the pads and screening required for the trash containers. Mr. Kitsinger stated that he plans to get back to sanitation about the screening. Bunn stated that it would need screening on three sides. • • • • • • • • Subdivision Committee May 4, 1988 Page 9 Bunn stated that the Conditional Use on this property is being asked for at the same Planning Commission meeting. Dow noted that this would all be contingent upon that being approved. MOTION Robertson moved to approve this the receipt of notification of Use in the R-0 zoning, seconded as submitted subject to the Plat Review Comments, the adjacent property owner, and the Conditional by Nash.
