HomeMy WebLinkAbout1986-05-22 - Minutes• • • MINUTES OF THE SUBDIVISION COMMITTEE A meeting of the Fayetteville Subdivision Committee was held on Thursday, Nay 22, 1986 at 4:00 P.M. in Room 111 of the City Administration Building, 113 West Mountain Street, Fayetteville Arkansas. MEMBERS PRESENT: Ernie Jacks, Sue Madison, Stan Green and B. J. Dow MEMBERS ABSENT: None LAKE ADAIR - PAY POND RANDY ADAIR - 2400 S. SCHOOL The first item of consideration was the large scale development plan for Lake Adair, a "pay -pond" located at 2400 S. School and submitted by Randy Adair. The property is zoned C-2, Thoroughfare Commereial. Janks asked if all requests have been met and Adair replied that they had, including proof of notifieation of adjoining property owners. Adair explained his fending plan and noted he has a telephone for emergencies in his home several yards away. MOTION Green moved approval, seconded by Madison, the motion passed 3-0-1, Dow abstaining as she bad arrived at this point. YORKTOWN SQUARE SUBDIVISION WADE BISHOP - STUBBLEFIELD ROAD The seeond item of business was the preliminary plat of Yorktown Square Addition located on the north side of Stubblefield, submitted by Wade Bishop and represented by Bishop and Mel Milholland. Property is 26 acres and is zoned R-1, Low Density Residential. Jacks asked about Greenspace requirement and it was determined that the Parks Department has advised that a land contribution in one quandrant is not applicable to a development in another. The Parks Department will make a determination whether Dash or land is required for this project by the Planning Commission meeting of May 27, 1986. Jacks asked if adjoining property owners have been notified and Carlisle replied that they had. Bishop stated that additional easements as requested, have been dedicated. He also noted he has changed several street names so as not to conflict with other City street names. • • • Subdivision Committee May 22, 1986 Page 2 Attorney Jim Boyd stated he was representing an area resident, Bob Bradbury. He said it appears that the plat proposed by the developer encroaches on his clients property. He noted that a surveyors stake has been found in Bradbury's yard. Milholland and Bishop agreed that there are existing warranty deeds showing the property under Bishop's ownership. Boyd said he and his client protest the proposed development as Bradbury has maintained a certain portion of the land in question for many years. Jacks advised this was a legal matter and Madison pointed out that a revised plat would have to be submitted if the results of a property line dispute changed the layout of the subdivision. Another neighbor, Dale Johnson, 1880 Stubblefield, expressed his concern regarding the size of the houses planned as well as the size of the lots. He said he was also concerned about Stubblefield Road saying he thought it was not designed to handle a lot of traffic. Johnson said the street is already heavily trafficked and has no sidewalk. Chairman Jacks explained that the usual process is for development to take place first necessitating the installation of sidewalk and street improvements. He suggested the City Board be petitioned for improvements to Stubblefield and asked Bishop if there will be any covenants regulating the size of homes in this addition. Bishop said there were no such plans at this time. Madison clarified that Bishop owns property immediately adjacent to this proposal on the east which also abuts Stubblefield Road. Jacks said it is to be assumed that Bishop would eventually tie into the street from that property. Grant Smart, 1427 Stubblefield, said he bought his home because of the character of the neighborhood. He said he felt Mr. Bishop was ruining the neighborhood with his proposed addition. Jacks said a developer cannot be stopped from using his property as long as he is meeting all City requirements. Bishop said he could not say, at this time, how large the homes will be in this addition. Smith said he was also concerned about the narrow road (Stubblefield) as it is already a fight to get onto it. Jacks said the City usually requires a developer to contribute to the improvement of the street along their property frontage. Kathyleen Whetson Kelley, 1601 Stubblefield, commented that there will be only one street to exit this development from for a long time. She said she thought there should be another way to get out. • • • Subdivision Committee May 22, 1986 Page 3 Nona Vinzant, 3290 Summerhill Drive, inquired into what or who determines the need for additional housing. Jacks explained that the City (Planning Commission) regulates the zoning of land and that an owner of property may develop that land. Dow had a problem with one entrance and exit onto Stubblefield drive she feels it is not adequate. Madison expresses concern about the street to the North being stubbed to the property line forever, and to attach a condition that no more than 20 units be built before such a street could be constructed for alternate access. MOTION Madison moved to recommend approval of this addition subject to 1. right-of-way dedication on Stubblefield Road; 2. a bill of assurance for street improvements to one-half of Stubblefield Road for the frontage of this property; and 3. a maximum of 20 units be occupied at which time a second access must be provided; and a recommendation that priority be given to widening and improving of Stubblefield (City participation). Dow seconded and, upon roll call, the motion failed to pass by a vote of 2-2-0, Dow and Madison in favor of and Jacks and Green voting against. This issue will be presented to the Planning Commission for review on Tuesday, May 27th. Green stating the subdivision committee looked at this plat in 1984 all the same concerns existed then. We recommended approval on a similiar subdivision on the basis that the street entering into the subdivision line up with Loxley, Green stating he really did"nt see any change in the last 2 years and that the City had not done anything about the street, the only problem with approving that subdivision was the jog distance. Madison moved to amend the motion, and to send a recommendation to the street committee of the city board to consider putting improvements to Stubblefield on the TIP schedule. Bishop points out the financial burden on any developer to fulfill the request for streets, storm drainage, and water & sewer taps, all have to go in at that time. PARADISE VALLEY SUBDIVISION LINDSEY, SEXTON & REYNOLDS - JOYCE STREET Third item of business was the Paradise Valley Subdivision located on Joyce Street, East of Old Missouri Road. `qA • • • Subdivision Committee May 22, 1986 Page 4 Jacks questing all utilities easements have been satisfied. Motion will be made upon plat review comments, also concerned about fire hydrants, Jacks requested 3 hydrants with the plat showing 2, Hopper then agreed with the 3 hydrants. Jacks asking if report from parks board has been submitted. Carlisle reporting both lindsey and Bishop would like to bank their green space requirement to the proposed park land on gregg street in the Northwest park district. At this point Parks Board will ask for cash or have the ordinance changed, Carlisle stating it would not be retroactive. Jacks wanting status on Bill of Assurance for upgrading Joyce to arterial standard 31 feet back to back to curb. Hopper stating they will sign a bill of assurance for Joyce street. Dow questioned the developers plan to build single family dwellings, Hopper reiterated the intention is to build single family but the developer holds the option to build anything that meets the R-2 zone Carlisle stated the date was wrong in the add and ask Hopper if they ran another add, Hopper stating yes. MOTION Madison moved to recommend approval of this subdivision subject to 1. plat review comments; 2. the Greenspace issue being determined by the Parks Department; 3. improvements to Joyce Street with the maximum as per Clayton Powell's recommendation, pending final resolution by the City Board as to determination of off-site improvements. Green seconded and, upon roll stall, the motion passed 4-0-0.
